Githu says the 4 commissioners have filed a fresh petition out of time. Asks Koome for an extension of time to resolve the matter. Says the four have committed subterfuge.

The four commissioner & IEBC continue to be a problem - are they respondents or petitioners? Githu also ask for more time.

Orengo - court has been very fair. Says it's 6hrs for each.

Former Amicus Curiae is not feeling very friendly today.   It is obvious the IEBC is split and the Chairman has gone rogue, and the court should listen to all parties.  Muite akae.  #SCOK

Raila argument that Mombasa and Kakamega was his stronghold - and gubernational election suppressed his votes- fails for among many reasons the results yesterday that were very close.

2nd reason - there was no big difference in turnout btw Kakamega & Vihiga or Busia or Bungoma.

Mombasa continued with historical low turnout.

Not true. It is not that close, it widened from 8K to 30K

Orengo and petition lawyers complaining of late filling. Last night - IEBC affidavits. Late filling by Kamau. Orengo want pretty much all evidence struck out.

Ngatia: E-filing system failed the petitioners and respondents. Asks court to consider the status of the responses so that issue of time is well taken care of.

IEBC & Chebukati lawyer - IT infrastructure & e-filling system had big problem on saturday. We did email. Confirmation was system was slow.

Further affidavit - from Githongo, Arnold, George Njoroge and John Wesonga - filled by the complainers.

These affidavit - filled way after they had been filled - raising new issues - touching on IT infrastructure.

Orengo and his lawyers ujanja :) - they keep raising new issues - then want to block IEBC  & Ruto team not respond - as their case mutate.

Their is no clarity - formal applications - to demonstrate any of affidavit was served out of time.

Eric (a lawyer we don't know) raises 3 issues.
1. IT infrastructure had big problem on Saturday. We did email to Judiciary and they confirmed the system was slow. Hence documents came in late.
2. A number of affidavits alluded to this morning are affidavits that arose out of a response by the same parties seeking to strike out the same matters, e.g. by Githongo, Arnold Ochieng, Njoroge and Wesonga. THese affidavits were filed way after the petition had been filed and raise new issues touching on IT infrastructure of IEBC. Naturally, we had to do affidavits. We had wanted to raise this with the court because yesterday they filed further affidavits to respond to the issues they had raised out of time. They have raised new issues on the petition before the court so that it mutates in form and character. From where we sit, because of the significance of issues at hand, we accepted that although they served, we worked and drafted responses so that if the court considers them pertinent, then their affidavits be allowed to respond to their issues.
2/3 Because there is no clarity on what was filed in time, let the parties file formal applications with specific documents so that it can be demonstrated what was served in time so that no party is prejudiced.

Ngatia lists several affidavits by Karua (27th, sworn on 28th and received yesterday), Celestine Opiyo - served yesterday, Njoroge - served yesterday, Githongo - served yesterday, Ouko E - served yesterday, Wesonga - served yesterday, Arnold Ochieng - served yesterday, Githongo once again - served yesterday. These prompted a flurry of activity from us to respond, but when we tried to file, the system was slow. So there are new matters that we have not responded to.
