I would release the rest..but Keep Muthama, Kuria, Kabogo, Ngujiri and Sonu idiot.

Ruto is in charge and Kenya especially Nairobi is small. We in CORD also have people in the system and we get information. It is WSR who undertook to "discipline" CORD and this is how he is doing it. We know it. His motive is to scuttle the talks.
To my disappointment and perhaps WSR's CORD has postponed the Thursday Demos. May be they now know better. We are under immense International pressure to talk and not demonstrate.

I am totally against the cancellation. But then again it is most effective on Mondays. They are not serious. They think detaining Muthama and a few MPs would stop CORD. So they will not concede in the talks. I am sure we shall show them dust come Monday and Thursday. They will kill lots of people on Monday mostly in Migori and Kisumu and perhaps Kibera (if they can profile them and know they are Luos).
The anger I have is because thanks to Ruto, the demos were spreading in Eastern (Ukambani) and Meru. The arrest of Bosire has shamed Kisii Jubilee MPs in to total silence. Senator Muthama's arrest has brough know Jubilee operatives like Musila in to the open with crocotears

By CORRESPONDENT, MACHAKOS, Kenya, Jun 15 – Machakos Governor Dr Alfred Mutua says swift action must be taken against those who perpetuate hate speech to ensure the vice is stemmed ahead of elections next year.
Mutua said all citizens, and especially leaders, should be held to account and strong action taken when they engage in hate speech and incitement.
“Regardless of whichever political persuasion they come from the law has to take its course without fear or favour,” said Mutua.
He added leaders whose followers and supporters engage in violence should also be held accountable and action taken against them.
“It is interesting to note that not a single leader whose followers have been throwing stones, carrying crude weapons, burning tires and blocking roads has publicly issued a statement telling his or her followers to desist from the violent acts,” said Mutua.
Addressing a news conference in his Machakos Office, Mutua said the silence of leaders instead of condemning violent actions by their supporters means that the leaders support these violent acts and may be the ones organising and funding them.
“These leaders only condemn the police and not their violent followers. This is hypocritical behaviour,” said Mutua.
He said history has shown that it is vital that planners and organisers of violence be held accountable.
“I call upon the Inspector General of Police and other relevant bodies to peruse the law and take necessary action so as to instil discipline in the behaviour of all leaders. No one should be spared,” said Mutua.
He said the motto to deter violence should be: “Eneza chuki na ghasia uone” (Spread hatred, violence and face the law).
Mutua said strong action should also be taken against perpetrators of hate on social media adding some WhatsApp groups, Facebook and Twitter posts have been used to peddle lies, create tribal animosity and divide Kenyans.
“Those who participate in hate speech and incitement postings and forums should also face the law. The message should be very clear that no one should be allowed to burn Kenya,” said Mutua.
He said it is imperative to safeguard the peace Kenya enjoys adding there is no matter in this nation that should cause anyone to engage in violence.
Mutua warned that if the same path of polarization, intolerance and hostility continues, Kenya will experience a very violent election period come the 2017 polls.
“As Napoleon Bonaparte put it, You stop a revolution at the beginning not at the end,” said Mutua.
He said the time to stem this indiscipline and to save Kenya is now.

1. The 2 million floating Presidential election votes must unfloat
2. Votes must be counted at polling stations as the final and unchangeable result certified by all candidates
3. There shall be no re-tallying of votes in Nairobi and no alterations after the count at the polling station
4. One unchangeable Vote Roll to be available for examination by all citizens
5. No sharing of servers with a political party
6. No sharing of the same vendor with any political party
7. All outstanding corruption cases involving the IEBC be dealt with fully before the next elections

Obviously I belong to school of thought that strongly believe Raila lost and Jubilee won. And that there was no rigging. And that Raila is responsible more than anybody for the mess IEBC found themselves in.
If there was extra 2M votes for president...how comes Jubilee has way more MPs than CORD. I bet if you analyze the number of elected MCAs it probably correlates with presidential vote.
Rigged election like 2007...are very obvious..Kibaki ended with so few MPs/Councillors..it was obvious he had stolen the presidental vote.
Now if votes are counted and declared as final in polling station...what stop mass collusion from happening there?
Next IEBC will probably start a fresh....new technology, new register, and then election. Which will be won as always by the guy who amasses the largest tribal coalition.
CORD should not forget after this IEBC ; they need to get their act together; in places like luhya land (where it still weak), ukambani(weakening), Gusii (really becoming weak) and others like Maasai & pastoral kenya where it going MIA.
Anyway tough luck. I don't see how you'll unseat UhuRuto. Unless CORD was to back Ruto :)

