Raila argument that Mombasa and Kakamega was his stronghold - and gubernational election suppressed his votes- fails for among many reasons the results yesterday that were very close.

2nd reason - there was no big difference in turnout btw Kakamega & Vihiga or Busia or Bungoma.

Mombasa continued with historical low turnout.

Mutie - Which is the real IEBC - and we need rulling. Prof Githu Muigai pleading of IEBC. Isaa Manour & Muite - we relie on resolution of the four of the 7 commissioners.

Prof Githu - IEBC filed application on 29th - seeking to striken out - Isaa Mansour - the application is pending. We have notice of appointment that predates Isaa Mansour. No notice of change of advocate was filled. IEBC commissioners cannot procure legal services. They have committed criminal offences.

Paul Muite can continue to represent the four dissenting majority...total confusion.

Githu wants court to consider pleadings by Issa Mansour to be struck out. There was a change of advocates.

It is not the work of IEBC commissioners to procure advocates so those who procured advocates have committed a criminal offence. The four will enjoy services of Paul Muite.

Ngatia makes submission seeking to strike out the response of the four commissioners. Cites Art 140. Koome intervenes. She says there is the issue of counsel with the problem of how both IEBC factions seek representation. SCOK to rule on that.
