Windy (I am not typing this new name hata kama nini), about what you say in the first post. Calculated, planned murder cannot serve as the defense of being driven beyond one's normal self-control. This is available in cases like, you come home and walk in on your SO with another and you go berserk and unleash some violence. If you go into the kitchen and find a knife, that will still pass. But if you leave and go contract a killer or look for a gun or otherwise act with calculation further and further away from the initial triggering event, you lose the ability to argue that you were possessed. It becomes more and more that you simply committed murder with forethought and all the rest of it.
