Thirdway Alliance sue BBI

The party filed an urgent constitutional petition at the High Court challenging legality of the amendment Bill 2020, and asked the court to stop the process pending hearing and determination of the suit.

Through lawyer Elias Mutuma, it was aggrieved by the use of the state machinery to collect signatures. It also faulted the seven-day period given by the BBI proponents for signature collection, saying it was not sufficient time for Kenyans to read and understand what they were endorsing.

“The Bill is government-sponsored and not a citizen-driven constitutional amendment that would qualify as a popular initiative. It was not flagged by the citizens as envisaged in Article 257 of the Constitution and should not be subjected to a referendum,” said Mr Mutu

Thirdway Alliance argues that the BBI initiative was a political truce between President Uhuru Kenyatta and ODM leader Raila Odinga that should not be used as a basis to make changes to the Constitution.

Further, it wants the BBI secretariat restrained from presenting signatures to IEBC for verification and in the event that they are presented, the court should stop the commission from presenting the Bill to the 47 county assemblies for debate.

“The use of government machinery, state resources and coercion of state officers including Cabinet secretaries, county commissioners, chiefs and heads of state agencies to collect signatures was a clear demonstration of forcing the constitutional amendment on Kenyans,” said Mutuma.

Seem all losers have lined up in court - instead of hitting the ground hard. The exclusively low EQ NGO- types who attract 30 Kenyas even when they call a rally against graft or MPigs.

Ther is ZERO substance in the petitions - that why they are directed at SCORK and not the high court.
-public officers and/or resources are being used;
-"basic structure" cannot be amended;
-this is state- sponsored and not popular initiative;
-we want multiple choices;
-can MCA amend the bill;
-parliament is illegal;
-we want consensus first  :)

A chorus of nonsense... see what of the shit sticks. Hope spring eternal.

Ruto was cornered like a rat at Matungu MP funeral. It like when his dogs attacked Gideon in Baringo sometimes back. Raila did not even throw a punch

omtata alone has defeated gok projects but now you expect judiciary to self immolate.Bbi tried to appease all stakeholders except judiciary and Kenyans.It going nowhere.I expect IEBC to be stopped from verification until Third way alliances issues are sorted

Opponents of the proposed constitutional changes are working on a game plan to halt or delay the process until 2022.

A think tank within Deputy President Ruto’s ranks is said to have put in place concrete measures that will seek to have the referendum delayed to avert any political arrangement that could bring a campaign for or against the vote.

The fear within Ruto’s camp is that a referendum before the General Election could disrupt the political matrix for the DP, seen as a front runner in the presidential contest in 2022.

Though not adversely opposed to the proposals in the Building Bridges Initiative (BBI) report, the DP’s camp is however weary of a political contest that could drain them financially but also open up for campaign in regions they believed they had ring-fenced for 2022.

Already, the collection of signatures that ended on Friday with 5.2 million signatories has seen top politicians traverse regions to promote the Constitution (Amendment) Bill 2020.

ODM leader Raila Odinga, Kanu’s Gideon Moi, Amani National Congress’s Musalia Mudavadi and Kalonzo Musyoka of Wiper visited their regions during the signature-collection period.

Raila, who had not visited Mt Kenya region for a long time, went to Kigumo Constituency in Murang’a County to promote the BBI Bill. Mt Kenya region has been seen as swaying towards Ruto. On Friday, Gideon was in Embu to drum up support for the Bill, just shortly after Raila.

Ombudsman is not immolation and judges are smart to ignore Ruto lies. These are the same Odungas, Mumbis and Weldons you often whine about. They will objectively rule- and any spanner will be stayed as it snake to SCORK. The tools are with BBI crew - so you get a ruling today it get stayed tomorrow and BBI continues.

Look at Maraga advisory- has 3judge bench even been formed? Case will end in 2023.

Uhuru assault on judiciary didn't start now.This is payback. Those judges you're praising uhuru has unlawfully blocked their promotion and also appointment  of new ones who had dealt with issues like Maraga case.The same fate await BBI it will be adjourned until new bench is constitued by new CJ in year 2022.Ombusdman is an attempt to legalise the executive judicial attack that has been underfoot and Maraga has said it all..and asked for a No.Both Maraga and Mutunga are leading the NO.Bbi is going nowhere.Raila is a fool not to realise this

Raila/ODM are getting a taste of its own medicine . In 2017 they brought to court a flurry of cases in the fight with JP .
First is getting a CJ who will fight for Judiciary .

It was filled on Friday. I bet by wednesday BBI will be DEAD as dodo.  You need BBI 4.0 - this time round - remove women nominated Mps and Ombusdman - and maybe you can get as far as Punguza Mzigo did - that one enjoyed a lot of goodwill from kenyans.

But apart from Raila - BBI has very little goodwill from kenyans.

And worse JUDICIARY is their enemy.

It has NO HOPE. DEAD ON ARRIVAL.

Cok2010 amendment is NOT a joke. The process is long and arduous. One mistake - you're back to square one.

Let see when that order gets issued. Hope spring eternal.

Supreme Court rejects bids to stop BBI reggae

Parties challenging the Building Bridges Initiative yesterday suffered a setback after the Supreme Court sent them back to the Attorney General.

While rejecting direct admission of advisory opinion cases filed by Nandi and Kericho county assemblies, as well as Makueni Governor Kivutha Kibwana, the court ruled that the petitioners should seek the AG’s advice before it can take up the cases.

Nandi and Kericho counties are seeking to know whether MCAs can amend the referendum bill while Kivutha wants the court to find that the national government cannot run a popular initiative to change the Constitution.

High Court judge Jairus Ngaah had declined to bar Independent Electoral and Boundaries Commission from verifying signatures collected by BBI task force.

Justice Ngaah, in a case filed by James Gitau, said the verification exercise should continue as the case on whether IEBC has defied court orders by failing to incorporate diaspora voters in the exercise is being heard.

Gitau urged the judge to stop IEBC from verifying the signatures until diaspora voters are incorporated.

There are five cases filed before the High Court by economist David Ndii and others, another by nurses’ union, Thirdway Alliance and Justus Juma as well as the one by Isaac Ogola and Gitau.

The Chief Justice is expected to constitute a three-judge bench to hear the cases.
