We have another busy body making a living from Kenya's fratricidal political scenery. We already know "Dr" Matsanga who goes around claiming to be helping Uhuru Kenyatta. With that kind of "help" surely who needs to be thrown down an abyss?

Meet Silas Make Otuke. He is living high in Nairobi. His full time occupation appears to rub Joho the wrong way. Don't get me wrong, I believe Joho did not lawfully earn his degree. However my hands are tied in his and other cases involving the high and mighty. Once the High Court in Uganda made a finding that the degree was valid and since nobody appealed and now we have a binding judgement, the matter is dead. Otuke has gone to the DPP. The DPP has now allocated our meagre resources to a pursue a matter he can very easily anticipate the outcome without having to expend much money.

We shall now have the CID on a gravy train. Like MPs they will insist on going to the scene of crime to investigate. So a trip to the Sheraton Hotel in Kampala is not out of the ordinary. I expect them to visit another scene of crime in Mombasa where they may just find a "last minute cancellation" to a Presidential Suit at the Nyali Beach Hotel. From here they will set out to "interrogate" Joho. Joho may choose to invite them to his palaces in Kanamai where they will mix some fun with serious work.

Lastly, who can really begrudge them if they accept a "present" from Joho in the name of a goat or even a 4WD? As the Luos say: Even the child who goes to fetch firewood for the mother eats!

I am not second guessing anybody. The closure of post offices in East Africa has made letter writing a doubtful exercise. Any way how could I expect Tobiko to write letters to Kampala University and to the Uganda Judiciary (the latter for a certified copy of the above mentioned ruling). Emails can be hacked so why blame him? A fax? You must be kidding! Faxes died when SMS came to. Any way, there are no telephone lines since Kenyans and Ugandans pulled them down and exported them as scrap to China.

The saga on Mombasa Governor Hassan Ali Joho's degree from Kampala University has re-emerged after the Director of Public Prosecutions ordered CID to start new investigations. DPP Keriako Tobiko said Silas Otuke, who is the Director of Youth Leadership for Democratic Governance and Guidance, has filed fresh claims on the authenticity of the degree.

 He has been questioning Joho's degree and his participation in the March 4, 2013 election. Tobiko in a letter dated November 5, told the CID director Ndegwa Muhoro, that Otuke visited his office on Tuesday and tendered a letter with an accompanying dossier containing fresh and or additional allegations and documents relating to the saga.

"Having perused the said letter and the accompanying dossier, I am satisfied and I do hereby direct that investigations into the above-captioned matter be re-opened and that a fresh, speedy and thorough inquiry be conducted into the matter and on completion thereof, the inquiry file be submitted to this office for appropriate action," said Tobiko.

He also ordered that Otuke records his statement with the CID and produce whatever evidence he has in support of his allegations. Tobiko said the previous investigations into the saga had been closed with no further police action for lack of evidence.

In April, the Uganda National Council of Higher Education had cancelled Joho's degree, prompting Kampala University, which awarded the degree, to seek judicial review insisting the team had no powers to annul it.

On Thursday last week, a three-judge bench struck out a case filed by Silas Otuke, a voter based in Mombasa questioning Joho's degree and participation in the March 4, 2013 election. Yesterday, the governor savoured a second victory when the Ugandan high court reversed the council's decision.

Justice Stephen Musota ruled that the council had no jurisdiction to either recall or decide over any degree awarded by any university in Uganda. He also found that the council acted illegally in the cancellation.

"The decision was reached in contempt of a court order and without giving any of the affected parties an opportunity of being heard, contrary to the rules of natural justice," said the judge who also ordered the council not to disseminate any information on the cancellation.

He added: "The court had also stopped the council from using the decision contained in the resolution of April 30 in any manner harmful to the interests of the applicant.

Joho's lawyer, Denis Mosota, hailed the ruling saying justice has prevailed.

"To us, beyond vindicating Joho's degree, this is a very profound and far-reaching decision as far as the regulatory powers of the National Council for Higher Education are concerned. The Judgment affirms the academic independence of individual institutions of higher learning," said the lawyer.

The governor of Mombasa, governor Hassan Ali Joho has cause to smile.

Uganda's high court has ordered Uganda's national council of higher education to pay costs to Ali Joho for wrongfully querying his degree.

Mombasa - The court presided over by justice Stephen Musota has quashed a resolution  made by the national council of higher education to have Joho's degree revoked. 

A court in Kenya a few weeks ago also rejected a petition by Silas Otuke ,who was querying Joho's academic qualifications.
In his judgement, Musota said,''National council of higher education acted illegally and overstepped it's statutory to query Joho's academic credentials.It also failed to give Joho and Kampala university a fair hearing.''

Musota added on that the power to revoke a degree on allegations of fraud is vested in the senate of respective universities.

John Kabagambe,the head of legal department at Kampala university said it was fitting for Joho to be paid costs.

The vice chancellor of Kampala university,professor Badru Kateregga  said he was happy over the court's ruling.

Kateregga said,''The courts ruling is not only a victory for Kampala university,but also a major milestone for all universities in Uganda.''

He said that Kampala university diplomas and  degrees are genuine and had always wondered why National council of higher education was doubting Joho's academic credential. 

In May this year ,the national council of higher learning had passed a resolution  to quash Joho's degree.

In response,Kampala university filed an application at the High court seeking a judicial review of the resolution.

One of the students leaders at the university,James Kato said that they have always been together  with Joho and their university as the case was proceeding in court.
