The judges association or JSC - or LSK - is better suited to raise such objections. I'm also sure this rich justice can afford the best lawyers unlike most other suspects.

You've always been a Ruto guy and that's OK. The UhuRao vs Ruto standoff is very good for Kenya. Imagine the President and Leader of the Opposition are actually fighting corruption. Looks like fiction. 8) If the justice is innocent his battery of lawyers will prove it, otherwise he has no right to be a justice.

Evil forces like corruption are really powerful. In Kenya this force has manifested in the face of William "Mr Efficiency" Samoei Ruto himself. Without the handshake and Raila's help Uhuru wouldn't stand a chance against the brutes. God bless UhuRao.

Unfortunately, the fight needs a long time to be effective. 5yrs may not be enough. The next person may not pursue throw cool water onto it, just like Kenyatta did after kibaki. having said that, I commend these rivals for coming together to fight a great cause.

Arresting and successfully prosecuting a judge are two different things. We have seen high profile arrests of late but even the old cases like NYS I are yet to take off. As of now to me it is all PR.

She has always been corrupt and didn't deserve to be DCJ. I am glad she is gone down. She is also probably most to blame for decision to annual election without merit. She was connected to Amos Wako - ODM senator - and was leaking info to NASA.

Deciding on a case launched two weeks ago by the island’s attorney-general, the Royal Court of Jersey ordered the seizure of about Sh520 million in the offshore account belonging to Windward Trading Ltd after the company pleaded guilty to four counts of money laundering.
The company, according to court records, admitted to laundering proceeds of crime between July 29, 1999 and October 19, 2001.

Gichuru & Okemo issues like with our corrupt courts - no DCI. And beside I don't want DCI wake up all dead ghosts of 90s and 2000s when we have all graft. What is obvious is that Uhuru's men are leading this fight against "graft". Those are NIS-DCI-DPP - all working for Uhuru - and the war is led from interior ministry. If I was Ruto surrogate I'd be worried because it obvious PUTIN are in charge of the war - that explain why Matiangi is still out there. I'd be even more worried if I was Raila surrogate because Raila has no leverage on Uhuru.
This war has gifted Uhuru constitutional powers he doesn't enjoy. Ruto having been in power understands that - and was first one to ran to the hills - just like he did with local tribunal - the foolish ones who remain silent will be sacrificed.

I am assuming you mean Ruto, because Ouru is not going to be arrested. Having clarified that, the investigation and the gathering of evidence against Ruto must be thorough otherwise we may end up with a case similar to the ICC situation. That Ruto is a thief is not even debatable by sane people. What we know is that Ruto will wage a political and tribal war when arrested and therefore the evidence must be overwhelming. I do not understand why this should be difficult given the fact that he has amassed so much wealth and has so much property in the country. However, one must appreciate that Ruto is a very shrewd operator and he may have methodically wiped clean his finger prints and foot prints from the crime scenes. It may therefore take a little while before he is ultimately tied to a crime with sufficient evidence to warrant an arrest that would lead to a conviction. Ruto will be handled very carefully because of the kikuyu hostages in RV and therefore the timing must be perfect, the planning must be done meticulously and the arrest, if any, must be supported with overwhelming evidence and deployment of adequate security.

And hope springs eternal.The best PUTIN can do is to target Ruto men - but like Matiangi or Waiguru case shows - the moment you start seriously fighting corruption - you'll find yourself entangled in it. If Uhuru has Ruto dirty - Ruto has Uhuru dirty. The same can be said of Raila. The eating was done jointly - wherver there is Ruto CS - the PS is Uhuru - the same is cascaded through out. That I think is insurance the big boys have...against the war. Of course at end of day - these are show trials - securing conviction for any of these cases is hard.

I'm not naive, I know he can't arrest Matiang'i because this is a political tussle with Ruto. I'm cheering the outcome of the war not the intent which is selfish as always. Right now noone can dare sniff a coin illegally in the entire GoK, noone wants to be picked up by mean kacheros at dawn on Saturday.

I think former Nairobi Town Clerk John Gakuo was jailed 3 years over the cemetery land saga. And his property taken. There are a few successes. The biggest payoff is deterrence of thieves. Before this it had become free-for-all.

This war is about dismantling Ruto's looting network and scuttling his campaigns. Both are succeeding - already the national debate has changed with Ruto on the defensive. It's not possible to arrest him because he's too clever and powerful. Sabotaging his political plans is all that is needed.