I appreciate that you declare your interests ahead of expressing your views. So it is clear that you are pro Jubilee as I am pro CORD. That settles a lot.
About the floating votes: There is really no reason for me to bring in figures to prove what you can easily check. You know it never happens that 2 million people would go to the polling station just to vote for president and then go home. That only happened before in 2007 and we know why. But if you will have patience, I could get you the raw figures;
On Jubilee MPs being more than CORD: CORD screwed up on that. They had separate nominations which saw CORD aspirants running against each other. Some of the candidates had Jubilee backing. An example is Shabhhal of Mombasa who was bank rolled by Jubilee and almost won against ODM's Joho. All those were CORD votes. Then Omar Hassan and Kajembe went after each other. in such cases and where there was a strong Jubilee candidate, we saw him or her pass between Kalonzo style :D. Look at all the cases of intra CORD wars and see how many MPs we lost. This is changing. We shall have joint nominations and see how we shall fare in Nairobi especially
Kibaki faced one major party called ODM while in 2013 it was slightly different. We had Khalwale winning in ODM territory dominated by Oparanya.

Well I hope we can get new IEBC and supreme court starting on a clean slate. That is a small price to pay for peaceful vote in 2017. I am seeing Jubilee this time winning with an even bigger margin. CORD just has a lot in their to-do list. I somehow suspect Raila end game is to postphone elections & form a unity gov. The elected class would love it too...they get to extend their tenure. Jubilee should accede to firing of Isaac Hassan and team ASAP...we only have 1yr to election...so we need the new commissioners in max of 3 months..new registers...and new software...in election in about a year from now.

The eight Cord and Jubilee MPs who were detained on Tuesday over hate speech are complaining of cold, flu and chest pains.
Lawyers John Khaminwa and Harun Ndubi have moved to court to seek orders to have the MPs at Pangani Police Station taken to hospital for check-up.
The MPs held are: Machakos Senator Johnson Muthama, Ferdinand Waititu (Kabete), MPs Junet Mohamed (Suna East), Timothy Bosire (Kitutu Masaba), Moses Kuria (Gatundu South) and Kimani Ngunjiri of Bahati.
Women representatives Florence Mutua (Busia) and Aisha Jumwa (Kilifi) are also in police custody.
Police officers at the station declined to allow other leaders to see the detained MPs.
The Hight Court on Wednesday rejected an application seeking to release the accused lawmakers on bail.
Their case is scheduled for hearing on Friday.

Muthama and Junet charge sheets give the date of 11th that he uttered words. There is a slight problem. They were allegedly commenting on remarks made by Moses Kuria at a function he held a day AFTER (The 12th). So according to the police Muthama incited people at a presser on the 11th to talk about an event that had not taken place. Only the police can tell how he did that at a press conference he did not attend!
While Junet had a presser, it could not have happened a day before Kuria actually uttered his words.
This whole process is to tell Kenyans Kuria speaks for Uhuru and if you insult Kuria or his mother, you are insulting Uhuru. Even Moi would not stoop that low.

By arresting innocent MPs and then embarking on persecution? How about they actually do that to people who incited? Muthama has a previous charge for which he is bonded. He was not present at the press conference. The other CORD MPs at worst said exactly what WSR said when he made fun of CORD's list of negotiators.
This is not about defective charges alone. It is as you wrote earlier an abuse of police power, with the connivance of the DPP. What caused the DPP to soften his earlier stance on this?
Now let's assume Raila becomes President and as most GEMA think, he chooses to revenge. He could hold Uhuru and Ruto in police stations around the country (Nyanza to be precise) for days on defective or plain non existent and unheard of charges. They cannot complain and if they sue Muthama, et al vs The State will silence them.
As Muite has said this morning, this is a terrible precedent that can return to wreck the country.

