Some of the solutions you are advocating for would lead to serious miscarriages of justice. If you allow magistrates to throw out cases on whims, they will collect bribes and do just that and cite delays, absence, not being prepared etc and you will have to eat your own orders.

If there is an inordinate delay the cases can be throw out without prejudice to it being brought back when parties are prepared. I have sat in magistrate court and all you hear is the magistrate guessing future dates....and complain you see from people held in remand...is them coming to court every time....for months or years..only to be told...something is not ready.

If we still have 700K backlog then clearly our case management is not working.

Just watching NTV interview btw lawyer Nelson Havi and Prof who sit in JSC. And I am getting a picture of Mutunga who should never have been our CJ. A feckless, reluctant and rudderless person who was pushed and held hostage by wakina Muita, Mutua and AhmedNassir.

Are we attributing this to Mutunga or to new constitution? It very hard to find Mutunga's own intervention outside changing the judges uniform, randomizing judge list to hear cases (which he undid the last minute by snatching the  case from Njoki who was the duty judge) and maybe the traffic offence regulation he came up with cops.
