They will eat him on appeal and may still lose. Kenyan courts, including lawyers/clerks and entire fraternity will take you to cleaners financially if you chose bribery route. I helped someone many years ago in Agrey Michelle court and I got to understand how they work. Their bribery infrastructure is well oiled, especially if it is a criminal case. If you a villager/nobody like 90% of Kenyans, it is better serving the sentence than trying to use money because you will sell everything and when released, you will live poor the next 10 years. They will eat Mr Waititu but may squeak out. 53 million now but appeal process may eat 300+ million! Those courts are money pit, don't get yourself in trouble in Kenya if you have no network lol
