First of all I do not believe Waiganjo was a "fake" police officer. He went through all the stages of being hired as a Police Reserve. I think he lacks a good advocate to start with. The issue of his status should have been number one. I know many people who were appointed "Police Reservists" verbally and went ahead to kill Kenyans in the name of being Law Enforcement Officers. That was as the Kenyan banks would put it, "
the general practice in the profession". The advocate should use that.
Secondly, once you remove the "fake" label, all of Waiganjo's actions become legitimate police work. He cannot be charged with offences when all he did was act as any policeman would. He followed the "
standard practices in the profession".
