HIGH COURT bars Judicial Service Commission from assigning duties to the 34 judges recently appointed by President Uhuru Kenyatta pending determination of a case filed by a Nakuru doctor.

Who is throwing tantrums now? What are they hiding? On the first case, the claim was that the shortage of judges was hampering the disposal of matters before court. How is the judiciary helping now?

How exactly did you connect petitioner Benard Okello with six judges or the entire judiciairy. You're an overzealous cow from ODM that are willing to defend the indefensible from Uhuru - pretty scaring to imagine what you'd do if Ojinga was to win.

I dont get it. Were they appointed illegally or not?
Am not in favor of judicial activism. It destroys everything. Look at USA that has been turned into a useless society by the likes of Clarence Thomas.

This is not first such appointment; Uhuru post his win being annualed changed; the rules as everyone knew; JSC forward the list; and president perform a ceremonial role of appointing them; not rejecting some them based on some "NIS" reports that he is not even willing to share. Any such reports out to be forwarded to JSC to do investigation any time any day.

The worse his rejection list has mutated - adding and removing judges based on emotions of the day. Prof Joel Ngugi is a new addition as Mumbi Ngugi name was whitelisted.

Let not defend the indefensible. Otherwise next year when Ruto wins - what will you say? NASA or ODM cows okaying everything Uhuru does is creating a terrible precedent.

Ceremonial role is moot. At first, people dared Uhuru to release the NIS report. Now the Judiciary is gagging him from doing the very same thing. It does not look good for the Judiciary.

Motive is important.He has shown utmost bad faith and will not be allowed to besmirch judges with wild allegations.That is why you can go to court and seek protection even before trial.Uhuru has lost on bbi and is loosing on this...by time two former CJ rain on you..it over.He can as well act illegally but he will come to pay.Cok2010 soon mchezo.Unless he want to spend retirement in courts he better seek wise counsel.His retirement Wil get eaten by lawyers...who are damn expensive.For now gov is paying

How can we know Uhuru's allegations are "wild" before they are tabled?

A high court judge in Nakuru has found they are prima-facia wild. Secondly it really JSC to determine the weight of any allegation.

And as for us 1) JSC has confirmed Uhuru never gave them evidence the last 24 months 2) The list has changed - with addition and removal
Secondly two former CJ have said the same and 3) The list is almost exclusive to judges that have been high court division of human rights and constitutions with history of ruling against gov.

Thirdly we know Uhuru made these appointments because he was desperate for bench for BBI appeal.

This court order therefore put more brakes on his brand new select judges from being in BBI appeal - and it possible Musinga will not get a 7 bench soon...so more BBI waiting time.

Finally if this is allowed to go; the next president will be selecting who to appoint or not appoint; thereby ammending the Katiba.

JSC list will now be a suggestion - with final pick coming from Harambee house. If judge has been ruling against gov - Harambee house can manufacture fitina.

Way forward. Appoint all of them. Channel fitina to JSC. If they have merit - JSC will start tribunal.
