WHEN RUTO MET SONKO ON APRIL FOOLS' DAY 2020

This is the story of the estranged Deputy President, and the coup'd, nearly ex-governor of Nairobi.

Once upon a time in Nairobi, the popularly-elected governor used his rescue teams to pour human excreta on Jacaranda grounds where the opposition leader, swindled out of his presidential victory, would be sworn-in as the people's president. Knowing that the day after (the swearing in), Jacaranda grounds would revert to its role as a social facility for all and sundry in the neighbourhood, we joked this act by Sonko would be frowned upon by the heavens, and our ancestors in toto.

Pouring human dung in the playfield of children for whatever purpose is not the act of a mind that has gone through renaissance. But few politicians if any in Africa, are post renaissance. Still, regardless of his voter pull and magnitude of his victory, we felt Mike Sonko had operated too much outside civilisation. He was too sheety.

Meanwhile William Ruto had of course made Uhuru Kenyatta president, twice, convincing him their narrow social base, the binary tyranny of numbers, was stable enough to sustain a rigging and contain Raila Odinga, twice in a row! Odinga, Ruto taught, was an old spent force, a waning Mchawi and Mgangha, a Lord of Poverty whose regression had been exposed and now, could be safely buried.

When at one time it was even revealed Jubilee was ready to pay Raila a very hefty sum to retire from politics, it became obvious there, belying this bravado, was an urgency, a desperateness borne of an insecurity which, as time prospered, hinted at the fear of living in a house of cards before a change of weather. And behind the scenes, a feeding frenzy commenced as if it was the last day on the bounteous Earth. (Billions for supplies of air to the NYS for instance).

All that looks a very long, long time ago today. In any case Raila Odinga did what he never does when he is up and dry. He went back to the people. He did, with a knife to his throat so said, if you believe Doctorates like Miguna Miguna and David Ndii. Howbeit the people responded to his plight, their plight. Even as morons like Raphael Tuju smirked off the ceremony as Kalongolongo, the people of Nairobi, knowing well they had the people of Kenya behind them, forced the ever trigger-happy animals of the security services to a parley and ceasefire.

It became obvious Jubilee's tyranny of numbers was dead. Having failed at the ballot, it could not be militarily enforced, not even in Nairobi alone for all of Sonko's populism. Something had to give. Not at the bottom, but at the top. The rule of human dung needed national sanitation!

And it did give. A bit. But enough for the nation to breath, more than a sigh of relief. At a time.

That was the decisive meeting when the estranged Ruto met the overthrown Sonko.

Wonder O wonder! while every Kenyan knew what was discussed between the two renegades marked for political execution, the NSI couldn't report with transcribed authority to the Handshake Presidency. This informational deficit provoked a harsh reaction from a section of those whom we can describe as handlers of the son of Jomo.

This comedy show struck me as greater than Sarah Serem's and Kamau Macharia's star roles as Kenyan tributes to Xi JinPin.

Kenya-China is a straightforward story of imperial domination. Kenya is a vassal state being a vassal state; Monicah Juma, Macharia Kamau and Sarah Serem are cogs being cogs, ancillaries, in the sense of handmaids. But the Uhuruto divorce is Shakespearean. It is like a classical Greek Tragedy writing itself. And we watch it live, unrehearsed.

For people like Ouru Kenyatta, these things about land are just weapons in a domestic fight between him and his deputy, now estranged. But consider the families of Jacob Juma and one, Mr Onesmus Mutinda, a surveyor executed on 27 September 2014, at Ruiri bypass (according to the DN report). For them, the case is murder gone unpunished. Theirs is to yearn for Justice, may be till death do them depart from the realm of sunlight.

A HOUSE OF CARDS can stand until a kick-in by some determined rogue, or hit by a burst of harsh wind. Corona is not enough harsh wind, methinks, neither is Miguna Miguna et al a motley herd or rogues determined enough. The house of cards so stands.
It is still comedy time.
Admittedly it is getting darker, but the phase is still more on the laughs than the grimace. The Ouch is still out there, taking its time, lurking like the depths of the Deep.

Geological time the changes may take, but bit by bit the puzzles arrange. All facts are known. For instance, the better men of days far gone, knew Nairobi City was on growth steroids. The budgeoning city would, within a decade or two, morph into a monster needing a SEWAGE PROCESSING reserve of no mean acreages. Essentially a depo and sh!tbelt past 5000 acres of managed swamp. Yes, those were not yet the days of high-tech meta algorithms, but good old math data projected a Megacity, a dense populated Metropolis hitting 10 million souls. --10 million heavy daily sh!tters. These better men of yonder knew all that pile of pooh, transformed to torrents of sewer, would need an estate the size of legendary sisal acreages of Basil Criticos, The Greek of Taveta.

And they planned for it. Those sides of Dandora.

Alas! Fire can beget ash. A new generation of mediocre city planners and cannibal elites would take charge, wholly unaware of just how much tonnage of pooh Nairobi produced daily, and needed process, lest the metropolis drown in its own excrement. These apes of greed ---their names are in the Ndung'u report, soon as they had the power, set upon the sewage reserve and concocted it into private estate developments. Result? Even the toilets at the coveted state house, Ikulu, flush, only to regurgitate!
It is not a classified national secret.
Mwai Kibaki abandoned state house because his own pooh once tailed him from the loo's! As for President Kenyatta, he moved next door to his family home coz dear Margaret couldn't stand the same problem which chased the Othaya drunk from the national cottage. And, gossipvine, it is the disgust from Maggie which is forcing the son of Jomo to do something about the Nairobi sewage problem! (Of course he also has to report something serious to the African Development Bank which is coming for inspection of where its funds are going!)

Ouru, not running for re-election, was content to kick the can down the street. Agwambo, much used to the flying toilets of Kibera, where he is King of the toiletless proletaria, isn't really the man to be bothered about loos regurgitating pooh! Is he!?

So, were it not for the disturbed hygiene sensibilities of Margaret Kenyatta, William Ruto may not have needed to re-donate, albeit with a little pressure, the Ruai sewage reserves back to their rightful owner, the Nairobi sh!tters and their ever ruminating bowels.

In that respect ---ownership of urban shitting land---- here is a historical document of investigative journalism. The NairobiStar has competition I say. But, what there is for sooth, is an open vacancy for position of 'President of the people. That office, The peoples president,  has, since the abdication of The Mysterious One, had no contenders, no applicants, nor pretenders even. It is an apparence which can be deceptive of course. But it is the going default mode.

When more than 40 demolition excavators descended on the plains of Nairobi's Ruai at dawn yesterday, they not only set to recover 3,000 acres of what was originally set aside for sewerage purposes, but also brought to a screeching end a dream of what was supposed to be a fairy-tale city.
Had it been built to completion, Ruai Park Estate would have comprised 10,900 housing units worth a mouth-watering Sh15 billion funded by investors from the United Arab Emirates.

It would have been a one-of-a-kind project with malls, schools, solar farms and areas set aside for urban agriculture.
In fact, a Chinese contractor was already on site and houses were already growing on what used to be a barren piece of land that had in the years past been at the centre of protracted battles between different groups of squatters.

Then in 2014 an influential politician in government moved in to stake his claim on the land.

The politician managed to bulldoze everyone out of the way and used his influence to have a police station set up on the land to protect his interests.
The officers from the East Park Police Station, as it is known, have for the past six years been harassing anyone who threatened to challenge the ownership of the land while offering protection to the contractor who was building the city.

"People here have died by just challenging the ownership of that land. It is not worth talking about it. Just see what you want to see and leave," one of the IDPs living next to the property told us in August last year when a Nation investigation broke the story about the illegal occupation of the land.
On September 27, 2014, Mr Onesmus Mutinda, who was a surveyor in Ruai, was killed on the Ruiru Bypass.
His crime, according to the IDPs, was questioning the ownership of the 1,600-acre parcel, which by then was occupied by the IDPs.
Yesterday morning, the police officers guarding the property were overpowered by another contingent of about 300 officers mobilised from all the police divisions in Nairobi. The government had, after watching from the sidelines for three decades, come to take back its land.

As things stand, only 30 per cent of the over five million residents of the capital are connected to the sewerage system, whose treatment capability was last upgraded 40 years ago. This means that about 3.5 million Nairobians are either dumping their raw sewer into the Nairobi river basin or in septic tanks.
The Dandora Sewerage Treatment Plant, which stands next to the property repossessed yesterday, was built in 1980 and was initially meant to serve 80 per cent of city residents. But, since 1980, further expansion of the plant has been hampered by encroachment on its land.

As a result, the treated effluent does not meet required quality standards due to overloading. Standing on the only available land that can be used for expanding the plant are two properties with a total acreage of total acreage of 3,000, and worth a whopping Sh20 billion.

The controversial property, LR NO 12979/4, is on paper owned by Renton Company Ltd, a firm founded in 1995. Renton's records mysteriously disappeared from the Registrar of Companies, but we managed to get its registration number, 65570, from a land deal it carried out in the 1990s in Kakamega.
The Nation is aware that the mysterious owner of the land had used the value of the property to negotiate as equity for the city being built by developers from the UAE. The third partner in the project is a son of a former minister and husband of a former popular television news anchor.

TARMACKED ROAD

A tarmacked road was already being laid to link the project to Kangundo Road.
"This land was secured many years ago and it is a pity that it was stolen," Water Principal Secretary Joseph Irungu told the Nation yesterday.
"Unless we recover the land, Nairobi will have no place to expand its treatment works."

The Ruai land, previously known as Juja Sisal Estate, was originally part of the expansive 16,000-acre Embakasi Ranching Company land and had been sold to the land-buying company in the 1970s by the Settlement Fund Trustee, a body that was administering land after independence.

Records indicate that shortly after, the government made a compulsory acquisition of 5,000 acres and compensated the Embakasi Ranch shareholders. The land was to be reserved for the building of stabilisation ponds for Nairobi's waste water.

But the Nairobi City Council only utilised 500 acres and left some 4,500 acres unoccupied - and unfenced.

The land was mistaken as unoccupied for many years - and became the playground for Nairobi councillors and politicians. Within the land are two tilapia fish ponds in Phase 1 and Phase 2 and which are used to determine the quality of water released.
But it was not until 1993 that the first raid on the land took place, when former Youth for Kanu chairman Cyrus Jirongo's Offshore Trading Company was given part of the land, some 1,000 acres. Until recently, he was wooing some Arab investors into a joint Sh15 billion partnership to build a megacity worth billions of shillings on the land.
The only problem is that Mr Jirongo had no money and the land was already charged. The title had been with the Kenya Deposit Insurance Corporation (previously Deposit Protection Fund Board) of the Central Bank of Kenya after he used the land to secure for Sololo Outlets, his other company, a Sh1.1 billion loan from Postbank Credit Ltd (in liquidation).
"I have the original title to the land, so any other titles out there are of no use," Mr Irungu told the Nation.

After Mr Jirongo was given the 1,000 acres, the balance of 3,500 acres was now up for grabs. It is this land that became controversial after the Nairobi City Council passed a resolution that they would settle squatters on 1,600 acres.
While some of the squatters were to be people who had lost land during the upgrading of the Mathare 4A slums and the building of the Mathare 4A primary school, politicians saw a gerrymandering opportunity to beef up the Ruai population.

For instance, Ruai councillor Dick Waweru - who later became Nairobi mayor - brought in various people from Githunguri while David Mwenje also brought in truckloads of supporters to get land. Soon, Embakasi Ranch chairman Mwangi wa Thuita, who was instrumental in the original hiving off of the land to built the sewage plant, also started his own allocations - in what became a free-for-all exercise.
Since Jirongo had not fenced 'his' land, the parcel was also occupied by squatters - and a few years ago they organised themselves under the Ruai Embakasi Youth United Development Organisation (Reyuda) and asked the High Court to nullify Mr Jirongo's title deed and declare them the valid owner of the massive tract. This was after CBK's Deposit Protection Fund Board sought to sell the property.
The balance of the land was then fenced by a senior politician but under a company known as Renton. Mr Irungu said it is "a pity that the people who had taken the land are very senior."
"The land was never opened for alienation," he added.

