I expect they will postpone the by election until Sonko case is determined. Hearing will be expedited to beat 60 days deadline. This luckily means Wanjiku does not have to contend with delay tactics by the defense or petitioner - you have no evidence or witnesses you are ignored. Realize unlike Waititu- Sonko is aided by the CoK2010 60 days mandatory by elections.
Waititu was dead because 60 day by election window was missing as DG Nyoro took over. The defense - senate, Kiambu MCA - will ride out the rest of his term by delaying tactics. Case is only good for clearing his name. The irony is Kiambu case while clearing his name - contradicts Nairobi eligibility case. If we assume his impeachment is indeterminate- how can he be governor in 2 counties? If we assume he will loose in Kiambu - then he is ineligible.
In short Waititu goose is cooked. He must withdraw Kiambu case to be eligible in Nairobi. But that make him ineligible for life!
Side note: i don't get how your rogue judiciary won't just declare the JSC appointees as automatically sworn in. Their word is final afterall. This is the worst form of impunity Uhuru has done in Kenya. It much worse than Trump refusal to concede.
If you file a case today - expect settlement date 3-5yrs from now. Uhuru refused to hire 41 judges. That is huge backlog there. Waitutu has active appeal - and as long as the court has entertained it - he is clean kama pamba.
Let the man run - although Nairobeans will not elect him.
Is the case settled? I imagine so. But his petition is about Nairobi race not Kiambu. Waititu problem in Kiambu was worse cause there was a rival DG who swiftly took over. Sonko if he prevails Ag governor will be revoked and by election cancelled. But if high court upholds impeachment- it dead end just like Waititu- cause it no longer about County Government Act but entire Chapter 6. IEBC, EACC are already against him. Even usual NGOs types - Omtatas, Karuas, Boni Mwangi - are silent and won't lift a finger to defend Waititus.
Waitutu says he also challenged his removal in Kiambu. There was an issue of quorum.
This needs to get sorted asap. So i support this. Of course i think and hope Waititu and all sleazebugs be PERMANENTLY banned from public office - including CS, PS, MD, etc - not just elective. Kenya has no shortage of leaders so chokora can run the country.
Sonko case is different because he is contesting the impeachment itself - which is what Waititu should have done. Especially if the MCA accounts can be proven to have been hacked such that 2/3 was not met Sonko can get back his job. But I won't hold my breath unless he kneels before Uhuru and Raila. Also the case about the DG appointee - Meru lady blocked by DPP - is waste of time because she doesn't have the political backing to pass vetting stage.
Sonko has a better chance than Waititu to nick it. Ironically if Sonko succeeds- Waititu case is moot cause vacancy. And vice versa. They are both likely to be loosers... just like long list of Ruto NGO groupies, Aukots and Omtatas trying to stop BBI steamroller.
