Ouru needs the courts more than the courts need him.  His predecessors understood that and therefore controlled the courts quietly through intimidation, bribery and appointing only fiercely loyal judges.  We got rid of that system under the new Katiba and the judiciary is just starting to emerge from that traumatic experience.  Once the judiciary realize that Ouru cannot do anything to them in this political atmosphere, they can rule without fear or favor and there is NOTHING ouru can do to them.  Mutunga was a coward and let them intimidate them, I hope this judiciary is not scared by these criminals.

Under a constitutional government the redlines for all the three branches is found in the constitution. Unfortunately, the judiciary is the only branch that interprets the constitutions and tell us  where those redlines are.  Go easy on the judiciary my friend.

No less person that CJ  recently declared 8.8.2017 election a red line that judiciary. There has to be a red-line that judiciary will not cross. I beleive having election on 8.8.2017 is one such red-line. If believe whatever conservatory orders NASA and it's groupies are seeking can be amalgamated into one huge petition and presented to SCOK. I know NASA after their last loss at SCOK are mortally afraid to go there...but that is where eventually everything will end.

Let IEBC hold election...and whatever damages that will occur....can be heard as form of petition. Constitution is indeed sacrosanct and judiciary cannot move the election date willy nilly.

Pundito, you talk like a child. Parliamentary majority, the electoral majority or the executive  powers that you talk of are only "powers" when you have a constitution and when everybody agrees to respect that constitution. Once you undermine that constitution then everybody else do not have to respect it and the only thing you have to control the opposition is the military.  Once ouru converts from a constitutional president to a military president then that is a whole different ball game my friend.  In 2013 the courts allowed Ouru and Ruto to run, we disagreed but we respected the law and let it be.  In 2013, when the court ruled against Raila's petition, we disagreed but we respected the constitution.  Now that the court has made a few rulings against your side, you are throwing temper tantrums and calling for ouru to overthrow the constitution.  You really must believe that this is a tribal presidency and not a constitutional presidency.  Do you really think that kalenjins and kikuyus can control this country without the constitution? Stop acting like a child my friend. You need this constitution just as we do and you need to put the country first and not your tribal ego all over the place.

There is nothing to intepret here. Election must be held every 5yrs on second week of August. You should have filled your many frivolous cases - last year - what NASA have done with there 40 (and more cases) is to try to misuse the courts - because they know they will get kichapo ya doggie in the election. Like the ICC shenagians - this will fail. It's okay if judiciary want to add Uhuru more years - - but Uhuru simply doesn't want that.

Only free and fair elections must be held every five years. If the court believes the election is not going to be free and fair then they can pick a date when the next free and fair elections will take place. That is a constitutional interpretation and only the judiciary has that power. Ouruto need to stop inciting and  misleading their supporters.

I do not think the rank and file jubilee want war.  They want to use their tribal powers to intimidate.  All we have to do is call their bluff.  When war begins everybody will suffer but we are not going to back down no matter what. The army only knows how to kill, loot, maim and rape and Kenyans do not walk around with NASA/Jubilee signs on their foreheads.  Those who are calling for the KDF to go on the streets may end up with their mother's, wives, sisters, raped, their property stolen or even killed. We all need peace but one side should not be intimidated into submission.  Let them continue with their hubris but the reality will dawn on them very soon. A lot of people are interested in the stability of Kenya and they are all watching very closely. At least now we have a friendly country where we can set up shop while we deal with jubilee's shenanigans.   If these elections are not done correctly, ouru will be an illegitimate president.  He will realize that this is not the Kenya his father ran through intimidation.
