ICC was created for people like Raila who have outgrown the justice system of a country.

The country of kenya is unable or unwilling to prosecute him for fear it will cause more chaos or violence from his bhang-laced fanatics.

Kenya as a signatory to ICC therefore should invite Karim Khan to come and investigate his violence - and try him for crimes against humanity

Kenya should exercise their right to seek help from ICC

Referral by a State Party: A State Party to the Rome Statute, which is the treaty that established the ICC, can refer a situation in which it believes crimes within the ICC's jurisdiction have been committed to the ICC Prosecutor for investigation. The State Party must provide sufficient information to enable the Prosecutor to determine whether there is a reasonable basis to proceed with an investigation.
