Jubilee should not bite NASA bait for talks

NASA storm out after Jubilee fails to show up in IEBC. There is really no need for any talks. IEBC have the constitutional mandate to conducts election. It doesn't need any political help.

They have no realistic path to victory; they know it; they've been trying to put figures into excel  but in vain- and they are yet to find ONE CREDIBLE SINGLE excel sheet that makes them win the presidential election  - despite spending a lot in tallying center. It obvious they are in this for NUSU-MKATE.

Jubilee should stay clear - right now the only risk is some Odunga Judge putting brakes in IEBC work - otherwise let us have the election - Uhuru already won in 8.8 and so if they don't participate - Uhuru has parliament and legitimacy.

The court found irregularities and illegalities. How can we then go to another elections with the same electoral body without any serious changes consistent with the courts funding. I think NASA should start to think seriously about not participating in this elections if IEBC has completely been  taken over by Jubilee (most likely sawn torture videos). Uhuru and Ruto are the heads of a criminal cartel not heads of a government and NASA needs to treat them as such. Serious talks about secession should now begin. There is no need pretending anymore to belong to one nation with these thugs.

In the supreme court, 1st and 3rd Respondent created then replied to their own case leaving the one placed before them unchallenged!

Nusu mkate talks cannot be held before the IEBC. NASA achieved its objective of turning up for the meeting knowing Uhuru would not turn up. I will explain after elections.

The court ordered the same IEBC to conduct election. If they thought IEBC mistakes were so grave - then wouldn't have given them 60 days to conduct election. It means IEBC can rectify mistakes - for example you don't need new commission or any changes - to enforce that all forms 34s should have serial numbers, water-mark and signature - that is just enforcing due diligence. If the server was not secure - they just need to secure it.

In short as we wait for detailed judgement where SCOK will address itself to process gaps/mistakes - IEBC should continue with preparation.

And I think even with a court order, IEBC can protest that it's unenforceable....appeal against it or something.

While I appreciate NASWA's whining, what prevents Jubilee from making totally unreasonable demands as well? They may for instance reject any team Chebukati lines up as NASWA moles. I think we need to move from people to processes however uncomfortable that makes us.

Wasn't it Weta who quoted some American judge who said you can't drive in anticipation of an accident? :lolz:

Let Ouru be a dictator as he has  always wished and let us not pretend that we live in a democracy. I don't understand why Uhuru's talk of constitutional amendment is dictatorial whereas Babu openly entertains going back to parliamentary system. Uhuru simply pointed out to the futility of Babu's presidency with a severe minority in parliament. You can substitute Babu with anybody else and the result would be the same.

Jubilee has the numbers and they must flaunt them, they was hard won. Had it been NASWA,they'd have flaunted them too.

Whether NASWA's demands ('irreducible minimum' as they call them) are reasonable or not is subjective.

You know the procedure of removing Chebukati. You can start it. You also know that barring any evidence from DPP -  there is nothing criminal about what IEBC staffer have done. IEBC can take internal administrative action - that may including giving warning letters or firing some of them - but nobody can tell them who to fire or not - you can tender you evidence and if commmissioners are convinced they can institute administrative actions.

But ultimately ONLY IEBC can conduct election. IEBC with Chebukati and his commissioners who ENJOY SECURITY OF TENURE will oversee the repeat election in about 30 days. I don't think there is anything more to talk about.

You are probably right, though I think Uhuru was just pointing to futility of Babu's victory with such a minuscule minority in parliament.

I have always been against a parliamentary tyranny of numbers. You just can't trust a Negro with all that discretion. That's something I can't and won't cheer. But it is a fact that the 277 petitions can't overturn


Whether parliamentary system enhances democracy is theoretical. It is undemocratic in the sense that Kenyans voted against it in 2005 and 2010.
