It looks like a poorly executed murder. The APs panicked and decided to knock off the lawyer, his client and innocent taxi driver. Very primitive but there we are. My father never tired of reminding me never to even joke with an AP.

The cowardly lawyers are annoying me. This is not EJK as we know it. This just primitive murder by persons recruited to the police force for being foolish. Anybody with a score higher than D is rejected.

EJK is a completely different ball game. It is cleanly executed and no mistakes are made. Bodies if found reveal nothing about the killers except they were good. Most often though the bodies are not found and if they are, considerably longer than a few days. A person abducted in Kisumu could well be found in Mandera and vice versa. Sometimes the local authorities genuinely mis-identify the person and have him buried in some home - all the better for the EJK squads.

Likening this murder to EJK is harmful to the cause of fighting this vice.

Yeah I am sure they left all their fingerprints and footprints. This is just very stupid of them. I hope they get send to the worse jails.

Sad thing there's no supervision. Police can be corrupt, kill, not show up for work and still continue to work. Accountability from top to bottom is lacking.

If this is not EJK what is the criteria?  To me it's the same thing.  The idea that someone can consider the physical elimination of another as a viable option with impunity.  It's the same problem.  Failure of the rule of law.

I do not consider it EJK perse on the grounds that while the murderers were policemen, there is prima facie evidence that they acted based on private / personal motivation. The client had brought a complaint against the individual policemen for actionable offences. That therefore in my book becomes murder.

EJK is when a person is killed on the orders of the state with the state as the "beneficiary" of the death.

Here I am annoyed because the lawyers who clearly know the difference are shouting about this because it will not irritate the government and the government will definitely arrest, try and convict the killers. When that happens GOK will proudly add that to its propaganda and state that it takes EJK (under the now misguided/ misleading definition) seriously. The real EJK will continue unabated.

Nobody say that it is because a lawyer was involved: A lawyer working for Uhuru Kenyatta in state house was EJK'ed and to this day no sound has come from the lawyers.

I find it not entirely encompassing. The FARC is not a government but it kills as are other Quasi-government organizations controlling territory. Killings conducted by government officials but for private motives and gain should be treated as murder, even though some disagree.

Problem is, arent bosses supposed to be responsible for any police misconduct?
Do they account for their time when they are on duty, like log in hour by hour on what they did?
Under Nkaissery, these people have been encouraged to be rogue and murderers so he should quit.
There was no accountability when they killed protestors.

It was a mistake to stop lawful executions and commute death sentences to life. Many of those inmates are now free having faked deaths (it costs 1M and you arrange for a body to be buried in your grave). I know one man from my home area who should have died and the parents got his personal effects when he died. He comes home regularly drives a high end vehicle and his wife has added four more kids to the family. He has a wonderful alibi to commit more heinous crime.

I thought Uhuru would have the same no nonsense approach of his father who instituted the death penalty knowing full well that the majority of those to die were from his own Kiambu. He did not hesitate to sign death warrants presented to him. Hate or love him, that was a man by every description.

We got where we are now when Moi citing his topsyturvy religious sentimentality illegally stopped executions. The last persons to be executed were Ochuka, Obuon, Njeremani and a few other 1982 coup leaders.  Kibaki compounded it by commuting all death sentences. This must be reversed.

The death row convicts should face their lawful sentences.

Yeah you're onto something. Death sentence in kenya only exists in books. It has failed as detterent. This need to be enforced. They should hire the guy to do the this as soon as possible.

Kenya has no police period.

It is not about vetting a force where you will remove some of the rotten oranges but leave the rest intact because they were good at hiding their stench.

There is a simple way to get rid of the thieving killing bastards and create a clean force. Hdere are my suggestions:

1. Universities should start offering Police Studies. These should be four year degree programs
2. Only persons who have these degrees or equivalent such as criminology, law etc should then apply for intake in to the Police Academies.
3. These academies (which the Police can license to universities) can then focus on the para-military element of their education - shooting, etc
4. There should pass a law making physical fitness and good health mandatory
5. Policemen should not undertake non police work. Meaning pen pushing, and other bureaucratic crap in offices should be left to civilians who should be hired to do those jobs. That goes for provision of security at banks, private homes etc. Ministers and others should hire private guards to guard their homes and escort their mistresses to supermarkets.
6. All those old style cops (Grade D dropouts) will be removed from the force by natural attrition. Those young enough and ambitious can be sponsored for these courses to bring them to speed with the new better educated cops.

Ps I heard something to the effect that KU was offering some such studies.

What about parliament? Will they have hearings as an oversight body?

The death penalty is ok as long as one has been given the right of appeal and has exhausted each and every one of the possible avenues. If then the courts are of the final opinion that he should die, this should be carried out on a timely basis. Convicts have a constitutional right to seek for mercy through a committee that processes and makes recommendations to the President. This process appears to be stuck. It should be revived.

The issue of prison congestion which Pundit was on in another thread should be taken seriously. More space should be created and the conditions improved.

I am for the privatization of some of the prisons and the granting of concessions to individuals and firms to setup and run prisons.

Thank for the clarification on EJK.  While the end result is the same for the victim, EJK is defnitely in a different league from regular homicide.  It's more ominous when the entity responsible for enforcing laws is involved in breaking them.

Thank for the clarification on EJK.  While the end result is the same for the victim, EJK is definitely in a different league from regular homicide.  It's more ominous when the entity responsible for enforcing laws is involved in breaking them.
Its a complex world. I am a little rusty after I quit working with some organization that addressed it. I can however tell you the danger I see now is that of private death squads. These are most active when law and order collapses or becomes a service to be paid for. It is compounded by inactive or corrupt courts. A "market" therefore naturally emerges where people go to buy justice. You son is beaten by a gang on his way from the supermarket; you know the police will do nothing. In fact the policeman who takes down your statement gives you a number to call. You pay a certain amount, the gangsters are all shot dead.

It goes to ridiculous levels where domestic disagreements and divorces are sorted out that way.

Make no mistake, most death squads are run by serving and ex policemen. They may recruit some former soldiers but just for certain jobs requiring military training.

It is so hard to end death squads I sometimes say its impossible. Kidnappings, etc are usually the precursor to this situation. We have seen lots of those.
