Atwoli Should Appeal this Judgement Pronto

Pundit

I thought influence peddling and bribery had ended in our courts. I knew this Mabeya guy as a very corrupt magistrate who was once fired for corruption and was in fact imprisoned. How did he get back to the bench?

Could you try to dig up any record of this guy being sentenced to prison for bribe taking. It was around 1993 - 96 not later or earlier. He must have bribed the Court of appeal to let him off and joined the bench recently to "help" the Executive.

How on earth can someone sitting on a bench with universal national jurisdiction say he cannot award 500 million? Who stopped him from awarding less?

Atwoli is an internationally known figure. His reputation is therefore worth that amount , may be more. But if the judge thought the amount is too high, then that should not be the reason to not find for the plaintiff. It is the same as a murderer being let off the hook because the penalty would be too heavy! Is the judge tied to either award 500 million or nothing?

Apparently he was accused of accepting bribes and then the accuser withdrew http://www.nation.co.ke/news/JSC-clears-Mabeya-of-bribery-claims/-/1056/2729050/-/view/printVersion/-/13skrocz/-/index.html

It seems like one can say Atwoli murdered Muchai with minimal consequences.