Some Cord supporters are planning to block the Nairobi-Mombasa highway to protest the detention of Senator Johnstone Muthama over alleged hate speech.
Police have, however, warned that they will arrest those planning to cause disruptions on the busy highway.
Muthama was arrested on Tuesday alongside MPs Junet Mohamed, Timothy Bosire, Aisha Jumwa, Florence Mutua, Moses Kuria, Ferdinand Waititu and Kimani Ngunjiri over claims of hate speech.
His supporters said he was not at the press conference where he is alleged to have committed the offence.
The High court on Wednesday dismissed an application by the detained politicians for release on bail.
Justice Joseph Onguto said the reasons for the decision will be given at midday on Thursday.
This means the eight politicians who were arrested on Tuesday will remain in police cells until further orders are issued.
The politicians had moved to court seeking release on bail contrary to a decision by a lower court.
Chief magistrate Daniel Ogembo denied them bail and ordered their detention for four days pending further investigations.
State counsel Leonard Maingi said the politicians should have filed an appeal or a review of the magistrates orders, not a new application at the High Court.
The politicians said they were motivated to move to court after they were denied food at the various police stations they were taken to on Tuesday.
They said they were also denied water, medication and opportunities to see their spouses and relatives.

Cord Mps being held at the Pangani have boycotted the food offered to them at the police station
According to Nairobi News, the legislators have not eaten anything since being booked at the station and their families have not been allowed to give them delicacies from home.
The wife of vocal Machakos Senator Jemimah Muthama, together with the wives of the two Mp's, were barred from giving their husbands food prepared from home.
“They have refused to allow us to give them food and clothes to change. I do not know what other plans they have to torture them, “said Mrs Faiza Jamal’s wife Junet Muhammed.
Senator Muthama, Mr Mohammed, Mr Bosire, Gatundu South MP Moses Kuria, Kabete legislator Ferdinand Waititu and Kimani Ngunjiri are being held at the station on charges of hate speech.

Differential treatment by the same magistrate:
A university student accused of giving false information to two senior police officers was on Thursday charged after being found fit for trial.
Wicklif Ochieng' made claims that Nairobi ODM chairman George Aladwa recruited youth to be militia that would assist Cord leader Raila Odinga overthrow the government.
Ochieng' denied the charges before Milimani principal magistrate Daniel Ogembo.
He also denied giving false information to police that Professor Bernard Njoroge, a deputy vice chancellor of University of Nairobi, was planning to assassinate Professor Peter Mbithi.
Ogembo directed the accused to be released on a bond of Sh300,000 or a cash bail of Sh30,000.
During Ochieng's appearance on Tuesday, principal magistrate Joyce Oluoch ordered the accused to undergo mental assessment at Kenyatta National Hospital before pleading to charges.
The magistrate had also ordered that Ochieng be remanded at Kilimani police station until Thursday.
In the first count, the court heard that on February 1, Ochieng' informed Chief Inspector Fatuma Hadi Ali that one Omondi Karori and Aladwa had recruited him and others to be trained as militia in Southern Sudan.
Ochieng' told Hadi that they would be trained together with Riek Machar's forces to assist Raila take over the government after the 2017 general elections.

To be guaranteed a seat in Central you have to insult Raila and call for his death. To be elected in Nyanza and Western you have to stand up to Kikuyus. So how do you expect this to ever end?
That said, I would like to see tough action but not based on lies, vindictiveness and trumped up charges. There are enough people out there who make the real hate statements that need to be locked up. Ngunyi for instance. Why jail a woman who only posed a question similar to the one the DP asked a week earlier? Why charge Muthama for an offence he did not commit and when caught dust up an old one the DPP found unwinnable? Clearly this not a clamp down on hate speech. This is a clamp down on CORD.

Well, took it upon myself to do some research on this lady, Aisha Jumwa, from the coastal province, to figure out what she could have said that insinuates "hate speech". After searching the archives all I could find are examples of Ms. Jumwa castigating - and very eloquently so - the distorted and biased policies of Uhuru Kenyatta and previous Kenyan governments as it pertains to the coastal region of Kenya.
I can state unequivocally that I actually do find her to be a conscientious, fearless leader with a bright political future; an asset to the coastal folk in their quest for true equality in that republic.