In a statement released yesterday, the ministry said that the waste-water treatment plant land was supposed to serve Nairobi for generations to come but only 660 acres remain.
With no treatment works for Nairobi's sewage, the government, which has acquired a Sh42 billion loan from the Africa Development Bank to build a dam at Thwake, fears that raw sewage would flow into the dam.
"This investment will be a waste if the Athi River basin is not restored and sewage treated to the required standards before it is discharged," said the statement signed by Mr Irungu and Lands and Physical Planning Principal Secretary Nicholas Muraguri.
"It is estimated that currently, out of a total of approximately 4,240 acres of this land, only 1,637 is utilised for sewerage," the ministry said. "The rest of the land has been grabbed in totality."
The ongoing demolition will be the single largest such recovery of grabbed land in the city.

But when I heard the name was Nicholas, and it was this Nicholas who, because services are to be better delivered, is Wanjiku's watchdog on DAMS, LANDS, SEWAGES AND URBAN PLANNING, my thinking missed a beat and I had to rewind to refind my footing.

The name Nicholas when added to Muraguri, FLASHES RED. As in Biwott! :D

"In the continuing endeavor by the Jubilee Administration to improve the efficiency of public service delivery to Kenyans, His Excellency President Uhuru Kenyatta has deemed it necessary to make changes to the organization of Government," read the State House dispatch.

By moving Dr Muraguri, President Kenyatta effectively ends his feud with Health Cabinet Secretary Cleopa Mailu which spilled into the public during the recent doctors' strike.
So it is Mafya House man Nicholas Muraguri grabbing back Ruto's sewage land, reverting  to .... should we say Bi Nairobi Wanjiku!

It tickled my senses of irony! Because ... Dr. Muraguri once sacked a man for being overcompetent, diligent and incorruptible. The man was/is a star accountant, his name is Ben Muchere. Methinks Mr. Muchere is the kind you would headhunt, or finger unchallenged, to head the Auditor General's forensic office, currently purposefully out of service! That kind of move would only if the Handshake duo were serious (and not merely Rutofurious).

Senior government officials tried to transfer the auditor who unearthed the Sh5 billion scandal at the Health ministry.

Health Principal Secretary Nicholas Muraguri initiated the move, claiming the job needed more senior auditors and was backed by Treasury Cabinet Secretary Henry Rotich.
However, it is not clear why the attempt on July 12 was dropped. Bernard Muchere, who was leading the audit at the Health ministry, stayed on to issue the interim report which has shaken Kenya.

A letter seen by The Standard calling for the transfer of Mr Muchere and his team was authored only weeks after his arrival in June at Afya House.
Dr Muraguri wrote to Rotich on July 12 asking for the posting of "internal auditors in senior positions" apparently to replace Muchere and his team
.
I say with ease, it isn't that Ouru Kenyatta is a lame duck, nay, he is just a dead duck, in the head.

There are reasons His Excellency was stayed upon to retain Dr. Nicholas Muraguri, but not the following he gave.

So it is Mafya House man Nicholas Muraguri grabbing back Ruto's sewage land, reverting  to .... should we say Bi Nairobi Wanjiku!

It tickled my senses of irony! Because ... Dr. Muraguri once sacked a man for being overcompetent, diligent and incorruptible. The man was/is a star accountant, his name is Ben Muchere. Methinks Mr. Muchere is the kind you would headhunt, or finger unchallenged, to head the Auditor General's forensic office, currently purposefully out of service! That kind of move would only if the Handshake duo were serious (and not merely Rutofurious).

Senior government officials tried to transfer the auditor who unearthed the Sh5 billion scandal at the Health ministry.

Health Principal Secretary Nicholas Muraguri initiated the move, claiming the job needed more senior auditors and was backed by Treasury Cabinet Secretary Henry Rotich.
However, it is not clear why the attempt on July 12 was dropped. Bernard Muchere, who was leading the audit at the Health ministry, stayed on to issue the interim report which has shaken Kenya.

A letter seen by The Standard calling for the transfer of Mr Muchere and his team was authored only weeks after his arrival in June at Afya House.
Dr Muraguri wrote to Rotich on July 12 asking for the posting of "internal auditors in senior positions" apparently to replace Muchere and his team

I say with ease, it isn't that Ouru Kenyatta is a lame duck, nay, he is just a dead duck, in the head.

Taxpayers could be losing billions of shillings in the courts due to legal blunders made by the office of the Attorney-General (AG) while defending the State against compensation claims lodged by individuals and corporations.

A perusal of civil cases that the state has lost reveals mistakes that the AG has committed in the courts - including failure to produce crucial defence witnesses and documents - shows hundreds of millions of shillings awarded to claimants without much of a hassle.
 
These kinds of omission leave huge gaps in its defence, with the courts often entering judgments in favour of the claimants.

The government's principal legal adviser has occasionally failed to enter appearance in cases, delayed in filing appeals when a judgment has been issued and subsequently failed to explain what occasioned the inordinate delays.
 
The latest beneficiary of the AG's failures is Nairobi reclusive tycoon Mike Maina Kamau, who last week secured orders compelling the state to pay him Sh859 million as compensation for his demolished mansion in Nairobi's Spring Valley to pave the way for a road.
Justice John Mativo of the Judicial Review Division directed the Principal Secretary in the Ministry of Transport and Infrastructure as well as the Attorney-General to ensure that the billionaire, who owns Marble Arch Hotel in Nairobi, is paid.

The AG had opposed the compensation claim, but failed to prove that the property was on a road reserve and that Mr Maina held an irregular title deed.

The state also raised fraud allegations against Mr Maina but failed to prove the claims through the Commissioner of Lands or any witness from the Lands office (Ministry of Lands) on how the plaintiff fraudulently acquired the certificate of title he held.

The state said it intended to appeal the award, but this was to expose yet another weakness within the Attorney General's office. While the compensation order was made in December 2017, the state filed the appeal on November 14, 2019, out of the requisite timelines and without court's extension.
At the time when the award was made, the sum Mr Maina had been awarded was Sh711 million, then it gained interest after the delayed settlement and remittance by the AG's office

Mr Maina said that he was aware that following the judgment, the State Department for Infrastructure allocated the funds for settlement of the decretal sum and costs.
He submitted that the Department even remitted part of the money to the office of Attorney General for onward transmission, but the money was not paid for close to two years without sufficient cause and without any order for stay.

According to Article 156 (4(b) of the Constitution, the AG should represent the national government in court or in any other legal proceedings to which the national government is a party, other than criminal proceedings. But the laxity to appear, enter appearance of defence and file defence documents in court has enabled some litigants to obtain compensation without much struggle.

For instance, a family in Nyandarua was awarded Sh7 million in an undefended land dispute against Silibwet Primary School. The evidence in court shows that the office of AG failed to defend the public school in the case filed against it by John Macharia Mwangi, whose 11 acres were compulsorily acquired by government 53 years ago.
Attempts by the AG to enter appearance into the case when the judgment had already been delivered were thwarted by Justice Mary Oundo at the Environment and Lands Court in Nyahururu.

The AG wanted the judgment to be set aside, but Justice Oundo noted that at the Attorney General was duly served with the suit papers, and a hearing notice on many occasions and no explanation was given as to why there was no appearance during hearings and mentions of the matter.
The judge ruled that the office of the AG deliberately failed to attend the hearing and prosecute the case and thereby refused to avail itself of the court process. Further that no evidence was placed on the record even by way of witness statements or documents.

While describing the situation and abuse of the court process, Justice Oundo found that the State Law Office had just crafted the reasons for seeking quashing of the judgment, but left out the issue of its failure to attend court during the hearing of the suit.
According to former DPP Philip Murgor, the office of Attorney General is facing myriad of challenges among them laxity by State Counsels leading to a collapse of cases filed against the government.

Another lawyer, Mr Suyianka Lempaa says Mr Kariuki can also motivate the advocates in his chambers by approaching the Salaries and Remuneration Commission (SRC) and bargain for better wages for the counsels.

But Mr Murgor said terms of those in office have improved, unlike before.
"When I joined the AG's Office in 1986, the terms were abysmal and we earned about Sh5,000 at entry level with no medical cover. Today, the counsel at the AG's have little to complain about and should provide the best possible representation to the public," he said.
He observes that if the State counsels are falling short of the public's expectation, it is a challenge to Attorney General Kihara Kariuki - as the principal legal adviser to the government- to look into ways of motivating his staff.
"One way of motivating the counsel is for AG Kihara Kariuki to make appearances in court to lead in cases of great public interest. Past Attorneys General have done this, and it has had a tremendous motivational effect," he added.
Now this is the guy who will supposedly prove Ruto illegally annexed Ruai sewage reserve! :D

The last termer son of Jomo appeared stung by a very normal process: the questioning of what the government is up to with the re-public's money. President Kenyatta has authorised the National Treasury to pay Sh1.4 billion to two Anglo Leasing-type firms that had judgments against Kenya.
State House announced late Thursday evening that Mr Kenyatta had also ordered fresh investigations into the cases around the suspect security and information contracts which State House described "as a thorn in the flesh of the Kenyan nation".

Mr Esipisu said that when Mr Kenyatta was chairman of the Public Accounts Committee as opposition leader, he investigated the matter "and he agrees with the views of a majority of the Kenyan people on this. That's why it has taken long to make a decision on the current situation."
But the President, he said, has had to make a painful decision on what is the greater evil: either the money or put the country's economy at risk.

"By making this payment, the President is not legitimising what he and many Kenyans believe to have been a series of fraudulent transactions," the statement said.
"Therefore, the President has ordered fresh investigations into the cases."

He said investigations would be left to the Ethics and Anti-Corruption Commission, but Parliament also ought to play a role

Some will also remember the antics of President Kenyatta's then solicitor General, Nje Muturi, towards the EACC. Professor Onsongo had a gun waved to her face and burst into tears! Can he succeed where his predecessors didn't?

Can he tame the crooks and criminals who have called the shots at one of the country's most important ministries for decades?
Those are some of the questions in the minds of many as Health Cabinet Secretary Mutahi Kagwe faces off with a cabal of well-connected and deeply rooted dissidents at Afya House, the ministry's headquarters.

The genesis of the face-off, a Saturday Nation investigation shows, is a decision by the minister to seek the transfer of senior procurement and accounting officers, some of whom have worked at the ministry for more than 10 years, overseeing multibillion-shilling projects by one of the most well-funded dockets in government.
At least 30 officers have been moved from their plum Afya House offices, and more, according to ministry insiders, could be on the way out

Will he succeed?

It depends on his personal ambition, guts and sense of worth. Does he see himself as a man of destiny, the way Ruto does?

James Aggrey Orengo was famously handed the Lands Docket in the distant past, GCG. Summary

The colleagues have questioned the manner in which Dr Lutomiah was dismissed, insisting that it did not follow the right procedure.
The scientists added that the CS and top ministry officials should have told Dr Lutomiah that the results would be released in the morning for him to get prepared.

A scientist in charge of testing for the coronavirus at the Kenya Medical Research Institute (Kemri) has been demoted as the organisation reels under financial pressure.
Since the first case was reported in Kenya in mid-March, Kemri has tested more than 6,000 people under the leadership of Dr Joel Lutomiah, the Centre for Virus Research director.

He was the chairman of the Kemri Rapid Response, which is in charge of laboratories, and would appear on the Ministry of Health committee to give the position of the institute on Covid-19.

This was until April 17, when Dr Lutomiah was dismissed, following reports that he failed to release the results on time that Friday.

Health Cabinet Secretary Mutahi Kagwe instructed Prof Kombe to remove Dr Lutomiah from any leadership position at Kemri immediately.
 
So, the way one would dismiss a shamba-boy or a KAYAMKONO (who pleases ones wife much), or a wife would summarily sack a housegirl who looks too directly into the eyes of her husband ----no reading of rights or any other bull the 2010 toilet paper is suppose to guarantee all Kenyans, is the way a leading research scientist of the land can be sacked by a political appointee! And the way professor Kombe, apparently one of the most compliant spines at KEMRI, obeyed the master dog without question, points to an academic community themselves with a worthless sense of the self, and a Pavlovian training to perform their circus roles of administrative obedience.

So what are the mistakes of Dr. Lutomiah which warranted a standing foot sacking?

Covid-19 battle at stake as agencies fight over billions

At stake is $60 million (Sh6 billion) received by the government from the World Bank early this month.

A report authored by World Bank researchers Jørgen Juel Andersen, Niels Johannesen and Bob Rijkers dubbed Elite Capture of Foreign Aid: Evidence from Offshore Bank Accounts published in February 2020 shows that the Ksh328 billion was funneled to the offshore accounts between 1990 and 2010 during the tenures of Presidents Daniel Arap Moi and Mwai Kibaki.
Such easy pickings breed a false view of reality. A dodo mentality.

