Matusi
« on: January 04, 2015, 01:46:58 PM »
I am formally requesting that Obienga be suspended from this forum and all the posts he has made which contain insults and barbs intended for me be deleted. Those are the rules. I am aware that there is zero tolerance for matusi. Note that I have the authority to remove the offending posts but since I am an interested party have opted to bring it forward.

Slow down Omollo. Obienga was informed by Windy of the rules that we abide by on this forum and he has since complied. Check the timing of his postings and the timing of windy's reminder. Let it go.

Its his game. He did the same a while ago and again "complied". This is what brought down RCB and Nipate.com - loopholes and subterfuge.

Simply show your evidence and the timing of such postings and let the council of spears deal with it. Whatever the case, I applaud you for not taking the matter in your own hands. Even while we strive for a cleaner forum, let us not do so in such a way it infringes on freedom of speech and expression.

What freedom of speech is there in deliberately spewing matusi?

Do not show your relief nor applaud me too soon because if no action is taken, I will feel abundantly free to unleash the same. I will not exceed the measure by Obienga but will strictly keep within his style and depth. I am sure then you will defend my right to freedom of expression.

Not so fast....you are being disingenous here. Why didnt you complain yesterday, or you needed to rest through the night to figure out that you had been insulted. I did go back and read the other stuff about girrafe et cetera. The warning shot has already been fired, let it go.

I am not obliged to respond to your inquisition. You have not declared your interest in the matter, especially why you are behaving like a defendant in a trial against somebody else.  However for argument's sake here are your answers:
  • There is no time limit to filing a complaint and
  • There is no requirement that the complaint be filed on the same day the offence was committed
  • If it helps you then know that I was not online and all the offending words were posted after my last post yesterday. I encountered your insults upon logging on today.

I hope it helps your defense.

Here you go! in one post you pretend to know all about the insults and wonder why I missed them yesterday on the other you feign ignorance and actually suggest I should offer "evidence". Of course there is the frontal attack where you wonder why I did not complain seconds after the matusi - as if my full time job is to watch out for matusi incase I jump your "deadline"

Wasilwa, do your best, I second your great effort and in the interest of public disclosure, will liberally share any more PMs you send my way. You have been warned. You launched your trolling insult and got one in response, every action has a reaction, don't start fights you cannot handle. On that note, I hope you succeed in yet another misguided and self defeatist quest:
I would like you to spare your insults for .com otherwise I will start a process to see you expelled from here. Gender reversal as an insult is NOT permitted here as are many other insults. If you run out of clean ideas to share, go back to .com to spew matusi. A copy of this message is hereby sent to body that deals with violations.

Omorlo,
You have a STRONG case, but an outright ban,to me, sounds too harsh a penalty for this offence. I propose a warning followed by a temporary ban followed by a permanent ban.

In all of these, I request hearing obienga's version as well

I have not advocated for expulsion although I wont mind offender being so sanctioned. RCB and .com ended up where they are because complaints were ignored and trolls got away with murder. After that nobody raised a complaint instead people went after each other's throat. .org has a chance to adhere to rules we all made or join .choo

Dealing with Obienga is actually quite easy, given that he never  reads or engages in the slightest amount of thinking.   In his  arguments, he appears to believe that forceful assertion is a good  substitute for those things.  If one can get by his poor language and deal with what he is putting out, he will quietly slink away.

Example:

If you read our exchange on the "blooger jailed" thread, Obienga

opens with

Quote
MoonKiai, where do you unearth such fictitious hogwash from?

and

Quote
I cannot and won't heed your suggestion not to call out asinine BS when it is willfully being spewed.

And how does he propose to do that?   He offers us things such as

Quote
Did you read the attachment I included? In it you would have seen  that a Kenyan sentence for possession of a roll of bhangi is far  more lenient than a US mandatory minimum for the same crime.

After he gets slapped around a few times with the facts, his song changes:

Quote
The link I provided was only to demonstrate that there were  mandatory minimums under US law for certain offenses.

Compare that statement with what he initially wrote and decide for yourself. In any case, a poor dodge, reflecting low-capacity thinking: what would be the point of such a statement?  After all, every country has mandatory minimums for some things, e.g. murder.

Another one was this:

Quote
If mental illness was a defense for every offense, every court in this world would grind to a screeching halt. I cannot imagine the endless nature of such an excuse for lack of personal responsibility. "My lord,  I exposed myself because I was mentally ill", "My lord, I was speeding because I was mentally ill".

A little while later it was:

Quote
If he indeed did not loose the mental defense on a technicality or through cross examination that established otherwise, then he should appeal ...

But, never the man to miss an opportunity to state the absurd, he adds:

Quote
Has anyone considered the remote possibility that denying him his right to a mental examination (assuming all procedures were followed) could have been done in his best interest to give him and everyone else a way a quiet way out on appeal?

Before I knew what you write, I engaged him with gusto. I recall the debate in the wake of the ICC ASP conference. That is when I discovered he has no ethics and would deny things he has already written and strongly argued for just minutes earlier. His failure to read is legendary. He posts documents that he has not read and turns to insults when caught.

MoonKiai, don't chide yourself. That is quite an extraordinary effort spent attempting to analyze an anonymous person. Interesting, I had no idea you were an accomplished English language teacher. I wonder how much of your post is because you felt slighted and hurt. Did your imaginary slapping around boost your ego? I hope it did considering your chest thumping bravado. You may have needed such a boost.

Quoting a lengthy discussion out of context is something a mischievous person would do. If you couldn't state it during the debate why cowardly sneak around to a thread out of sight to do so? Is that a brave or cowardly thing to do? If you dreamed that I was going to slink away, you will have better luck buying lottery tickets for the rest of your life. I'm not done yet. Did you ask for elaboration of what you call absurd? It is funny you should term others incapable of thought and turn around to fail to think outside the box or seek clarification. Indeed nyani haoni kundule, least you call that an insult, it is a Swahili saying. I understand you excel at English but don't let literal translation not confuse you.

Obienga:

I will leave it to Nipateans to go read that thread and decide for themselves.   Engaging you in the manner you'd like is not an activity for a thinking person, and I will not do so; you will, I'm sure, have better luck on the other Nipate.

MoonKiai,

You have a clear choice, you can let others be who they want to be whether you like it or not, or make it personal and assume all the unpleasantries that come with it. Make no mistake, I am not here to engage in a popularity contest, neither will I entertain your silly suggestion. This is a public forum not mali ya Baba ama Mama yako for you to tell others what to do or where to go.
