Chebukati should resign
« on: September 01, 2017, 02:14:23 PM »
If I were Chebukati I would resign.  Once the court finds that the body you chair committed irregularities and illegalities then you really do not have any choice but to resign even if you disagree.  Maraga is trying to set a new standard of integrity in this country and I hope Chebukati follows suit.  We have to start taking public service seriously and not personally like Hassan did.

He is Kenyan so expect personal interest to override all others. Reputation and of course culpability. He may be sued in future so he must maintain an innocent facade.

Resigning does not mean admitting illegality-that has to be proven in a criminal court.  All Chebukati has to say today at his press conference is that he disagrees with the findings but respect the court ruling and in that spirit, resigns so that he can give chance to a new set of fresh hands and minds to run the elections.  That to me is an honorable thing to do instead of clinging like Hassan did until he was hounded out of office.

He should hold the re-run and then resign. If he resign now - then his deputy takes over. There is no time for replacement. Unless the whole commission were to resign.

Ok, Lets wait for his press conference but he is really damaged by those findings.  I do not understand why we Africans have problems running things efficiently.  Why was it so difficult to do all the Forms 34A's correctly on the original forms, sign them, stamp them and transmit them as required by the law. I thought party nominations were shambolic because of lack of resources but IEBC has enough resources to ran an election in India with 800 million registered voters and yet they cannot ran an election of 19 million registered voters seamlessly.

Chebukati,  chiloba and majority of iebc will be gone some might end up in jail. Next election most likely next year. Uhuru will not be on the ballot, not barred by the court but his own choice.

Chap is hanging on tight.  he actually thinks he's ok to run and deliver the up coming elections.  Never mind that his account was used in deleting 34As..

He's just another electoral criminal.

I missed bits of his presser but his gist was they would wait for the full judgement.

I think resigning now would amount to sabotage. He was not personall liable so how much of a purge do you need to be satisfied that IEBC is cleansed of its failures?

Remember we have 60 days. Is that sufficient to disband the entire team and cobble up another and oversee the election? I doubt.

I think we should reserve judgement on IEBC culpability until the full judgement is out. Thereafter, I think they should step down following the conclusion of the last petition up to the next 12 months

Trust is the key here and I do not see how he can redeem himself after these scathing findings. If Chebukati remains for the sake of another elections on time, then Chiloba and the head of the ICT team must go.  Some big changes must happen regardless of the time constraints.  You cannot have the same people do this again and expect a different result.

Chebukati invites the dirty DCI to investigate his staff. He could have indicated that the commissioners are meeting to deliberate on whether to send home the IT department for a start.

Agreed, but 60 days is limiting. Ideally everyone should go home but that would negatively impact the election which could Ben held as soon as next week.

The realistic way forward is accommodating NASWA's flimsiest whims and getting on with it. I have little doubt this is the way forward.

The issue was not the incompetence of IEBC staff, it's to do with criminality carried out on their systems.  Chances are these poor sods could not challenge any rigging machination.  They might have been bullied into allowing access.  Heck Msando died doing his job.  We need to go easy on some of the lowly staff.

But if it was sabotage(the closest I can come to the hacking theory) at the IT department, then 60 days is decent.  It means they just need to put the Msando studies in charge.

Scok just saved the country from splitting it's time to exercise caution and sobriety from both sides. If there is will from both sides am sure there is a way to extend 60 days requirements to accommodate necessary changes.  I expect an avalanche of court cases so no one knows who will be or not be on the ballot

Exactly, we do not know how the other side will react.

Chebukati is therefore an idiot. How do you share your account and password which has full administrator rights and then deny or disown the transactions carried out? He should have asked Chiloba to get his own. He cannot pin these transactions on Chiloba because they were carried out by his account.

Was it his account or just an account with his name?  My hunch is the latter.  There is simply no conceivable reason why he would have administrator rights.