To be honest this is way too disappointing by DPP (or was it DCI?) who instigated this to gloat about. Mwilu is being accused of having influenced/colluded (used her office) with the receiver manager of imperial bank to do an equity release on her charged property and then evaded paying taxes (stamp duty) on the resultant sale of this (her) property! See attached charge sheet.
Really...!!! We have people who have stolen billions...not declared this revenue (obviously proceeds of crime; enrichment from a position of responsibility, clear abuse of office) and are walking freely around. In mind comes the famous Champion of corruption no. 1 and no. 2.
It is not that she was bribed Shs.12m, it is that she evaded paying Shs.12m in taxes. We don't even know whether it was her directly or her agent who was processing the property sale on her behalf who (may have) crooked the forged KRA stamps ostensibly to show payment but otherwise diverted the loot to his pocket. This is where i agree with the thinking that her matter should have been processed through the JSC and then she faces prosecution or whatever consequences once he matter has been dispensed with by JSC.
If DCI or DPP or EACC wanted to nab all the mega thieves of public money all they need to do is go to the leading estates in Nairobi where the nouveau riche have acquired a taste for (Karen, Lavington, Runda, Loresho, Rosylyn, Ridgeways, Muthaiga etc.) and inquire about their ownership.... knock door by door making inquiry about the source of funds in purchase of these "mansions". From here do the Al Capone dance (ask Mr. Taxman to demand his tax while you confiscate the same on the basis of proceeds of crime). A random sample will fish out massive returns that will make Mwilu's case peanuts really!
This is why I would view this as wichhunt....it doesn't deserve the high drama it has elicited. I though it was a big one... a mega crime. This is nothing really. Ruaraka Land is a biggie staring us in the face... i thought this is a slam dunk; a real low hanging fruit! But Noordin cant seem to crack this one... We read this last week that Uhuru's nephew crooked someone Shs. 100m and he bundled him in until he returned the loot, also variously that Shs.500m in cash was found in his residence in Muthaiga. Why isn't Noordin jumping at this...why isn't KRA asking him questions about their portion of tax revenue from this Shs. 500m revenue? What business does he do to be keeping Shs.500m under his mattress??
It is said that a lot if not most of the plots/mini-ranches bought in Masailand is by public servants who come with money in the boot... a casual walk around the newly acquired Kajiado plots and newly built mansions will reveal most of the owners being mostly civil servants and KRA employees (proceeds of crime...their 10%s or bribes for providing low/clean tax audits at a fee).

Well Mr Pragmatic, all Ruto supporters are pretending to be buffled or disappointed by the "charade" - as if they ever supported the purge to begin with. We all know it's a gang war among the former political twins turned bitter rivals Uhuru and Ruto. No honor among thieves... this vicious palace infighting is very good for Kenya. If Ruto is the big victim that's even better - a heartless crook marketing himself as a hardworker - real hustlers should sue him. Looting is the dictionary opposite of hardwork. William Ruto is the most corrupt Kenyan in history and is absolutely not presidential material.

I don't see a witch-hunt. Mwilu has the means to clear her name if she's innocent. She should not be spared because she only failed to remit 3m in taxes - that's alot of money. She should sue for damages if the DPP's case is baseless.

This is why I would view this as wichhunt....it doesn't deserve the high drama it has elicited. I though it was a big one... a mega crime. This is nothing really. Ruaraka Land is a biggie staring us in the face... i thought this is a slam dunk; a real low hanging fruit! But Noordin cant seem to crack this one... We read this last week that Uhuru's nephew crooked someone Shs. 100m and he bundled him in until he returned the loot, also variously that Shs.500m in cash was found in his residence in Muthaiga. Why isn't Noordin jumping at this...why isn't KRA asking him questions about their portion of tax revenue from this Shs. 500m revenue? What business does he do to be keeping Shs.500m under his mattress??
It is said that a lot if not most of the plots/mini-ranches bought in Masailand is by public servants who come with money in the boot... a casual walk around the newly acquired Kajiado plots and newly built mansions will reveal most of the owners being mostly civil servants and KRA employees (proceeds of crime...their 10%s or bribes for providing low/clean tax audits at a fee).
Noordin Hajj is giving me second thoughts about this war on corruption. With this Mwilu case, it seems like a charade.
Witch hunt is an appropriate characterization. Haj is abusing public resources.
I don't see a witch-hunt. Mwilu has the means to clear her name if she's innocent. She should not be spared because she only failed to remit 3m in taxes - that's alot of money. She should sue for damages if the DPP's case is baseless.

