Once again start with Raila - you cannot ran out of sensible crimes he has committed -starting from attempting to overthrow kenya GOK and admitting it - I am sure he can be charged for lesser crime if treason is time-barred/limited.
When and where did Raila admit to treason?
To the best of my knowledge, Raila was charged with the lesser offence of Misprision of Treason. The state failed to offer a shred of evidence and when the defence moved for the charges to be dismissed with prejudice, Moi swiftly moved to detain Raila.
Raila being an Odinga and connected to the University of Nairobi was on the List of the Usual Suspects. The police were under standing instructions to arrest these in event of anything and sort them out later. Others were Wanyiri Kihoro, Prof Oyugi, Ngugi wa Thiong'o (before he fled for good), Koigi, Mukaru Ng'ang'a, Pro. Gutto,
Now I really don't know what role Raila played in that coup. The charge stated that he got a table out of his house and placed it in the garden where he had a radio "in furtherance and support of activities aimed at overthrowing ...". I too had a radio on a table that day. I was in school waiting to go home the next day. We got one of the school radios and placed it on a table. Three of those who were with me are now judges.
The coup was a Njonjo plan with the Air Force Commander. It was to take place when Moi was out. Ochuka seized the chance to forestall Njonjo.
