Judiciary if they don't throw this thrash out - will have themselves to blame. Ombudsman will kill judicial independence.

Only 300 out 350 mps voted. Also some Ruto men voted for BBI for their own reason. Ruto remembers has no official position on BBI - Mps are free to vote yes or no. Ruto has clearly said he is not leading NOs.

Isnt by voting Yes giving Uhuru a weapon to materialize some of the content without going the referendum way , If the Courts decide to either derail or delay the referendum .

Do not count on the judiciary. JSC is clearly in Uhuru's pocket and the SCOK judges starting from acting CJ have been humbled. CJ will soon be occupied by one who will not dare oppose the Executive. I would not put all my eggs in that judiciary basket.

RV , you seem to trust Judiciary too much even with past experience . I for example  have my hopes on them but still warry due to the machinations ongoing .

Based on the thinking of Uhuru insiders and how they were able to take DPP office by dangling a carrot to Tobiko , they might entice one of COA judges with Ombudsman so they can be well protected with  former judge Martha in JSC, Current COA Judge Warsame in JSC and incomming Ombudsman in JSC . Lets see how it goes .

Most judges are angry with Uhuru blocking their promotion and snitching on them with NIS fitina - so this payback times. But you're spot on Ngugi, Odunga and Chacha from past ruling are progressive pro-people anti-gov kind of judges. So BBI will drink water in high court.

Now before it get to SC.

It has to go to Court of Appeal.

There it will drink water...Court of Appeal is now down to 15 judges or so...from normal 30 judges....after Uhuru stopped promition and hiring..to replace dead, retired or promoted COA judges..so those judges at COA are totally overworked. In fact if BBI get there...they will deliver ruling in 2023 if they are smart :)

Now by time it goes to SC - that will be 2024!

Pretty much everyone in Judiciary hates Uhuru except maybe 2 or 3 connected judges.

And Uhuru with BBI bribed everyone except the JUDICIARY :) that he wants controlled. Will judiciary allow him to hang them - he already shown the rope in the 41 judges debacle - and ombusdman first business will be those 41 judges.

It going nowhere this BBI.

Go slow until it pans out. As of now...judiciary has the ball. If held in 2022 - Ruto prophetic advice would have pan out.

8 cases - mean there is a lot of ironing that needed to have been done - through Referendum Law - that Uhuru was not keen on. That tell you someone is playng games.

Raila wants a contest, If I was Raila advisor and an inner circle like Otiende and Orengo before the intimidation , I would have advocated in voting No. That ensures a guarentee for Referendumn. But then again Raila continues to be shafted , he just gave Uhuru a WEAPON he can use if things dont go as planned. Akin to BBI 1 , BBI 2 , BBI 3.
If this was really connecting with the grounds you would have seen Mt Kenyans in the streets and in television talking of a victory. But oh well Robina still waiting for Uhuru to handover Mt Kenya to Raila through P.K.

Central, Nairobi, RV and Coast got most of the seats..and Mps from there voted for that..but BBI is going nowhere. As for Ruto strategy..his formlessness is driving his opponent nuts.

BBI is nonsense to me and if it comes to casting my vote at the referendum, I will vote NO. But I want to say this:

While y'all reduce this to some armchair contest between Robina and Pundit and how somehow a Judiciary that now has a bottom-of-the-class as the new CJ will stand in the way of the machinations of a rogue executive, I am surprised none on this forum has seen the real significance of today's vote. The vote was won by 2/3 majority. Tafakari! Reduced to a paltry 83 MPs to count on in parliament, gives ideas to the other side. WSR precariously is now vulnerable to being removed from the office of the DP by a parliamentary vote of no confidence. And on that Judiciary will not stop such business of the house going ahead if it were on the order paper. Luto is about to be released to his UDA where he can campaign freely for 2022.