However, if you are amongst the wretched, unfortunately the majority of the populace, and, for instance, is forced to desperate measures, like boiling stones in a sufuria to fool hungry kids, that there is a mighty supper coming, then contemporary Kenya is practical hell. The whole political class running the establishment now seek to deny the implications, implicit or otherwise of that slogan. This is not easy, even for the deluded. So they seek to manufacture intellectual rationalisations to sugarcoat an ACT OF TREACHERY. To whitewash traitors.

In human society there is a problem with treachery. Betrayal is a dangerous crime. There is no pride in being a traitor. When a man spies for a foreign country against his own country, the charge is treason, and punishment usually highest and unforgiving. Such a man, rarely woman, has betrayed nearly everything ---himself, his country, his family (honour), his school and schooling. He has become non-human.

What is a 'rat''? What does it mean to 'rat on ones friends'? Why is a rat, even if lowly as in a police informer in the underworld, killed immediately on exposure?

So a particular kind of politician in a particular kind of country at a particular time, has this task set for him. They betray each other left and right, but have to pass this universally lowly and despised act, as the normality. A cultural edifice in politics, a holy script: there are no permanent friends in politics; everyone is for sale, and betrayal is the name of the game. Period. ---MOU's matter only so far, the moment Kibaki is in power, he never heard of an MOU with Raila. Very normal. Judas the Iscariot kisses Jesus for his 30 pieces of silver. Very normal. You find your wife in bed with your brother, fine, lets make it a threesome. Uhuru Kenyatta waxes hysterical around the country during the campaigns: Mimi nimalize zangu Kumi, Ruto aanze Kumi zake, then on his last stretch after two rigs, he never heard himself utter those words. Very normal.

I submit, that for an elite whose (demobilised) legal intelligentsia could not define integrity, nor translate it into operational chapters within the law as envisaged in-the-2010 promulgated thingy, the idea that words can have meaning and promises be kept is beyond their scope. And, that a concept can be sacred, incomprehensible.
To rule and perpetuate themselves in power, they have tried to turn upside down the common sense of Kenyans. They strive ceaseless to instill a cult of corruption, moral corruption, and a permissive mentality of mediocrity where anything goes. ---Bad bridges, okay, bad buildings, okay, substandard roads, rigged elections, unsolved murders (Musando, Kenei, Yebei, Tob Cohen, Juma); poisonous food (mercurised sugar and aflotoxin maize imported for human consumption); substandard drugs and health services .... etc etc... all huge okays.

But the filth have not succeeded. They have found out enough Kenyans wont buy their rot. And like all regimes, alienated and unresponsive to the aspirations of a people, the Kenyan state has to resort to extreme violence to defend the interests of the elite and effect their dominance.





Even the enforcement of the COVID-19 curfew has had to be a murderous venture. Yes, the rotten elite has only one option for all their ethnic paramountcy: terrorise the mass into obedience.



Anybody who rigs election is not left much choice. That will be anybody anywhere on planet Earth.

Second is the self-proclaimed General, Miguna Miguna of the National Resistance. No establishment intellectual can hold fort against the spitfire tongue of the  General. It means, intellectually speaking, the Kenyan establishment is an intellectual ruins. The arsonist General, Miguna, has burnt it down. The best they can do is pretend Miguna Miguna does not exist. If he does, he is inconsequential, an irrelevant Canadian foreigner, in deed a nobody who will never come back.
But think about it for a moment: does the interior man and designated president, Phd fellow, former college don and education minister Fred Matiang'i, alone with himself in his own mind, think for a second he himself comes from Kisii while General Miguna comes from Ontario, or Toronto near Alaska!?

To answer yes is to declare Matiang'i insane. So we all know Miguna comes from Canada and must stay there because he is a potato too hot to handle for sthe mall-brained Kenya elites, be they be triple Phd fellows!

Recently on local radio station in Kisumu discussing floods in Nyando, a man declaring himself the Ignorant One, had a question for the minister of Education, Professor Doctor Magoha. ----'Has the ministry of education under him commissioned a research which has concluded the same as Interior, that Onjiko here near Ahero in Kano, geographically is Canadian territory!?'
'Be dwokre adier!?' the studio host interjected.

That is what I mean by intellectual ruins as all one stares at in government offices in Nairobi. DJ's and their sidekicks have to interject to save professors running education from barbed questions.

Kithure Kindiki was Uhuruto's top lawyer for the ICC. He also authored the legal parley between URP and TNA which birthed Jubilee. His senate seat was a reward, and his deputy speakership in the senate too, was a reward. In other words in politics, he was always the trusted handmaid, to Uhuruto.

Then divorce happened. And the African proverb came up. Serving two masters at the same time is a magical feat. The best literary rendition of this divide is the story of The Voter by Chinua Achebe. It is about the dilemma of a man who took money from rival candidates in the promise of voting for each only. But the rivals weren't fools easily parted with their money, even if easily looted from the state. They had forced him to take binding oaths, dread oaths which his superstitious mind could not ignore. So in the booth he tore his vote and deposited each half in the respective box! ---He voted twice, but a spoilt ballot! Emerging happily from the booth. Mission accomplished.

But Kindiki Kithure could not resolve his dilemma of faithfulness to either Ruto or Uhuru. Because the voting had to be done in public. You attended the State House meet or you didn't. Kithure Kindiki didn't and so exposed his heart's loyalties: Ruto. He was smoked out. Refusing to wield the collective senatorial dagger to insert into the dying body of Sir William Hustler.

No, he wouldn't let Ruto grin at him with the Caeserian grim, reserved for Brutus in renditions of that old Roman scene at the bloodied floor of the senate.

No, when (not the chips but) we are down, we all understand betrayal. And all you need to be is human to recognise humiliation. The colonial system with its racial myths had its illusions about the politics of Kenya and why the Whiteman would rule her and the world forever. I imagine the current masters of Kenya too, have this notion their rule is forever.

Let them take a look at the body (or language) of Ruto. Only yesterday the most powerful vice president ever, a co-president. Politics of betrayal. Treachery remains painful.

Howbeit, I am waking up to a world where taking a knee has become more sinister. It is now Minneapolis and St Paul burning. It is the wake of George Floyd. It is a cop in the full glee of white --power-- arrogance, snuffing out the life out of a big black male. The cop does it slow-time and is utterly composed.  He can afford it because three other cops are pinning the big man --who is already handcuffed, down. It is essentially a lynching scene. It is chilling because of is utter honesty in total disregard for the life of another human being. It is the white Ubermensch showing the black Untermensch his place. And it went all live before the whole world, thanx to modern, instantaneous communication. It is a feat in self satisfaction, it is a masturbatory peak, enacted at the indulgence of ones ultimate fantasy, in this case Alpha dominance.

This is the unique thing about the Minneapolis video. Its stark honesty. Its  clinical premeditation and execution, its nonchalant cold-bloodedness. It is reptilian. It is evil. Unpretentious evil.

B: When I was being introduced to interracial pornography by my friends from the Diaspora, majorly former classmates coming back from the USA, they had some (pirated disc) copies of action from a factory called Blacks-on-Blonds. There was one in which only the Mandingo-hung Afro-Americans had been selected. Flincher's need not apply. It was called the anaconda challenge: which top blond could calmly subdue an anaconda? No popping eyes, no gag reflexes only. It was notorious, but also comical.

No, standards of proof are high in the United states for white cops who murder coloured folk. No, they did not have enough evidence to make an arrest of the killer-cop, Derek Chauvin. No, the legal department had nothing to file even a holding charge. The filmed murder in public, according to this Mr. Freeman, didn't amount to anything more than a ... hazy ... picture. It was all conjecture really. Defence attorneys would tear the case apart.

But as they say: you can't fool all the people all the time. And as for yourself, you can't fool yourself even for once. You always know it when you are full of sh!t.

Anyway, barely a few hours later ,Freeman was wholly backtracked by the mayor and other more quick-witted attorneys. These smelled smelled the coffee pronto.  These were not the days when Amy Koubuchar made a career running that old script of denial.

Nay, the battle against Shabaab has reduced our sharp shooters to dispatchers of foetus's to the next world; the battle against corona (reduced) our health spokespeople to a monotonous incantation of unexplained statistics; and the one against poverty is of course the Waterloo of every regime we have had since Kenya wa launched in Berlin. (Around 1884).

When it comes to the war on corruption, behold, the Marshals Haji and Kinoti, once paraded as Valour and Valorous, have been reduced to whining puppies, blind and butting one another in the search for a ripe teat to suck.

So to detect the ruthless streak in the Quixote turned man of steely will and crimson-dripping sword, one has to gaze elsewhere. Why would H.E Ouru Kenyatta take such a venomous turn against William K. Ruto, his ICC soulmate of yonder?

The answer, I am afraid, does not lie on any personal animosity between the two; neither, I dare stake my life on it, does it stool on the spell allegedly cast upon the president by the witch Agwambo; nay, mesays it is the behest of the economic interests fronted by the Kenyatta dynasty and Gikuyu oligarchy. These are the interests who have declared a Ruto presidency incompatible with their interests ----the continued monopoly of state loot. The same constituency which forced Kibaki to first, disown his MOU with Raila and 2, later rig the election against Raila. It is nothing personal. Raila is no more the beloved brother of Uhuru Kenyatta than William Ruto is. And equally, Raila and Ruto are not any less a beloved kin between them. It is an easy partner swap community.

But there are vested economic interests. They fear, and not without reason, that Ruto and his hungry mob of eat-all locusts will not just be content loot the state dry, no, they will in addition strip the competitors to the bone. The Hustler Ruto, forget Chromo PhD's, is the best student of his generation in acquisition: that is, in how to loot the state from political power. He apprenticed under Arap Moi, graduated under Mwai Kibaki and perfected the methodology under Uhuru I. Once the top dog in the land, the old owners of Kenya fear, The Hustler will unleash his predatory and accumulative instincts like an incensed piranha. A monster beyond check. And then there is his entourage. Young hungry Turks like Oscar Sudi and Farouk Kibet, they understand, you aint seen nothing yet if you think Nicholas Biwott was a total thug of a man.

Uhuru Kenyatta is a front for these fearful interests. His Excellency is just a puppet on a chain. He would rather be enjoying his vintage single malts than waxing ruthless in an arena that always bewildered him. Everybody knows the Kenyatta running Kenya is the other son: Gecaga, Jomo Gecaga. Uhuru is nothing but a terracotta pawn, a decoy.

William Ruto is going down. But if he is not to be out, he has to fight. Fighting he has a chance. That is life. One has to take risks. Even if the odds are tragic. Time for Ruto to find the warrior in him. Or he will be the latest paper tiger to have been blown away by the winds. And the winds are a blowin!

I think Ouru Kenyatta is miscalculating the kick in the remains of his regime. That is why I am confident he is in a trap. For close to a decade he has been running a rigged-in government; he has been running a corrupt den of a binary ethnocracy masquerading as a bureaucracy; he has been presiding over childish but debilitating looting exercises like the NYS scandal, the Eurobond affair, KRA mayhem ......; and he has been commander in chief when the KDF suffered its most historic defeat at El-Adde;  .... and now he wants to build an eternal pyramid in one year called the BBI!? And do the Big 5 for lunch, and Ruto for desert too!?

Even superman wont do. Less so in the real world.

No, he left it too late, neither did he have it in him to be The Great Leader. His executive orders are now best understood as looting devices, Yeltsian. The greatest news on the Kenyan scene this week, has of course been the demasque of the DP, William Ruto. That demasque has been in two phases. The first was an exercise in political theater; the second, cultural.

The political chapter was the above, already discussed EXECUTIVE ORDER of one, Uhuru Kenyatta. It peeled the fakery off the DP's office as a separate entity off the presidency. This public event officially ended the Jubilee facade of parity between the two offices. It reduced an already reduced Ruto to a subordinate, essentially a minion of Jomo Gecaga, the controller of the office of head of state. ---Comedy of course; the python has swallowed those spiked iron rods the police use to block roads. The hiss of instant flat tires.

The DP, like a dazed warrior in the field, deserted by lieutenants, abandoned by the usual horde of mercenaries, has reacted instinctively. He has gone to find strength in the old well, Kalenjins only,  the indefatigable furnace at which souls are forged and reforged ----even for matyrdom. The DP went for a ... wait for it -PRIVATE-- cultural ceremony of re-fortification, cleansing and reaffirmation. He went to be rebirthed in the cult of the legendary Koitalel arap Samoei. The wounded warrior went to regain invisibility, or at least the strength for a tragic heroism. So does a warrior achieve eternal fame: fallen in the thick of combat against overwhelming odds, but fallen for the just cause. --Spartacus, Patrice Lumumba, Mkwawa the Hehe, Kinjeketile ya Maji-Maji, Qassem Soleiman, Abu Jihad (Al-Fatah commander and founding member of the PLO together with Yasseir Arafat); Peleide Achilles.

