You're right. It's Githu. I wish they had given us the reasoning though. She seemed to use who filed first and was served etc and says the Court won't be drawn into IEBC drama, they go sort it. Basically.

The bench seems obtuse. Now with two slow women at the helm. The men can't outshine them. Even when Maraga was elaborate on scrutiny, they don't seem to have brushed up on his ruling.

You really have a big chip in your shoulder :) IEBC as corporate entity will be represented by Prof Githu and team. IEBC and Chebukati are in same team with Ruto. The Cheroror four are free to get lawyers with Morlo and Gulye to represent them on their individual capacity as IEBC commissioner. The IEBC body corporate will retain the services of Prof Githu. The illegal procurement of legal services by Cheror is just more criminal charges pilling up against them. UDA parliament will shortly process a tribunal and Ruto will remove them before Christmas.

And this is why media is reporting that Chebukati won today - because che-error shenagians were rejected by courts. They are free to represent themselves as commissioners - but not IEBC.

This is a controversial issue. Mwilu's pronouncement is subject to misinterpretation. Did she rule that the four commissioners cannot be represented at all like Pundit is suggesting? No. She only ruled that SCOK cannot decide for IEBC who represents it. However, she left it open to the four commissioners to choose their own lawyers since they are respondents in the petition. That means you will still be seeing Paul Muite and Issa Mansour tomorrow and the days after. It remains to be seen whether they will speak on behalf of IEBC, because Paul Muite categorically stated he represents the majority of commissioners in IEBC. It was a clever strategy for Orengo to point out early that Muite and Issa Mansour had been locked out of the hall illegitimately. Once again, this theft almost passed.

Strawman arguments. Isaa Mansour application and response on behalf of IEBC were striken off. In short he cannot represent IEBC - his rogue response on behalf of IEBC (where he supports Raila petition) stand deleted. Prof Githu and group will continue to represent IEBC & Chebukati as Chair & Presidential RO. Supreme court allowed all the 6 other commissiners to appear with their lawyers if they so wish. Che-error and the 3 others can pick individual lawyers or Muite. Mule and Prof Gulye will also appear with their lawyers. Chebukati & IEBC (proper) have been tied - as they should.

Orengo - requirement the president must be receive more than half of votes cast. Ruto did not cast more than half the votes.

I think he is inviting the court to revisit their decision on supreme in 2013 and 2017 - that decided 1) invalid votes are not counted and 2) Ballot cast is not a vote cast
