I agree with submission but I think it ought to be done at High Court.

For instance, the Governor noted that there are currently 78 different issues proposed for amendments which affect at least 13 of the 18 chapters of the Kenyan law.

According to him, this presents an uphill challenge to those charged with civic education and public participation.

On the issue of whether public officers should use state machinery to drum up support for the referendum, Governor Kivutha argued that it would be an unfair fight for others who do not have the luxury of state resources.

We should see flurry of activity at high court division of human rights and constitution.. ultimately judiciary is being helped here...and will be do the needful..to keep their independence as the third arm of gov.

Meanwhile Ndii "Basic Structure" headed for 5 bench - you can bet a sympathetic bench will be entertaining this case. BBI 4.0 has better recall their BBI handchieth and remove judiciary ombusdman :). Otherwise one arrow from Judiciary is more than assured to delay and kill it.