You catch the jig of tragic heroism. How the death of certain warriors issue into eternal fame. :)

Ruto's back to his roots is thus a big step.

It is a very big step. A leap in consciousness. But, here is the rub; given his rout at the court of Kenyatta, only yesterday his bosom buddy, this leap is predictable. His mercenary court of armour has fallen apart. They are proclaiming their loyalty to Muigai the conqueror. So William Ruto has gone to refind values which have no meaning in his class of elites. Values which to him too, he long divorced in his rise up the neo-colonial pecking odder where all service is lip and first self. These Values, trace at the top, include honour, integrity, dignity and credibility. They constitute a healthy and wholesome historical personality --Cabrallian terms. The elite is of course a depersonalised rank of  alienated zombies who wouldn't know whether theft is immoral or amoral, divine or sin. That is why they never could implement chapter six, the integrity clause. And in as far as they possess rudimentary self-awareness, they all instinctively recognised the DANGER: they would collectively fail the litmus test of integrity!

RUTO ROCH! TONGE TO OMERE!

Back to his roots to refind his long lost self and shine! Ruto initiated a journey to ... how should I put it without a grin ... re-unite with the uncompromising, anti-robbery strand within his culture. (or, ... daredevil .... to seduce them unto his Kingdom of rot and decay!???)

He shed off his Christian mask. Or thinking of Miguna Miguna's notorious book, he peeled back the mask of Christian  farce. ---Sir William DP Ruto is ---officially like he is co president with Uhuru Kenyatta, a born-again Christian. He is a pious soul if there ever was one in political Kenya today! He is a man the Lord has deeply touched. (if you remember your Machiavelli sermons).

But that was when he had secure billions to bribe the corrupt clergy and their equally forked souls, not to mention their split-souled congregation. These are half Christian, half African. This is a neurosis in effect, widespread as an epidemic across ex-colonial citizens. But there it is: keeping up the appearances of Christian piety can be a very expensive affair you know, especially in Kenya where duplicitous parasitism is a social art! Tythe rates are high here! Very high. The pirates church has been bleeding Ruto, just like like the cash-hungry MK Mpigs who can be rented but not wholly bought.

Now, deserted, facing more desertions ---who can rely on the likes of Aden Duale even as Trojan Horses remaining behind? the warrior has to find steel elsewhere. He has to recruit from a separate school. Reality burns off the fake identities; only the core personality if any, will remain standing, jutting like some ancient rock exposed by millennia of harsh erosion.

We all know what these 'private cultural sessions'' enacted in the dark over whole nights, entail. They are deep, deep, deep! Some are indulged only when the survival of the tribe is on the line. They are bastions of some of the most radical decisions on earth. E.g that the survival of a species be guaranteed.

Most of us of a certain age have passed through variations of them, much like most women of a certain age have passed through certain defloration rituals. Some, if not most of these private cultural rituals, involve a lot of bloodletting ---sacrificial black rams, white Billy goats, peacock ducks, three-headed lizards, slithering reptiles, stinging bees and lots of milk and raw meat. Too, (aided) much communication with the ancestors  are all part of the dazzling paraphernalia of rites, depending on the passage in question.

Who wants to kid who now!?

Its no wonder most are secret. Few Africans will break their tribal oaths. When the chips are down, the Church or the Mosque do not rank. The foreign religions are masks without roots, grafts that didn't make it, overcoat paints quickly dilapidated by the elements of tropical harshness. I always tell folks this: those swearing in ceremonies where African presidents, always duly elected of course, hold the Bible aloft and chant faith and obedience to the constitution, we all know are an empty ritual. They are meaningless like the current pitch of the AG, Paul Kihara, who claims yesterday's executive Order elevates Ruto higher. In such a fundamental issue as  state power like oathing for commander in chief, no African worth his identity is going to take the Bible or the Quran seriously as a seal of oath. You know that in your heart too. Just like you know the sh!t Fred Matiang'i and co are full of when they declare Miguna is a Canadian, DEPORT!

But

Were the tribal rituals to be brought forward, marched with much ceremonial pomposity into the daylight, and, were Uhuru Kenyatta or William Ruto, Dennis Sassou Nguesso or Mobutu, Paul Kagame or Kaguta Museveni, or whoever is duly elected, to be ran through them holding the ancestral court of arms and chanting the names of the deepest cultural mirthlessness to strike them dead on betrayal, few states would be the constitutional ruins we so see everywhere in the continent. Few vermin would rise to the top as now is the case, and if they did, short would be their breath spans. For there would be a bonanza of ritual deaths of those their excellencies.

What a spectacular ceremony of cultural re-affirmation it would be -------we all know the ancestral formula's of vigour  :* and fidelity, witnessing the head of state to be ... dipped into  a fresh cocktail of the blood of black bulls, white hens, an assortment of lizards, then washed in fresh milk, nakedly declaring the constitution Holy. How awesome it would be, the duly elected holding the ancestral spear and daring: let this spear rip through my heart when I betray!

It would no doubt provoke a fair share of twitching noses and shivering pus'is, but business would be meant, both in public and in private. The president is obligated to swears on his tribal honour: if i betray, kill me straightway, with this sword of the ancestors! No impeachment nonsense!

NB: Every footsoldier knows what the price of treason is, so it is only fair that the commander in chief suffer the same fate should they fail to honour the land.

But when we still oath our commanders in chief with these books chronicling the ancestors of others, we all recognise a pantomime show if ever there was one. Mr. Bean Shows.

That is why it is important Ruto went home, to his roots.

He can't buy the spirit of Koitalel like he can buy the bishops of Kenya like Anyolo with that car (returned due to public pressure!). Ruto can not bribe the custodians of the Koitalel spirit like he bribed the Land registry to fraudulently award him the land where he built the Weston Hotel. Ruto can not rig the hearts of the Nandi vigil on the Samoei, like he rigged the heart of Wafula Chebukati to falsify the election results.

Yeah, up there at the top of Kenya where he comes from, everything is for sale. Even their wives are for sale. But when Ruto descends to the lair of the the Cultural lion Koitalel, and kneels to kiss the death mask of the Samoei, the Kenya shilling wont be the currency on the take.

No, in this private cultural ceremony in the cult of Koitalel, The Hustler has to hold the spear of his Kalenjin ancestors and confess his loyalty, or he could go back empty-souled to his mercenary cycle of political minions like Murkomem and the lot.

The master land accumulator Ruto bowing before the spirit of Koitalel, is, switching gears, a flirt with class suicide. But we wait to see if Ruto is past salvation, past reclamation, .... that is in the sense of being too rotten to even take the oath to the Samoei Koitalel seriously.
It surely would be a completely rotten Kalenjin who spat on the grave of Koitalel, who raised his banner but with derision and scorn in his heart. Ruto is rotten, but I don't think he is rotten beyond class suicide.

I eagerly wait to hear what the Oracle of Koitalel whispered in his ear. It couldn't have been Praise the Lord, Amen. The Koitalel spirit does not suffer theft, does not bless thieves. Does suffer land grabbers.

The drop in revenue collections by Kenya Revenue Authority (KRA) will increase the pressure on Kenya's ability to pay its debt that stood at Sh6.285 trillion as at March 20, according to data by Central bank of Kenya.
"The Government of Kenya should urgently engage multilateral and bilateral lenders with a view to renegotiating loan obligations, with emphasis on waivers of interest and extensions on the repayment period, as well asking for total waivers on some of the loans to free up money to enable the government to contain the spread of the pandemic, cushion Kenyans against its social and economic effects, and address the economic impact of the pandemic," MPs said in the notice last week.

The move comes at a time when revenue fell in the first two months with the tax reliefs on workers and small businesses set to hit KRA's collections further.
Tax collections by the taxman dropped in the January-February 2020 period by Sh3.51 billion to Sh216.06 billion compared with Sh219.56 billion in the same period a year earlier, official data shows.

Kenya will need to pay a total of Sh630.1 billion. In Mr Yatani's debt repayment strategy, unveiled this year, Treasury was going to use the increase in tax collections and all the savings from ministerial budget cuts to repay the debt and deal with the ballooning pension bill.[i/]

A FAILED GIMMICK REVEALS AN EVOLUTIONARY DEAD-END

I think William Ruto has been taught a savage lesson in culture. As to whether he has learnt it, that is another story. But he played the worst politics within his own culture, The Nandi, and has been well-burnt.  Howbeit with duplicitous heart and much mental delusion, he ventured into to the tomb of a Nandi Saint, Koitalel, and pulled a gimmick of manipulation and bribery.

It was foolhardy.

You know these things are not new in warrior adventures. On his famous return from the Trojan war, Man Ulysses hits the rocks. He looses men, looses booty, looted cargo, ships and all mates. To find his way home and have his future divined ---if his Kingdom shall he reclaim, he has to consult Theban Teiresias, The Seer of Seers. The prophet is blind, but has the reputation of never having been a charlatan Mgangha. The greater fact is, he is long dead and doing time at Hades, the Kingdom of the dead. Man Ulysses, famed of many wiles, has to make that journey. And he does. He isn't a pioneer mortal though. Herakles before him, and Orpheus before him, in various pursuits of the heart, had long made the descent to Hell, or heaven as the case may be, and returned alive (before eventually bowing permanently to death, as even the living god shall).

These adventures are called trials, and, folklore aside, they are the building blocks of national consciousness. Tragic heroism and the resourcefulness of man to advance in the face of any adversity, is the story of hope and the eventual triumph of the human spirit. Now, if Jesus resurrected, it means he too made the journey to the land of the dead, came back to the land of the living, then departed again to the land of the dead, in this case, heaven. But it is the same story of defeating death. The same story why we refer to the historical Gor as Mahia.

But these trials have a dangerous purpose on the rebound. They test man -or woman as the case may be in Me Katilili-- to the limit. Limits which sustain no illusions.  These trials purify every impurity of delusional thinking. They strip the hero naked to the core; core of his character. For instance when you are being cruxified by 8 inch steel bars of the Y10 ---(now D10 untwisted)--- construction grade,  being rammed in by a ferocious Nyahunyo, you will have nowhere to hide from the pain. ---Jesus Godson had to cry: Father, why have you abandoned me! In other words the suffering drove him to DOUBT! To doubt God. To doubt his own mission by default.

What happened to Ulysses in Hades? He meticulously went through the rituals and passed the test, and came face to face with the soul or phantom of Teiresias The Seer. An interesting detail why Teiresias was blind is that the Gods chose to reward him with the Seeing the Future, which was a restricted calling even amongst the gods themselves.

But William Ruto is of another make. He went to Koitalel's tomb as a Kenyan politician. Not as a Nandi warrior with a mission in the morrow. A Kenyan politician is at this moment a being lost to history. He or she is a professional cheat, a lying, looting and election-rigging criminal who never meant anything good for the land. The Kenyan politician is currently excess luggage, historical ballast. And it is with such a dead-end mentality that William Ruto stole to the tomb of Koitalel.

 He bribed a section of the custodians, TALAI ELDERS, they (deliberately?) chose short-cuts in the rituals, imbued him fake blessings and, within a few hours, what had been billed to make the future of a man exploded in is his face. Scandal, a kalongolongo event!

The back to the roots gimmick of The Hustler Singh  became a futile gesture. Farce. What a pathology!

We --of the chattering classes--- need to understand what went wrong. Of course the mass of the people already know! Why did DP Ruto's endorsement by the TALAI ELDERS, supposedly the custodians of the rocky Koitalel mystique, fall so flat on his face within a day?

To understand is to avoid another tragi-farce, or predict a sequel. (the people already have this understanding of course!)

It is only human to take a tangent off reality. That is when under pressure, the mind flies far into the realm of fiction and fantasy. Very well when the product is Art. very mad when the subject is politics. Reality is dreary business, so come Sunday for we Christians, it is flight time. Hopefully the Covid-19 ban on congregations has offered us a time for deep introspection on this our obsession with the empty Sunday ritual. Reality is dreary, dreary like the fields of combat; there men die; there, unlike at the movies, death is final and actors do not rise to fit another role.

Reality is for keeps.

