This is only way to win the war against graft. let the thieves prove their loot is genuine. It way easier than proofing their criminal culpability. You cannot account for any wealth -  it by default proceed of crime - and it revert back to the gov.

Great work from Ngugi. Some of the Judicial staff are doing well with this COVID break. Nyakundi delivered 25 judgements yesterday from Malindi.

Maraga should call other judges and illiterate magistrates to order.

Judge Mumbi Ngugi is a class of her own. Most likely she will never get further than judge, but on integrity she is above all others.

She has a good heart - so can nail down the facts part of the law - but I think she fails the legal background/theory kind of thinking required at supreme court and court of appeal - where questions of law - not the facts of the case - are being addressed.

The lawyers here can put it better - but I believe at appellate or higher courts - the judges are more concerned with legal issues - question like is Abortion Legal - rather than did you do an abortion (lower court).

Questions of Fact vis Questions of Law.

So bigger brains - are needed at Supreme court where they deal with more "academic" questions of law - and I don't think she has those credentials..to sit with likes of Prof Smokin Wanjala, Prof Ojwang, Isaac Lenaola and etc.

Because she is incorruptible - she dispenses the question of facts - very expeditiously.

Judge Mumbi Ngugi is a class of her own. Most likely she will never get further than judge, but on integrity she is above all others.

Coz I have read many of her judgments - they come from a good place - but on novel issues - they veer towards judicial activism. Like suspending a governor that has essentially killed devolution. She obviously means well - and want to end graft.

But the road to hell is paved with good intentions.

She should be restricted to lower courts - because with her naivety - she can sink the country if she was to sit at higher court.

I am 90% certain she is not Supreme Court material. We need academicians and very brilliant lawyers in there.

How did you judge that she has no big brain?

Why has she not been sentenced to jail?  Is there a separate sentencing hearing?

It was hearing about assets taken from her on suspicion they are proceeds of crime.

She failed to prove they were from legit sources such as business

I am also not very sure...apart from scoring first class at UON law..I don't think she has the credentials...and so does Mwilu. Maybe the gender card. I think Ojwang, Smokin and Lenaola have solid credentials.