We for a long while put RV Pundit on some pedestal when he commented on issues of the day ... all good until .... the rubber met the road ... turns out the man was no different.. ... just another blogger with plattidues until bitten by "mtu wetu syndrome". But my post is not about RV Pundit, it is about this one - I have a simple response to @Pragmatic's insha seemingly written in personal anger. Step one, he should change his handle. He is does not merit that monika if he cannot discern "practical" approaches in tackling public governance matters. Secondly he is not a student of History. If he was he would have known how "boot-legging" rampant in the 1930s in the US came to an end. Al Capone was a notorious gangster who corrupted government officials and killled at will yet he remained free. It took the tact of a PRAGMATIC prosecutor to take an approach that would - WOULD ACHIEVE THE SAME END RESULTS - take him off the streets and put the evil man away for good! Prosecuting the thug for not paying taxes was easier because of a clear documented trail, than finding evidence to link him to the murders. Al Capone died a nobody while incacerated. Failure to pay taxes. I saw that 101 bit from the charges DPP lined up for Mwilu. Haji has learned some useful input he can use for his job, while the @pragmatic here learns nothing and can as well go on wearing off his fingers writting useless inshas. :(

Until Matianga and Prof Belio Sang are arrested for 1.5B loss of money I am going to term this war - a fake war - driven mostly by Office of President (OP) - misusing DPP & DCI & NIS. They need to arrest the head of Interior - Mr Matiangi - and then we will say for sure we ar enow fighting graft.
To be honest this is way too disappointing by DPP (or was it DCI?) who instigated this to gloat about. Mwilu is being accused of having influenced/colluded (used her office) with the receiver manager of imperial bank to do an equity release on her charged property and then evaded paying taxes (stamp duty) on the resultant sale of this (her) property! See attached charge sheet.
Really...!!! We have people who have stolen billions...not declared this revenue (obviously proceeds of crime; enrichment from a position of responsibility, clear abuse of office) and are walking freely around. In mind comes the famous Champion of corruption no. 1 and no. 2.
It is not that she was bribed Shs.12m, it is that she evaded paying Shs.12m in taxes. We don't even know whether it was her directly or her agent who was processing the property sale on her behalf who (may have) crooked the forged KRA stamps ostensibly to show payment but otherwise diverted the loot to his pocket. This is where i agree with the thinking that her matter should have been processed through the JSC and then she faces prosecution or whatever consequences once he matter has been dispensed with by JSC.
If DCI or DPP or EACC wanted to nab all the mega thieves of public money all they need to do is go to the leading estates in Nairobi where the nouveau riche have acquired a taste for (Karen, Lavington, Runda, Loresho, Rosylyn, Ridgeways, Muthaiga etc.) and inquire about their ownership.... knock door by door making inquiry about the source of funds in purchase of these "mansions". From here do the Al Capone dance (ask Mr. Taxman to demand his tax while you confiscate the same on the basis of proceeds of crime). If Mwilu is a big one to send the message, so be it. I have no personal interest in her tribulations, i don't know her. I have no dog in the fight! I said that i thought hers is chicken feed compared to the biggies in the same industry (tax avoidance, tax cheating, forgery, abuse of office) that he could very easily go for to send a clear message. As we were on this, Waiguru (corruption poster Champion no. 2) was on JKL Live last night telling us that she has a house in Kihingo (value KShs.120m/-) - mark you this one she acquired recently while a cabinet secretary, another one in Runda and some other properties she admitted to all from public servant pay!! She says she is a hard worker... has worked for 30yrs blah blah blah.. I don't begrudge or envy her "hard working" ways, you simply don't line up those on a civil servant pay. That right there is a good target for Hajj, but they all (EACC, DPP, DCI) seem unable to round up these felons.
I know all about Al Capone and the US/Chicago '30's and how it went down, I was not going to write a book about it; i just picked the case of how the taxman was roped in to neuter the menace. Mark you they had his bookkeeper ratting on him.... I simply spoke of my frustration/disappointment in Hajj for too much ado about nothing. Now it seems very likely that matter will go to JSC for processing. I am all for all the strategies/tactics he is applying as a precursor or in preparation for the big whale when he pounces on them (i hope that this is the strategy and that he does strike in due time). No sacred cows....