William Ruto's hitherto public composure, ritual professions of cordiality with Uhuru Kenyatta, never fooled nobody. They did not fool even himself in his wildest dreams. As the Handshake slowly emerged into centre stage, we heard many a denial narrative. Kipchumba Murkomem and Aden Duale, then leading jubilee lights in the senate and parliament respectively, dismissed Raila as a bribe-taker, domesticated by the dynamic duo who had beaten square at the ballot. Jubilee, they boasted in public with scorn, would pander to Agwambo's childish sense of grandeur and, awarded motorcades and other such ostentatious displays of impotent power, Tinga would be a trouble neutralised. Uhuru Kumi, Ruto Kumi was guaranted.

Foolishly advised, William Ruto adopted this poisonous narrative, waxing vindictive as  he  depicted the Lord of Kibera as a Mgangha, a Mchawi ... a lord of all plagues combined. Shetani.

Sir William and his handlers had misunderstood Goebbels, that a lie had to so big it stunned into not disbelief but belief.

Ruto's feats became rants, mere rabid flights in delusion. They were so far from reality as to constitute clinical madness, rank hysteria. Goebbels' dictum about the big lie, is a double-edged sword. One can repeat a big lie so often as to believe it himself, and, on the podium, dangerously misinterpret the amused laughter of the mob.

And so it has come to pass that Uhuru has returned to the KANU fold. And Ruto has launched Jubilee Asili. It is the URP by another name. Once there was FORD, and then FORD Asili, ODM then ODM-K. Improvement on a theme, let alone the innovation of the new, is not a faculty active within the political elite of Kenya. They don't have to be original, but one would think there would be enough necessity to be creative. But no, Basta, their life is a repetition of old sets. Even when these are proven to no longer work.

And so Muigai wa Kenyatta is back to the KANU fold. It was Arap Moi who fished Uhuru out of the gutter to launch him a political career. It is like Uhuru is returning the favour, doing for Gideon what Gideon can not do for himself. ---Gideon, just like Uhuru or Kalonzo, Weta or Mudavadi, remains Ruto's inferior by far. Just like Jirongo was, even as he bossed Ruto in YK'92.

The implications of this simple fact are disheartening. Only Tinga can box Ruto into a corner. And Ruto knows this, even as he seems to sometimes believe his more ignorant assistants. Some people will be honest enough to remember why, once upon a time before Uhuru Kenyatta was born, it was Mudavadi who was elevated to be Raila's deputy while the ODM party ranks wanted William Ruto. These were just before the PENTAGON DAYS in the run to the fateful 2007.

It was obvious to the party ranks, that with Raila as captain and William Ruto as the deputy captain, Mwai Kibaki and Wamalwa-co wouldn't be defeated, they would be crushed. The combination of a Raila-Ruto ticket on the campaign trail singing one song, from Mombasa to Turkana, Busia to Mandera had a thrill and a vibe which would be unstoppable. All the other inferior politicians realised this fixed the future of Kenya for a while to come. With young Ruto made.

This obvious but deserved would-be elevation of Ruto was what many couldn't take. And they still can't.

It was those days I reached the conclusion: William Ruto was the most nationally dynamic politician outside Raila Odinga. It was also then that I found out James Orengo is terrified of William Ruto. Orengo is brave, but Ruto is braver. Orengo is more intelligent and thoughtful, but Ruto is more cunning and scheming and socially more intelligent. Then the clincher, Ruto is cold-bloodedly ruthless. Orengo is squeamish.

And when men plot power, the squeamish must defer naturally to the killers in the room. That is just the law of all theaters of death. And Kenyan politics isn't your kindergarten day out, is it? Last time I checked, the land of the dead was teeming with these sulking souls demanding their cold cases in the other life be laid to rest under the tree of Truth. --Tom Mboya, Alexander Muge, Pio Gama, Kang'ata and Oulu, Musando and Jacob Juma. Yes, JM Kariuki we all know, unlike the rest in unmarked graves.

But, on a light note ...

Why do the dynasts all hate Ruto so much?  :o

 Methinks it is the instinctive fear of all prey for a lurking predator. It is the unmistakable loath of the lesser males for the Alpha brute --We are talking the political economy of a (would-be) post-primitive accumulation state; a stunted tropical gangster state, busy priming itself for inter-elite fatricide. It is therefore no coincidence that it is George Muhoho, the CEO of the Kenyatta fortune, who is the chief strategist of the Rutexit. Muhoho's instincts are correct. Ruto's unchequered greed will expropriate the Kenyatta estates, ostensibly for the benefit of poor Kenyans and natural justice, but effectively to enrich himself more. The implied social justice is just a predatory pretext.

Muhoho watched in horror as Ruto's expansionism in the Energy sector, care of the Hustler's control of that ministry in the 50/50 deal with Brother Muigai, breached Mama Ngina's interests; and without apologies. It was Ngina who had to ge out of the way of the young Kalenjin turbo appetites. (This was the basis of Ngina seeking audience with Arap Moi, resulting in that famous photo.)

VISIT THE LAUNDRYMAN AT CAPITOL

Raila Odinga essentially has no role to play in this conflict, but pushed by his greedy handlers, he finds his flip-floppy self nowhere but a vacillation between the two poles. I like Purity Ngirici's pointer: Laundryman. I must hasten to add the Murang'a women representative has not suggested Anne Waiguru has used some of the NYS I loot to bribe Raila in person, but a bastion of demonstrators in that county didn't mince their words about it. In any case at the grassroots and even TV punditry, the Capitol offices of the father of devolution are now spoken of as The Laundry.

Even the mouthful and full-bodied Cate fitted the washers.

Raila won the presidency in 2007 when he teamed up with Ruto. He knows he owes Ruto a debt, a debt he does not owe neither Mudavadi nor Kalonzo. Tinga also knows the Luo nation, come to think of it, owes Ruto a blood debt. The Kalenjin warriors  loyal to Ruto were instrumental in blunting the murderous charges of the Uhuru-Kenyatta sponsored Mungiki. These hate-drunk goons were unleashed upon a hapless Omera nation in borders of the Rift and Central. But they were contained  by the flying arrows of the Kalenjin.

A SKYLLA OR CHARYBDIS CHOICE?

If things turn ugly, and push comes to shove, and daggers have to driven to the hilt, Luoland will have to decide between two narratives about Ruto. He is a thief, he is an election rigger and a landgrabber the rank of Jomo Kenyatta; or, William The Hustler is  a trustworthy ally who, when the darkest hour fell upon the Luo in 2007/8, fought the Omera corner with everything in his guts. He steeled Raila to battle the drunken rigger and  arrogant usurper, Mwai Kibaki, into a parley, the GCG. For all his duly elected mutterings on oath, Kibaki was sweating his pants steamy as he parroted the mercenary Evans Gicheru. There is a nick Ken Matiba named Emilio, and not for nothing.

Once again, come 2013, it was the same Ruto who steeled Ouru Kenyatta into a formidable candidacy, and helped him become president, albeit with a little help of fictitiously hatched number, the so-called vifaranga. Subsequently Ouru Kenyatta found himself a puppet as Ruto controlled both houses and rigged candidates right before his nose in Mount Kenya.

No one likes being a puppet, except a drunk to drink. But the whole of the Uhuru Kenyatta legacy has now turned to a STOP RUTO SHENANIGANISM. What an implosion of the KUMI KUMI mantra! What a self-defeating and primitive treachery! The same treachery his father afforded Jaramogi for his Uhuru na Kenyatta insistence! use and discard! like a rented lady of the lowly morals once done.

Let William Ruto show he is no rented prostitute. That he is no dog to be used by a dynasty then shown his place, the kernel. Let him find the warrior in him and put a bit of his fight to the service of the poor. Let him flirt with the unthinkable: class suicide. Samson growing new hair. Then will he better mobilise the anti-Dynasties, republican and nationalist sentiment. He has been banging the anti dynasty beat ever more strident. Now he can put his sword where his mouth is. Or fold tail and enter the kernel.  There is a long life in docility and captivity, and retired faithful dogs can reckon on easy deaths, euthanasia. But the politics of paying lip service to Wanjiku, trying to forge the blessings of Kotalel, trying to pretend to be a born-again Christian (while fathering Annas left and right) ---in short, the rotten politics of a rotten elite, will make him easy prey for his classmates ganged up against him. William has first to win the spiritual battle within him. Saul has to become Paul, launching and peddling the gospel according to Wanjiku.

Otherwise what is Ruto but just another possessed tropical kleptocrat? These --state bandits-- come a dozen a dime. ---Nguema, Nguesso, Mobutu, Kabila, Bongo, Kiir, Ngbuezza, Dos Santos. Dead end regimes. ....

KAPUTIN, THE OTHER OPTION WE DARE NOT THINK

It is a dangerous form of mental laziness. All laziness is bad, but some mental forms are the tenets of national ruin. I am afraid the dominant crop of the post-colonial African politician has been an explication of the above. They have been exhibits of the mental laziness which is the harbinger of slow-motion national ruin.

Yesterday's sanitisation of the pus-filled Anne Mumbi Waiguru by the senate, itself a political abscess, is just another minor detail in the rendition. The mental laziness of the would-be dynamic duo at the head of the nation's constitutional reform --the ex AG Githu Muigai and ex CJ Wily Mutunga has been hammered often enough. Their doctoral and professorial minds jammed and knocked, and couldn't make the meager effort to anchor a definition of INTEGRITY  (as envisioned by Chapter six of the 2010). The result is ... rot like NYS Scam Waiguru can, in make-believe absurdity, but with serious face to boot, attest their virginity as they enter a second marriage with children from the first.

Putting it another way. The senate commission under the now-expelled ANC Cleopa Malala of Kakamega, couldn't find a history of financial malfeasance which could have motivated the Kirinyaga dwarf-breed MCA's to lung a dagger called impeachment at their DULY ELECTED governor. And of course corruption cases do not carry over. When one changes jobs, one begins afresh. Otherwise where would the senate speaker Ken Lusaka be? Ken when he was governor of Bungoma, managed to buy a jua-kali wheelbarrow for the Kingly price of ksh.105K. A quick check around any jua-kali display returned a price of 3.5-6K. ---Yeah, where would Ken Lusaka be if DCI Kinoti and DPP Haji were literate?

And so like Pontious Pilate washing his hands off Jesus before a duplicituous Jewish clergy, Cleopa Malala just before being hung out to dry by the Mudavadi Party, now in Ruto's pocket, returned Anne Mumbi to the MCA's of Kirinyaga. Let them do the dirty work themselves if they so desperately insist. But the senate wont be their assassin, lest the senate inadvertently pass its own death certificate.

Historically speaking, the Kenyan senate is of course already a dead house. It is a morgue going through the rituals of cadaver upgrades, to look decent for burial. It is up sanitizing rot and puss-filled busy bodies (like Lusaka, Waiguru, Obado, Nyong'o, Rasanga, and you name the rest!)

KAPUTIN THE DEPTH

The first time the word KAPUTIN surfaced in Kenya, it was like it came from Francis Atwoli. It went Uhuru Kenyatta is too young to disappear into oblivion, having achieved nothing at the top. There had to be a dance of stools at the top to create room for the underachieving son of Jomo. Given the constitutional block, a sacrificial and pliant cog, a Medvedev dog, had to be found to warm seat for The Prince of Gatundu.

William Ruto wasn't going to be that dog. The ambitious hustler and son of a pauper, wasn't born to lick the toes of an inferior, even if born a King. Already as Vice President, he was more than equal to Uhuru Kenyatta, formally his boss. Some say Ruto's cardinal crime was to outshine his boss, to show he was too much the senior partner in the ticket, albeit officially the junior. But such people do not understand psychology. A young lion, a cub, can pretend successfully for a few weeks it is a kitten in your kitchen. After that one week, however much it puts up the act of docile, everybody will instinctively read the sleep as a trap: a lion feigns sleep to spring a surprise on the foolhardy meal. Ruto can fool nobody, not even a drunk Ouru Kenyatta, that he is a harmless pliable thing like Arap Moi was to Jomo Kenyatta. Ruto is credited with effectively containing Arap Moi, and then a few years later, Raila Odinga. There was always no psychological room to pretend he was Ouru Kenyatta's junior.

A man can't run that much away from himself.

Whatever Ruto would do under the naturally lazy Kenyatta ---a prince born with a golden spoon in his mouth, he would always outshine him by default. William Ruto like Oliver Cromwell, while loyal to the thieving aristocracy, was doomed to deeply clash with them, antagonize them forcefully, and face their wrath. It is not for nothing Kings historically prefer eunuchs to keep their brothels.

