If a judge had sex with a litigant 40 years ago, it is not the time that passed by the fact that there is that link.

No.  I am sure she can explain her decisions on the basis of purely legal merits.  But I can also predict her decisions just by knowing her and, at the risk of upsetting kichwa, her tribe.

1. Recusal: Unless three other judges recuse themselves, the quorum for the SCOK is 5. I have no idea what would happen in event of recusals. It may mean no case and there would no other court constitutionally mandated to hear the petition. In effect Jubilee would win.
2. Photo I am not aware of any time limit for any ground for recusal. Ndung'u is hit by two of the most common grounds: Ex parte communications with lawyers or non-lawyers and Relationship/ communication/ affinity with an interested party. She has to make her own decision to recuse herself as our lazy parliament has not found time to pass a robust public administration and management act to deal with such matters. However if she fails, it may become a disciplinary issue for consideration by the JSC