Do you know what corruption (and bad leadership) is doing to real honest hard working Kenyans? I will give an example close home. I am still holding out for my outstanding payment for last year crop delivered to the Moi's Bridge NCPB depot in December last year. As you are aware some crooked fellows were already paid for crop that did not even originate from this area; bought at a lowly Shs.1,100 - 1,400per bag from across the border and sold to NCPB at Shs.3,200/-. Very good returns, you wish you were in that Industry, but alas that isn't so for the farmer in North Rift whose total cost of production comes in at a range of Shs.2,200 - 2,400 per bag. I know our local expert Bwana Pundit will say that the subsidy should end and maize farmer be damned! That he is all for an open borders policy and letting in food from cheaper sources. I wonder how that will go for millions of Kenyans who live off their land. Now, I have other sources of income, how do you think it is going for the farmer whose only source of livelihood is the soil? I hate corruption on all fronts; whether practiced by my parent, sibling, close family member or friend.
I hope you now understand my agitation (or anger, as you put it) and source of disappointment with Hajj.

For Wanjiku it's the best thing since independence, for the corrupt it's the worst time ever, for Ruto it's double tragedy. Because of runaway corruption in Jubilee I voted NASA. When NASA claimed rigging and started secession and economic boycotts I disagreed. Then the handshake shook up things.
People here will stick to a tribal leader and call it principle. RV Pundit will tell you Ruto has transformed his life and will equally transform Kenya. Now how does a thief "transform" his life? Can his personal success be replicated nationally? What kind of leadership and inspiration do you expect from such a person? Does Kenya need William Ruto as President at this or any time? That's the debate here. Arrest Matiang'i and other dots and commas are details and excuses.
I say Kenya needs Ruto's "leadership" like I need a tumor in my head.

I tried reading that BD story and it’s not adding up. Either the journalist is inept or scared of contempt of court.
She took 59M loan,then 60M all secured by various parcels of land.
One questionable deal is the fact that the 60M was secured by a property sh,SME to acquire a year after disbursement yet it was the collateral. Possible the seller guaranteed her on the same,and after one year they discharged the title and charged it anew ....weird either way
What the journalists failed to capture was the other big loan. She applied for substitution of the collateral,which should be normal,but was advised to settle the 60M loan first and the balance on unsecured. All came to 65m. Her lawyer advises the receiver manager ,KDIC of a transfer of 65M Anne same is acknowledged. She is still servicing this loan and it’s not clear whether she got her title back or it’s still in the bank...this is the gray area they should have at least presented. They left so many gaps that one can’t possibly accuse her othe basis of this article.
Is her crime discharging a title while the loan is outstanding or what?

The DPP should have been more careful with this case. The DCJ is not a low lying fruit as he is about to find out. Kenyans are really hungry for him to fight crime and prosecutors make decisions all the time on which cases to prosecute and which ones not to all the time. This was a stupid mistake. The only upside of all this is that it may show that the current Kenyan courts is independent from the executive branch and not a rubber stamp as in the earlier years. This may help to separate Kenya from Uganda as we watch the Bobi wine saga unfold. The DPP office needs to be re-revamped, adequately funded and staffed with some of the best legal minds in the country if it is going to be entrusted with this monumental task of fighting corruption. Maraga said the court is ready but the DPP has proven that he is not ready for high profile cases where a defendant has 34 lawyers and a large political following. You cannot send inexperienced boys and girls after experienced women and men.

With the DCJ asking the DPP to hand over whatever evidence he has on her to JSC so that her departure manenos can begin, the drama is yet to unfold. It seems the DPP miscalculated this one. I do not see it ending well for him. Orengo and his legal team will once again score a big goal. I just hope Jubilee won't decide to revisit him personally.

Sorry I don't see the politics in this case for DPP. If the evidence is not water-tight Mwilu will just be acquitted and DPP will continue with pursuing other thieves. NASA worries about the threat to judges who dare side with them in future litigation hence their support for Mwilu - left to her own devices Haji would nail her - the nature of the case exposes her as unsophisticated. This is a smart play for NASA, but losing this one doesn't undermine DPP, Kenyans can tell he's faced with big kahunas.