In Kenya, we use the KAPUTIN lazily, seeking to purge off its potency. As Boris Yeltsin was completely captured and dominated by a thieving oligarchy ---much like the Jubilee regime of Uhuruto has been a thieving and looting racket, the Yeltsin succession became an obsession to the looters of Russia. Just like the Uhuru succession to the looters of Kenya. The Oligarchy of Russia sought another compliant stooge so that kazi could endelea for themselves even as Russia visibly collapsed.

This ---clash of continual plunder or economic rejuvenation of Russia---- was the background to the emergence of Vladimir Putin, a man who today, over two decades later, too has passed over to the realm of political insanity. Today he believes in his own immortality and irreplacability. Like Xi JinPin of China, he has manipulated the Russian constitution to rule forever: rule everlast, which is the same delusion suffered by every Czar before the Russian revolution confined the last of them to a pit latrine in the Taiga.

So methinks as of today Putin has lost his political mind.

But when he replaced Boris Yeltsin then, he was a man of mission. He would rebuild Russia, redirect her resources to her people. To do this he would have to cut down many an oligarch, bring the whole lot to size and domesticate them, or, failing that, eradicate them. The wrenching of the Russian state from the clutches of the thieving oligarchy, is a KAPUTIN outside the mental ranges of elitist Kenyan political imagination.

That is a key intellectual laziness of our motherland and its political elite and punditry. The second phase of KAPUTIN, the reorganisation of the Russian economy,  school system and scientific research, and the paired rejuvenation of its military and international posture, too is achapter lost to the elitist Kenyan appreciation of the concept.

By the time his term is ending as per the constitution and Medvedev has to do a shuffle, it is merely because Putin has so worked and aroused such a surge in Russia's fortunes, that he has become Caesar Julius by ability and achievement. As Achebe would say of Okonkwo: his standing in society was the result of the force of his own work and industry. Okonkwo had inherited nothing from his father but the name. That workaholism was the historical background to Kaputin. Putin had so performed, displayed such cold-bloodedness, had such a chilly grit to his gaze that his pre-eminence was undisputed. The ruins called Russia, was back on track. KAPUTIN!

But when Francis Atwoli proposes Kaputin, or was it Nancy Gitau who first did? It is nothing but the wishful thinking of the Yeltsin thieving entourage, seeking to continue looting Russia in peace. It is the song of a status quo to whom life is already a paradise. Parasites that they are!

Ouru Kenyatta's presidency has been an unmitigated disaster. We have Mwai Kibaki's record to compare. Ouru Kenyatta is no performer, the son of Jomo is a lazy Oblomov type who has been in bed as Kenya was looted to the bones. Jubilee has been an exercise in obsessive corruption.  His demise would be a national blessing without disguise.

It is therefore a mercenary act of evil, for one to propose such a nothing-doing creature should continue anywhere near high office. It is a crime against the future of Kenya, to plot to elongate the tenure, by open guile or otherwise, of a looting aristocracy-cum-oligarchy. Gideon Moi is of the same make as nonstarter Uhuru. Those who have never wiped a drop of sweat from their brows, even at work on their marital vows.

I say, let KAPUTIN come. But now you know the full measure of the historical ring. Give it a think. KAPUTIN ... the domestication of the thieving oligarchy.

No, Nancy Gitau didn't know which Djini she was letting out of the bottle when she devised that plot. Let the monster come, And Kenya run, ahead.

Kenya won the case against Cortec and Sterling Capital Limited which was hired and determined in Kenya’s favour at the International Centre for Settlement of Investment Disputes in Dubai.
In the suit, Cortec and Sterling sought compensation of between $2 billion and $500 billion (Sh200 billion and Sh500 billion) after the government cancelled their licence for exploration and development of minerals at Mrima Hills, Kwale County.

Cortec Mining Kenya Limited, Cortec (Pty) Limited and Stirling Capital Limited licences were revoked in 2013.

Cortec had been issued with a licence for mining niobium and rare earth minerals at Mrima Hills in Kwale.

The two companies had argued their project was nationalised after they had spent six years and millions of dollars in exploration and development.

Summary

In its report that was adopted by the National Assembly, the PIC established that the NCPB management had awarded the tender to Erad without consulting the Attorney-General.
The move that smacked of connivance among the parastatal staff, Erad and some individuals in the Judiciary.
This is because no due diligence, technical and financial evaluation had been conducted to ascertain whether the company had the capacity to supply the maize.

Businessman Jacob Juma was the face of Erad supplies, which he served as managing director.
And his two co-directors were largely unknown until they got a court order attaching the country’s strategic grain reserves.
The late Juma made it known to all and sundry that he was going to auction government property after his company won a case on a breached contract. He died before he could execute the order, leaving his co-directors with the task, which turned out to be a poisoned chalice.

And awaiting sentencing today is Sirisia MP John Koyi Waluke and Ms Grace Sarapay Wakhungu, the co-directors. Their woes started in August 2004 when Erad Supplies and General Contractors Ltd was awarded a Sh778 million tender to supply 40,000 tonnes of maize.
Erad was one of the five companies the National Cereals and Produce Board (NCPB) contracted to supply 180,000 tonnes so that the country could meet its needs at the time.

Erad supplies was to be paid Sh19,465 per tonne on condition that it would provide a performance bond of 10 per cent of the quantity.
However, the firm failed to deliver the maize, which it claimed would have been imported from Ethiopia, leading to termination of the contract despite being paid at least Sh300 million.

Erad challenged the matter in court and an arbitrator was appointed.

The arbitrator awarded Sh564 million to Erad for breach of the contract, but the NCPB contested the decision at the High Court.

Erad then went to court and obtained orders to sell NCPB’s assets to recover a total of Sh564 million, yet it did not supply a single grain of maize.
The matter was brought before the Public Investments Committee (PIC) of the National Assembly in 2013.

The committee launched investigations immediately. Interestingly, Mr Waluke was among the members of PIC, then chaired by Eldas MP Adan Keynan.


During the committee’s hearings and as required by National Assembly Standing Orders, Mr Waluke was excused from the committee’s sittings.
“We are now set to enforce a court decree to dispose of NCPB’s assets arising from the breach of a maize supply contract,” Juma then told PIC.
At the time, the order put at risk Kenya’s strategic food reserve that held about 2.2 million bags of maize valued at Sh6.6 billion.
The PIC was told that the matter had been heard by nine judges who threw out NCPB’s case and upheld its claim for storage charges and loss of revenue anticipated from the maize supply.

The committee members questioned the morality of attaching property of a key food security institution when no grain had been supplied.
In its report that was adopted by the National Assembly, the PIC established that the NCPB management had awarded the tender to Erad without consulting the Attorney-General, in a move that smacked of connivance among the parastatal staff, Erad and some individuals in the Judiciary.
This is because no due diligence, technical and financial evaluation had been conducted to ascertain whether the company had the capacity to supply the maize.
It turned out to be a choreographed scheme to loot public funds, according to PIC.
In its recommendations, the committee barred Mr Waluke and other Erad directors from doing any business in the country and within the East African Community.
The committee also recommended that Mr Waluke and his co-directors be prosecuted.

As the committee made the recommendations, it prevailed on the executive to begin the recovery proceedings against the company and its directors so as to recover the money already paid out to them.

The committee further recommended that no more money should be paid to the firm.
The committee also directed the Ethics and Anti- Corruption Commission (EACC) to undertake an in-depth investigation of the firm’s dealings.
The EACC investigated the matter and in 2018, Mr Waluke and Ms Wakhungu were charged in court over fraud among other charges after Juma’s death in May 2016.
In all the instances, the late Juma appeared to be the one running the affairs of Erad as Mr Waluke and Ms Wakhungu portrayed a figure of strangers in Jerusalem.

On June 22, 2020, the court found Mr Waluke and Ms Wakhungu guilty of the offense. The two are expected to be sentenced on Thursday this week.

However, their conviction did not come without a fight. Early this month they lost a petition seeking the quashing of the PIC report that recommended their prosecution, for fraudulently receiving more than Sh300 million from NCPB. Justice Mumbi Ngugi said Mr Waluke was an MP and a member of PIC when the matter was debated by committee.
She said the MP was given the opportunity to testify before the committee and he was in parliament when the report was adopted, yet he did not challenge it, until five years later

The value of his home sitting on 5.5 acres in Nairobi’s Karen estate. He had also invested a lot in real estate, including apartments in Nairobi’s Westlands and plots in Loresho and Karen. Juma also owned a residential property in South Africa’s Cape Town, which he sold in 2012 for a price that set a record.
Sh156 million

Amount Kenya Revenue Authority claimed in three years as unpaid taxes, which led to a messy court case which the taxman lost after Justice Weldon Korir dismissed the suit.
Sh521 million

Amount the National Cereals and Produce Board (NCPB) was ordered to pay Juma after the Ministry of Agriculture cancelled a contract to supply 40,000 tonnes of maize in 2004. Juma wanted to auction assets of NCPB, the holder of Kenya’s strategic grain reserves!
The contract had been awarded to Juma’s Erad Supplies and General Contractors. The judgment was made in favour of Erad despite the company not delivering a single grain to the board.

 Erad Supplies has Grace Wakhungu, a sister to former Vice President Moody Awori and mother to Cabinet Secretary Prof Judi Wakhungu, as Juma’s co-director.

The two were also co-directors in Juma Construction, which was blacklisted by the then Ministry of Roads and Public Works for “shoddy and unfi nished projects.”
Sh1.7 billion

Amount Pacific Wildcat Resources, a subsidiary of Juma’s Cortec Mining Kenya Ltd, lost in one day at the Canadian Stock Exchange when Juma’s mining licence was withdrawn in Kenya.

Cortec Mining had a contract to extract nobium and rare earth metals in Mrima Hill, Kwale County.

 Juma had 30 per cent stake in Cortec Mining.

Sh200 billion

Amount Juma sued the Kenyan government for at the International Centre of Investment Disputes following the cancellation of the mining licenceby then Mining Cabinet Secretary Najib Balala, who argued it was issued fraudulently. The special licence had been awarded in 2008 for 21 years.

The Mrima Hill deposits in Kwale County were valued at close to Sh100 trillion. “I will bring down this government,” Juma had declared after lodging the lawsuit against Jubilee in 2013.

THE NATIONAL CEREALS PRODUCE BOARD

It was a citadel of corruption, the NCPB. But the original, formative idea was brilliant. Just like the rationale behind the original parastatals –--KFA, Kenya Railways, Kenya Posts and Telecoms, Posta Bank, Uchumi supermarkets; Kenya Bus; KENATCO, or KPCU (former headquarters now the shell next to Wakulima market at Haille Salassie avenue).

But just like there is no shortage of good, simple and practical ideas, there is equally no shortage bad decisions to be made, and poor leaders to specialise in making them bad decisions. It is an epidemic in our land. And continent at large.

The NCPB was thus reduced to a white elephant, a fraudulent device. Just like the dams the former cabinet secretary for finance, Henry Rotich, used as a pretext to oversee the loot of the public purse. (Granted, Rotich was never his own man in office, but it is reasonable to suppose, that his intelligence and humanity, education and training, could have afforded him meagre elements of autonomy, just enough to desist going into history as a total dog and debauched cog!)

Anyway, on ERAD VS WANJIKU; after  many years of hide and seek, the political constellation of the land changed enough for a mini breakthrough to be booked. As to whether characters like Jacob Juma need must be mourned by any one else save their loved ones and criminal cronies, is a question not worth asking. Enough is that his murderers, and their paymasters must be caught nailed for their crime. The murder of anybody in any jurisdiction remains a captial offence which must never be left unsolved, unpunished.

EACC officers arrest Sirisia MP John Waluke

Ethics and Anti-Corruption Commission (EACC) officers have arrested Sirisia MP John Waluke over suspected forgery and perjury.

The Sirisia MP was charged on Thursday alongside Grace Sarapay Wakhungu at the Milimani Law Courts following an alleged million dollar contract between Chelsea Freight and the National Cereals and Produce Board (NCPB).

Waluke and Wakhungu, being directors of Erad Supplies and General Contracts Limited are accused of fraudulently uttering a false invoice for $1,146,000 (Sh115,061,838) as evidence of an arbitration dispute between their company and NCPB.

Waluke was temporarily held at the Milimani basement cells before he was arraigned.

