Raila perrenial (sic) lawyer is done. Says Chebukati role was to declare but wanted IEBC commissioners to agree on issues - not really specified on what issues?
Can you  stop cheapening Mwangi contribution. He already has the quote of the day that came at the very end of his submission.  :sign0098:

The power to declare the P. elections, no way grants you the power to decide what to declare!

It is a fantastic argument, that puts SCOK decision making mechanism right at the heart of the argument against Lone Ranger Chebukati.

Superb argument by Paul Mwangi. SCOK is collegiate, even football decisions are collegiate even with the screen referees and umpires. It is not a one-man show like Chebukati.

Pundit do you like this detail?

I disagree. Raila wont be in such a long loosing streak. He should have fired Mwangi and many of his close advisors ages ago.

Murgor mentions Chebukati PA (Kwanusu) but does not remember his name. Downloading and conversion from the system and thereafter uploading them into the system. Now he mentions CSV files and PDF. PDF cannot be edited but CSV can be edited. This is where numbers were changed in 34As otherwose there would have been no need to download and upload after hours or a few seconds.

That is pure nonsense.
Form 34A - is original in pdf - this immutable source of truth.
Form 34B and C - are collation of form 34As - in an excel or csv format.
How else do you imagine the CRO and PRO (chebukati) - would add up all the form 34As.
They entered form 34As into a spreadsheet - and generate a form 34B and Form 34C.

Mr Njoroge evidence shows there was working back from 34C towards 34A. From Njoroge's report, you see too much activity all starting with the generation of 34C. It can be surmised that the IEBC is editing and changing something. The hypothesis is that there was a result for Ruto beign arrived at before the tally was in and work was being done to fit 34A and 34B into that equation. The effect was that the players made mistakes and Chebukati walked in to tell the commissioners who must have noticed that they can go and tell it to the birds in Serena.

Their biggest failure so far is FAILING to recognise the magnitude of the criminal enterprise they were dealing with.  It is not incompetence to expect your opponent to keep to the law.  Odinga has won all elections since 2002.

It looks like they were using goalseek to arrive at forms 34Bs ... these lazy criminals.

How did that help Raila when he boycotted the re-run - which is the relief he sought. Raila lost 97, 07, 13, 17 and 22. If he runs again in 2027 - the usual characters will be around him.

If Mwangi was serious - he would have told Raila that vote protection is everything - running to court - is normally waste of time. Raila should have had agents to stop rigging - and if they cant - to record it.

Murgor has shown the probative value of Githongo affidavit and Njoroge submissions. He shows there were intentional and overriding transactions to finally generate 34Cs. He shows it from several pages of the submissions.

Well, that'd still be an incredible failure and, if true, a total betrayal of the people's future.

Murgor finally mentions Dickson Kwanusu by name. He was granted access after the elections. He is not gazetted and not authorized to access the system. Kwanusu did 1743 changes in the system.

Philip Murgor: We see his (Chebukati's) hand through his PA.  Mr Kwanusu accessed the system and performed purported verification of 1,743 form 34As.
Abdi Dahir, who is not gazetted, also purportedly verified 659 form 34As.

IEBC has replied to those allegations with their affidavits comprehensively.

The only reason Murgor mention probative - is because he knows Githongo and Wasonga evidence - has very little probative value - it's heresy - and has been self-repudaited in another affidavit. So already poor quality evidence - than been half denied by the author.

Murgor has shown the probative value of Githongo affidavit and Njoroge submissions. He shows there were intentional and overriding transactions to finally generate 34Cs. He shows it from several pages of the submissions.

That's victim blaming.  At what point do we actually find fault with the criminality?

After it's been proven - in court of law - you cannot assign criminality from your armchair.

That is exactly how the IEBC portal is.
Murgor is taking up the technology issue: Must be simple, accurate, verifiable, accountable and transparent.
