Court of Appeal: No Law Can Be Allowed to Undermine Rights

Consigliere has suffered a major setback. He thought his presence in the court would intimidate the court as in the old days. It is very uncouth and tasteless of him to dress up and appear before his former students in a clear attempt to intimidate them in to granting him his prayers.

Attorney General Githu Muigai's appeal against the suspension of eight clauses of the security laws has been rejected.

The Court of Appeal rejected the application on Friday saying the laws infringe upon the Bill of Rights as stated in the Constitution.

Judges Daniel Musinga, Paul Kiage and Agnes Murgor said no law can be allowed to undermine the rights.

They also said the State is yet to show that there will be a "vacuum in law" if the suspension is not lifted.

They asked security agents to capitalise on the other laws in securing the country.

Muigai, in his appeal on January 12, said suspending the anti-terror laws threatens national security.

He also said the High Court order was given in error of law.

The clauses suspended by judge George Odunga, after an application by Cord, are 12, 16, 26, 29, 48, 56, 58 and 64.

Cord said if the law is not blocked, the government will turn into a dictatorship.