Waluke denied all the four charges

Controversial businessman Jacob Juma is dead. Juma was shot dead by unknown people while driving past Lenana School Thursday night.
Nairobi CID boss Ireri Kamwende said the businessman was driving from his bar at around 9.30pm when he was shot by gunmen who escaped on a motorbike.

His car had about 10 bullet holes.

The 42-year-old who ventured into business after studying at the University of Nairobi has been vocal on political issues and severally bashed the government.
He will be remembered for claiming his mining license was revoked after he allegedly declined to pay a bribe demanded by Former Mining Cabinet Secretary Najib Balala .

The businessman also refused to apologise to Supreme Court judge Njoki Ndung’u for claiming she received money alongside Justice Philip Tunoi. Ndung’u refuted the claims.

Jacob Juma had also alleged Jubilee used over Sh250 billion of Eurobond money to refund all campaign cash allegedly used in the 2013 general election.

Six more dead as Jacob Juma's killers probe runs cold

Six killings with reported links to the investigation into the murder of Jacob Juma have added to the mystery.
As Kenyans marked this year’s Madaraka Day, a new murder was being executed. It was easy to ignore it.

KTN pieced together the last moments of two of the four men described by the police as most-wanted city gangsters. Simon Muturi and three of his colleagues were gunned down on the night of May 23 on Uhuru Highway. An AK47 rifle and a pistol were recovered.
“I was at work on the day I heard Simon had been killed. We went to look for him at City Mortuary,” said Simon’s brother Edward Muturi.
Eunice Wachuka, Simon’s widow, was informed of the killing by her mother. Police were quick to point out that the gun that felled Juma was the very gun they recovered from one of the suspects.

But KTN reported that the police account did not add up in many ways.

The man the police claim was a most notorious gangster was a fellow police officer that the Nairobi criminal investigations police chief told a local daily was attached to Wilson Airport police station.

Erad directors Walukhe and Wakhungu were finally convicted. As to whether they will pay the full penalty of their crime, that is another story of wait and see. The political constellation could vary again, and their criminal fortunes change. It is not the drive for justice precipitating these stEps; it is the interfactional wars at the top as pro- and anti-Ruto forces jostle at the Kenyatta succession.

The two were ordered by a magistrate to pay a fine of close to Sh2 billion or serve at least 39 years in prison after they were found guilty of defrauding a state agency.

The Judiciary yesterday explained that Sirisia MP John Waluke will serve a 67-year jail term while his co-accused Grace Wakhungu will be locked away for 69 years if they fail to pay their respective fines.

Trial Magistrate Elizabeth Juma said Waluke and Wakhungu are to serve the lengthy jail terms if they do not pay the fines amounting to over Sh2 billion.
The two are to serve the cumulative jail terms as individuals and on behalf of Erad Supplies and General Contractors as the directors

There are some clauses in the ruling which will send shivers up spine of many a public man cum director of a private company. The wheels of justice turn slowly in deed. Took 40 years to clear Mandela Nelson off prison. Took a century to reclaim Kenya's landmass from colonial Britain. 50 years nonstop war to unify Vietnam. But it does come to pass, in one form or another, Justice.

The High court has ruled that the Directorate of Criminal Investigations (DCI) has no powers to institute any criminal charges unless okayed by the Office of the Director of Public Prosecutions.

This is after justice George Odunga delivered a judgement in a case in which embattled Acting Chief Executive Officer (CEO), National Water Harvesting and Storage Authority Eng. Geoffrey Sang challenged the decision by DCI to arrest him and charge him.

Eng. Sang told the court that individuals at the water harvesting authority are colluding with officials of the DCI to have him take a plea as a public officer so that he steps aside and he be removed from office for their preferred candidate to be appointed.

"I have already found that the 2nd Respondent -DCI had no powers to levy the said charges without the consent of the 1st Respondent (DPP) and that the said action was illegal," Odunga ruled.
Further the court ruled that the action by the DCI can no longer be a basis for the removal of Eng. Sang from office.

Meanwhile, the DPP and DCI have been barred from instituting criminal proceedings against him.
YA! The two leading anti-crime offices and officers in the land, at a time there is a war on graft, have been barred by law from tabling evidence in a court of law, explicating a felony! ---Only in Nigeria! (see the great Odili injunction!) Could Haji and Kinoti and their teams be that stupid enough to sabotage themselves, or are they just obeying their orders, acting out their scripted parts.

I believe they are acting their scripted parts. Pawns held short. No dreams of queening.

Therefore behind the scenes, Waluke and Wakhungu, watoto wa Ingoo, have a serious fighting chance. It is still the reign of impunity. This means William Ruto's fortunes are not lost yet.  The Hustler need not give up. The Big Seat is still within his grasp. Everybody high has still too much to loose, and thus, are open to the stalemate of a blackmail. Surely even if not himself, Ruto must know who killed Jacob Juma and Chris Musando. And he must know they can't kill him, because Kenya would implode if Ruto is murdered.

Well, Kenya has never had a historical Labour Party, otherwise the likes of Markan Singh (Father of Kenyan Trade Unionism) and Ambrose Adongo (KNUT Veteran) would surely have served in cabinet at one time or another.

Atwoli's first great underpunch, is therefore that, as long-serving (should we say eternal) COTU boss, he has failed to transmute the potentially formidable, organised labour of Kenya into its logical path: the basis of a worker's party in Kenya, aka labour. This is one gaping void why our national politics have continued to tumble into a monopolistic narrative of ethnic bigots and tribal arithmetic.

But there is no subsuming organised labour, however poorly led. Organised labour has always been like the famous adage, of the idea whose time arrived: can't be wished away.  Riding this lame tiger as it were, Atwoli has yet emerged as the only Kenyan politician with a national thrust not based on his ethnic lineage nor support from his  tribal grassroots. In any case he is also an urban kid.  Labour does not do tribe. Labour does wages, labour does  income degeneration at the hands of inflation; labour does the material conditions of existence under the dictatorship of Capital. Labour may be confused sometimes, distracted by other emotional alliances like tribal  (or racial) solidarity,  but its primacy, urgency and wherewithal remains material and practical  economic welfare: real uppity. And since the lack of economic welfare and commercial marginalisation can never be addressed by fictitious narratives, be they ethnic solidarity or divine scriptures, labour unions  fighting the workers' corners  can never sell illusions. There is only one cure for hunger: food. You don't have food, all other narratives are bull+sh!t. You can't pay rent in the city, the landlord is Evicts.  (unless it is a Nairobi slum where the Mungiki, Talibhan, Baghdad or whatever other organised gang, can mediate for an alternative price.)

Francis Atwoli has therefore been Kenya's most spectacular public gymnast in politics. Wilson Sossion's is like an amateur's compared to the skills of Francis Atwoli in the political ring. Atwoli is so complex I think his person best tells the true  tale of post-colonial Kenya (the domestication of labour). ---Unfulfilled ambitions yet an official narrative of fulfillment. A duplicitous official acquiescence to the official narrative by day, yet at night, daggers are drawn to even up the odds. A tale of two nations keeping up the appearances of one. This national schizophrenia then expresses itself in very different forms in nearly every sector. --For instance, on one hand, Miguna Miguna is a Canadian easily declared persona non grata in Kenya, on the other hand, Miguna Miguna is an unfalsified Onagi from Ahero in Nyando, Luoland Nyanza. Uniting the two, resolving the contradictions, is currently beyond Kenyan political and legal competence.

Of course hordes of sane Kenyans do not  pander to that kind of intellectual mediocrity ----the mediocrity propagated by Kisii doctorates like Fred Matiang'i, now a sleeper presidential candidate. How be it the judicial apparatus under the likes of CJ David Maraga is dutifully carrying that dirty water for the  state? In fact I pity David Maraga. He  suffers in silence like a rape-camp victim. Such victims are  ashamed of their forced orgasms, which, on the surface, indicate they enjoyed  their degradation and ritual humiliation. I suspect CJ David Maraga can't wait to go home and heal. His tenure has been shredded to infamy, mutilated like the hinds of the victim of a runaway jail gang-rape in the male cells.

Another example of the schizophrenia is digital E learning during the covid-19 lockown. This has been the mantra of professor Magoha, education man.  Most of the students from the rural schools, not to mention arid Turkana and the slum-dueling rest, wouldn't know what digital learning is all about. And, howbeit, they are the majority in the country. The alienation of the ministry of education from reality is thus psychiatric. Aah, that laptop programs for primary schools! Would, it had succeeded! Would, the money was not looted.

Magoha's brilliant mind continues to play offside Kenya's reality. That is like being a mad man at the market.

Another example (of the national neurosis) is that, on paper, Jubilee programs have gone well. Officially, Uhuru Kenyatta and William Ruto sky-rocketed the national debt financing those (on paper successful) development projects. Think of the Eurobond heist too.  But Lo! On the ground, inspections show there is nothing  to show for that surge in 'developmental debt'. The term White Elephant comes to mind. A plague  of white elephants hit Kenya under Jubilee. For instance, the multiple dams which were  completed for multi-billion shillings, proved non-existent. Not even a wheelbarrow of kokoto to show for a billion spent! Dr. DavidRotich had to be replaced by Dr. UkurYattani , in a forlorn if desperate face-saving, or cover-up exercise.

Last but not least to make the point for today: the government is in the midst of a war against corruption, but the truth is corruption continues unabated. And those who should have suffocated in their own guilty blood, continue to earn promotion and perpetrate more evil from the top. Cleophas Mailu, former health CS, recently stunned the senate and the public, stating ... without batting an eyelid, that he is a 100% moron.

Which brings us back to COTU Francis Atwoli.

Having stunted as a labour activist and guru, Atwoli degenerated into a Luhya Kingpin. There is a big void there. In fact, looking at Ingoo, looking at the pretender Ingwe's ---say Mudavadi, Oparanya and Wetangula, it is obvious they are but blind cubs between the legs of the only Ingwe: Francis Atwoli.

But that is a sad statement for Kenyan labour. The key labour activist, the OFFFICIAL personification of the labour movement today, The Almighty COTU FRANCIS ATWOLI, is content to rent himself out to two dynasts in their war against a prospective opponent, the feared gate-crashing Hustler.

Instead of he himself using the trade union movement to launch his presidential bid, Atwoli folds like a natural watchman or cook, to serve his adopted masters. It is an underpunch the size of a national trauma. It is a collapse the size of class treachery.

Atwoli is a giant who has convinced himself he is best active as a docile puppy, wagging tail continuously at his masters, eternally faithful in the betrayal of labour, his base! He has diminished COTU and himself to a looter's accomplish. Not that he as any faculties remaining to recognise his demise. His super obesity once so ridiculed by the mouthy Cate Waruguru of Laikipia, is symptomatic of the pathology of his internal rot.

I think Atwoli is still suited, even fated to perform a few more theatrical shows. He should shock the nation by declaring he is going to Canada to bring Miguna back home. He is the only one in Kenya who, in public podium, can laugh and say: 'nobody in high office seems to know the geography of Kenya, so let me, Francis Atwoli, teach you: Miguna is a Kanyadian. That is somewhere in Nyanza. Toronto Canada is off the trail of his lineage, parentage and nationhood. This orphan has learnt his lessons enough. He has been kept outside the fence of his home enough. It was his punishment for abusing his elders. He behaved like those odd boys of mine ----Echesa Rashid and Waluke of Sirisia. But it is now time for him to come home. So I Atwoli will bring him home, foolish boy. to regret next to me!'

Who will stop Atwoli at the airport when he comes with Miguna as his luggage or ballast!?

2. And yes, it seems Kenya is looking for a Luhya president as a compromise. The obvious candidate is one man only: Francis Atwoli. He combines, even if theatrically, the two strands of ethnic arithmatic and labour activism. That is unique. The rest as I said, are babies yet to urinate anywhere else apart from their mother's laps! (---Mudavadi and Weta are certified cowards, having missed the KALONGOLONGO oath which would birth The Handshake gimmick. They are a waste of Luhya time. They are worthless litter.

Atwoli is by far the greater man from Ingoo. The only Ingwe in town! ---Not that he knows it, historical underpuncher that he be!
But there is still some mileage to his theatrics. A spectacular climax before the inevitable exit.

'If a government based on devolution and the dispersal of power is to be given a chance, the IMF's role in political horse-trading in Kenya should be curtailed,' argues Charles Abugre.

There is a tense stand-off in Kenya between the Ministry of Finance and the Ministry of Local Government, which is holding hostage critical laws that need to be passed to implement the generally acclaimed 2010 Constitution. These ministries differ sharply on how to regulate the management of public resources.

