EACC Comments On Jersey Money Laundering

The head of the anti-corruption agency thinks ambulances would be a nice way of spending the stolen loot whose thieves are known and have confessed.  That's all he can come up with.  Keriako Tobiko has predictably not seen any evidence that can stand in court a Kenyan court.

There will be a tender.   Some enterprising fellow will import second-hand vans, paint them white, and write "Ambulance" on each.   The vans will then be parked some place and forgotten.

Which reminds me, what happened to the container "mobile clinics" and the Mafya House story?

I wish some guy like Omtatah could go to some court and obtain order that would block that money until Okemo and Gichuru asd delivered to Jersey.

My hunch is that given that this is "pocket change", it will disappear somewhere between Jersey and the Consolidated Fund.

What I find truly bizzare is the utter lack of any interest in the case by either Tobiko or EACC.  Here they have a cut and dry case, with confession to boot.  But they'd rather go after Eric Ouko for buying auditing software.  I know Tobiko is working on extradition.  Which means he has a lot of the evidence why these guys are wanted, including the confession.  Is there something, legal beyond my paygrade, that bars him from prosecuting the crooks?

Goldenberg Scandal is still going on - almost 30 something yrs.  A disgrance to justice.

At what point do Kenyans stop worshiping the rich? Somwone flying a helicopter will never think about the regular guy. Most rich Kenyans are not the Bill Gates type, rather the Trump types.

Isn't that assuming Kenyan judges are incorruptible, especially with this kind of stolen money? Not to mention that it would set an "uncomfortable" precedence for our political elite?

Gichuru was the target of the new NARC Government in 2003. The Kibaki government went after him with gusto. He was being pursued for corruption. A warrant of arrest was issued. Even though Gichuru was attending harambees and being seen in posh hotels in meetings with influential ministers and power brokers like G.K. Kuria, we were told he could not be traced.

He then surfaced obtained bail and the case went dead.

Gichuru would not be heard of again until the Jersey judgment. Note that Kenya was asked to surrender Okemo and Gichuru before the trial of their "companies" but declined.

The idea behind the delay is a The Rich Man's Precedence known in those circles as The Githunguri Judgment. It was delivered by Justice Madan to stop a long winding case started by Njonjo against Githunguri for the theft of 300 million. Madan ruled that 8 years was too long to pursue someone as it became a persecution.

Pattni has benefitted from it as have a raft of Anglo Leasing suspects. To benefit you simply draw out the case until you hit 8 years. To do that you need money to disappear police files, court files, witnesses, get judges to call in sick and court clerks to mix dates and fail to inform parties.

I agree that it would be most uncomfortable. I also agree that it is not given that even if there were grounds and was left to a judge, he would rule in favor. However lately we have seen some very robust judgments from the bench.

Earlier it was only Mumbi Ngugi (who I do not believe is Luhya because she wouldn't be called "Mumbi"). Then we had Odunga ( a Luhya from Busia I believe) and now we have Chacha (Kuria), etc. They have shown a rare degree of independence. There is hope.

Just for the record, I am mentioning their ethnicity because Duale created an impression that judges act for their tribes and CORD / NASA.