They have submitted separate draft bills to the Constitutional Implementation Commission (CIC) to be forwarded to parliament.

The one from the Ministry of Finance (The Treasury) is an Integrated Bill covering the two levels of government - the national and the county. The Ministry of Local Government has put forward two related Bills, one specific to the financial management of the county government and the other - an Intergovernmental Fiscal Relations Bill - which aims to create mechanisms for ensuring coherence between the two levels of government in relation to the management of public finance. This ministry opposes the single Integrated PFM Bill approach and argues strongly for a separate Bill to strengthen the devolution process and fears that the Integrated PFM approach is a stealthy way of re-centralising power.

The Constitution of Kenya creates two levels of government which are independent of each other but who should 'collaborate and cooperate' for the public good - very much like the American political system.
The disagreements between these two ministries, both represented by Deputy Prime Ministers, is so sharp that the CIC felt compelled to refer the matter to the two principals of the coalition government, President Mwai Kibaki and Prime Minister Raila Odinga.

 Word has it that although the principals were unable to reach an agreement they were perhaps leaning towards the Integrated Bill approach and therefore have ordered the two ministers to consolidate their drafts into a single Bill.

This apparent decision has severely irked Kenyan civil society and the taskforce put together to detail out the devolution process and whose advice informed the Bills submitted by the Ministry of Local Government. Their anger is based on the justifiable fear that the Treasury is actively seeking to roll back powers taken from them by the constitution's strong focus on devolution, participation and service orientation.
As Kenyan Mpigs fume today 2020 July, whether they are Tangatanga or Kielewekee, not a single one seem to know anything about our history, and the implications of our mishandled DEBT obligations. They are thus a storm in a tea-cup.

There is something called the Proteus Syndrome. I believe it is derived from an ancient myth of  Hellas, Greece. There was an old man of the sea who could tell the future to lost sailors, but before he did, he would throw quite a running set of shenanigans at the interrogators. Some of these were so scary the weak nerved would let him go. But perseverance and courage always paid off. This folktale reminds me of another tale about class struggle. It is said to adopt many a camouflage forms. These confuse simpler minds to death, reduce good ones to surrender, and, by attrition, drive even better ones to the doorstep of giving-up on inquisitive openings. I imagine whether one is looking at Mlango Kubwa MCA, Patricia Mutheu Musyimi, being clobbered as to death by Fred Matiang'i's goons on behalf of the puppet General, Badi, charged to overthrow Sonko from City Hall to make way for new cartels .....

OKAY, BLACK LIVES MATTER, BUT CARTEL PROFITS MATTER MORE!










....  or whether one is looking at Raila and Uhuru in a failed mission to both buy and intimidate the senate into a political horror; or William the Hustler simultaneously outside and within the government, or DCI Kinoti empowered on Monday only to be disempowered on Tuesday ... these are all shenanigan forms by which a fundamental contradiction within our society is throwing smokescreens, playing possum. The conflicts are also fissures through which a bit of the pent up furies within are escaping, giving warnings of an escalating boil below.


A lot of political frogs are croaking, for them this revenue distribution maneno's is all about who becomes the next president of Kenya, come 2022. That is their next rain, for their mating season, election, and there ends their political minds. Added to this is simply the Raila-Ruto paradigm of antagonism, all consuming.

FROM MAJIMBOISM TO DEVOLUTION

But devolution is a  deep subject in Kenya, in deed anywhere, which is why there are a lot of federal states around the globe. Loosely centralised unions give a lot of breathing space to desperate mixes, composting with a lot of gaseous release. Molding diversities into a workable Union requires political talents exceeding greater far. For every Union state, there is always the ghost of secession to be appeased. Social justice is a very strong wand to achieve that end.

In Kenya, running toward independence in the early 1960's, there emerged a big word: MAJIMBO. Jaramogi Oginga Odinga and Johnstone Kamau (alias Jomo Kenyatta), were strong centralists and KANU union men who would have nothing of MAJIMBOISM. Majimboism was equated to the secessionist tendency and the KANU gods lambasted it for intent to create tribal fiefdoms, and thus, remain a colonial fifth column. That most of the MAJIMBOISTS came from the SMALLER, comparatively MARGANISLED tribes and arid regions, should have offered a spectacular clue to the breathtaking historic canyon separating the Bigs from the Smalls of Kenya. But greed and euphoria are a blinding cocktail in power.

Pwani was already feeling not very much Kenya ---citing old tales which went back to broken treaties with the defunct sultanate of Zanzibar; neither was the Somaliland NFD (Northern Frontier District) feeling Kenyan. There would be constellations called SHIFTA in the NFD and, elsewhere, motto's going as PWANI SI KENYA.

The resultant KANU unitary state became a classic case of the centre and the periphery, where the periphery was left to stone-age abandon: Swathes became Ruralia reserves of poverty, marginalised peoples. The Turkana being a powerful example. Many escaped from economically collapsed Rural areas only to swell the ranks of city slums. KANU, having failed to deliver the fruits of independence to the majority, having failed in in its historical mandate and betrayed here covenant with the people,  imploded into a totalitarian and thieving racket running on the fuel of ethnic animosities.

ENTER THE MAJIMBOIST SLEEPER ARAP MOI AND HIS DFFRD

To redress this national imbalance which the Majimboists feared, DEVOLUTION was born as the flower of the 2nd liberation. But not before the second President of the republic, The KADU stalwart turned KANU supremo, DT Arap Moi, pitched in a half-hearted Majimboistic effort. This is the policy which went with the name DISTRIC FOCUS FOR RURAL (and National) DEVELOPMENT. But it was largely about creating a new powerbase and breaking the stranglehold of the old Kenyatta power establishment. It was just an alternative looting scheme for the new power constellation at the centre.

The problem of marginalisation to be solved remained, the imbalance between the centre and the periphery, remained intact: tic-toc, time sped. Toward the second liberation. The MAJIMBO FORMULA now we called DEVOLUTION, the crown in the jewel of the new constitution. The constitution to make a nation of us, motley crew of tribes and prejudices.

But without clarity and articulate vision, it is a question of one step ahead, several backwards. Devolution, like the liberation of slaves, has been an act at which money power stays centralised, as usual in Nairobi. The slave is free, but must stay as bonded labour to the boss who kept him and his ilk a slave all those decades!

Otherwise the economic system will collapse. Someone, has to do the tedious work of producing wealth, for nearly free, if not wholly free. Coffee farmer, sugarcane farmer, maize farmer, casual labourers. Devolution has also seen some of the most concerted efforts to disorganise Organised labour. One of the most effective Unions hitherto, KNUT, has currently been hit a near fatal blow. Professor Magoha of education has conspired with the TSC to use the CORONA LOCKDOWN for a pre-emptive:

The ouster of indefatigable trade unionist Wilson Sossion (pictured) from the helm of the giant Kenya National Union of Teachers (Knut) has been work in progress for the last few years.

The writing has been on the wall. Plans had been meticulously hatched. And as the days progressed, Sossion's removal as Knut secretary general became a matter of when, not if.

The fiery unionist, who has had running battles with the Teachers Service Commission (TSC) over a raft of issues, admits that it is not just the teachers' employer which has been baying for his ouster.
The commission, he says, has conveniently been the catalyst to speed up the process. During a press briefing on Wednesday at Parliament Buildings, the unionist, also a nominated MP, blamed his woes on the top political leadership

There were other dynamics which dictated Sossion's removal be incomplete, just like today, the removal of Mbuvi Sonko or William Ruto can not be finalised! Those who want this done do not hold all the cards, it is a kind of stalemate. And so, attrition.

Shock for Knut as thousands of members miss out on pay rise

Thousands of teachers are reeling in shock after their employer denied them promotions and a salary raise for the second year running, citing their membership to the Kenya National Union of Teachers (Knut).

Their counterparts, who ditched the giant union led by Wilson Sossion, after it clashed with the Teachers Service Commission (TSC) last year, are celebrating after receiving fatter pay cheques this month.

Some 47,131 teachers in job group B5 have been promoted to job group C1 using TSC's Career Progression Guidelines (CPG) even as 32,556 of their counterparts missed out after TSC said they fall under the Schemes of Service because they are members of Knut.

PREFERRED PROMOTION PATH

Although the Employment and Labour Relations Court ruled in favour of Knut, its members have lost financially.
This caused an exodus of teachers from Knut to Kuppet between last July and June this year, as others opted to remain unionless.

A source at the TSC Tuesday said teachers who ditched Knut and joined Kuppet have received a salary increment under the CPGs.
It was, however, not possible to immediately get the details of those that have been left in the cold

Devolution must kill the most effective historical union to date. That is a think to think. From Ambrose Adongo to George Magoha. Which makes Magoha Professor Judas to labour. But the good professor is just the latest cog anyway. He is excused. He knoweth not what he doeth!

To implement devolution, there was a ministry created for it, and no wonder it was headed by rot
like Anne Waiguru., now Mumbi. She's vilely remembered for the series of NYS scandals. So, no sooner was devolution the song, than the pillage and plunder of national and public resources went even a notch higher. Whether one talked Eurobonds or the SGR, robbery was still the name of the game at the centre.

 It means a financial crisis has been unavoidable, is unavoidable, however much of a Santa Claus Xi-Jin-Pin may feel toward  his Kenyan protectorate on account of his OBOR ambitions. And now there is the CORONA contraction too. It is a global phenomenon which shall spare none.

ONE MAN ONE VOTE ONE SHILLING IS A DISCOHESION HORROR

The competition for ever  more scarce resources will heighten. ONE MAN ONE VOTE ONE SHILLING is nothing but a recidivistic lurch to the 1960's. Those were the days when the independence party of yonder, KANU, engaged the antics of instituting policies which inevitably led to a failed process of nation-building. They instigated policies which destroyed national cohesion, contrary to the vision in TZ for instance.

NB: This week we have saluted the late Ben Mkapa, GCG diplomat and former president of Tanzania. I didn't see covered in the eulogies, any of his insights  into the Kenyan ethnic quagmire,  as he observed and recorded during his reconciliation marathons with the likes of Martha Karua and the then cast. ---Martha Karua was then known as the iron lady. She misread the amiable mien of the urban Tzder as a weakness, yet it was the armour of a veteran who had seen it all, knew the tricks of the trade all through. ##FOOTNOTE

DEVOLUTION as a concept in its ideological purity, is of course a dream step, for the marginalised locals that is. Theory is services and money come close. Development takes off. Income disparities between countryside and city decrease. Autonomy, local rule. It is like the colonial office in London surrendering control of the colonies to an independent African government, ie Uhuru come to a bar near you!

But Imperial London experiences this as a loss of prestige, and, economically speaking, a loss of a sphere of interest and profitability. This loss is also the way Mwai Kibaki and his cabal of colonially-minded Centrists saw the Raila-fronted devolution. Devolution was dismemberment of a profitable union, devolution was the blunting of their economic reach. But even more importantly, the international consortium of debt enslavers fronted by The IMF and World Bank, can not afford to allow locals to determine their own financial priorities, control their own monies, and build their lives independently. Devolution therefore had to work out into an empty shell, a politically appeasing slogan but of no content. The central government had not only to retain the the Lion's share of revenue ---to pay external debt, but also retain control over the little that was distributed for the county governors to steal at leisure. It has been a feeding frenzy at the county near you.

This of course charts a course of conflict between the led and the leaders. A conflict which does not always play well for national cohesion, since failed and shallow politicians will defend their homeland at the expense of perceived enemies. In this they will forget the national interest.

For social justice and a sense of belonging, money has to flow to the forgotten, historically marginalised areas. And it has to flow big. But if you are looking for votes and those arid areas though geographically big are numberless, you can only condemn them further unto marginalisation. Raila Odinga and Uhuru Kenyatta find themselves in the place their fathers found themselves in, early 60's: condemning outlying areas of Kenya to stone-age relief systems and designed marginalisation. This is the centre to periphery colonial model. The Handshake duo are not building any bridges, they are burning them. To put it the Achebe way, they are setting on fire the hopes that should hold us together, and we are drifting apart.

Just before the peoples-driven presidential oath which crowned Tinga the alternative president, there was already a map of two Kenya's: the Republic of and the Peoples republic. It was a joke, so said, but you know the saying about how history repeats itself: farce. It is towards two Kenya's now. Every region their interest, no national collective interest.

The question is: how do we make the divorce velvet!?
