Raila was actually the one collating changes to appease noisemakers. IEBC, disabled, pastorialists, MCAs, governors, judiciary, etc. This is Raila baby stop tripping on yourself.

IEBC - remains intact
PWDs - got 4 nominated MPs
MCAs - can double as CEC; don't have to quit to run for MP (Gatundu North case)
Governors - women running-mate not mandatory
Ombudsman - now strictly under JSC and non-voting JSC member. Cannot review judge or tribunal decisions. Must present report to JSC and Parliament annually
Pastoralists - ASAL equalisation fund sunset clause extended by 10 years

Raila was adamant no major changes would be entertained.
Well they did - but still BBI has major flaws.

1) Parliament - will become unwieldly - with possible 180 nominated Mps - that will be joke of the century.
2) Judiciary Ombudsman - Appointed by PORK and vet by Senate (conveyor belt) - and it's job is obvious - collect dirt and intimidate judges -  If JSC is unable to
run judiciary - investigate judges and magistrate - upon petition - let us have evidence of their inactivity - there is none.
3) Parliament - back to Deputy Ministers - 41 was Kibaki number - and minister in parliament and MCA - totally messed up system of gov. We will start having powerful politician as ministers - not proffesional apolitical onces we have.

In short - this is just mongrel we came from - and we are going back.

Yes. That why BBI will be coupled with 2022 to save the few billions for hustlers.

Robina , please take your time and study Uhuru and Raila and what happened in Uhuru second term.
I will summarize , Railas knows his time is up  and a legacy he wants is to correct 2010 Naivasha talks which lead to the promulgation of the current constitution .  On the other hand Uhuru wanted to lead Kenya peacefully and in the process loot as much as possible to create generational wealth just as his father did .
This is what lead to the handshake an agreement between two people .

Uhuru initially was not keen in changing the constitution his aim was to effect any recommended changes through adapting or enacting of laws .  Railas aim was for re-introduction of the Bomas draft  mainly introduce a powerful Prime Minister and Regional governments .

In between both for reasons well known decided it was better for the middle ground - Uhuru realized he could not achieve any legacy - Big 4 was a pipe dream and in comparison with his predecessor Kibaki would leave state house without achieving anything ground shaking - He saw an opportunity in changing the constitution he would be remembered when history is taught .
Raila also climbed down on the PM and regional governments  it was delaying a referendum he eagerly yearns for and secondly it was a hard sell to the most populous regions in Kenya  - The middle ground is what you have now BBI 2 albeit Uhuru cleverly sneaked in some items which he thought affected his ruling as a president e.g. Judiciary Ombudsman

As it stands now they both are for the referendum happening before 2022 but we very well know the bottle necks for that materializing  , It has to  pass  through  IEBC, County assemblies , Parliament and the hardest of all the Court system which BBI2 is going to curtail their independence . Then finally on the ground  the reality check will hit .

Now if you check who is to lose its definitely Raila - without referendum he forgets the selling line of coalition after disastrous performance in 2013 and 2017 . Uhuru goes home with a tainted legacy but with a good financial foundation of his family and also with an assurance of Ruto not going after him as Ruto will also be trying to recoup his investment post 2022 .

And why exactly would Tangatanga diehards like Njuri "warn" Robina? How altruistic! :) "They are playing Raila" is a new hustler anthem... Mobutu himself is cornered in No corner with his URP. Pastoralists have lost the special treatment and have to swallow hard and pick 35% which is much better than 1K1V crumbs.

BBI is Raila 2022 Manifesto - repeat after me. Basically Mobutu gets shafted as Uhuru backs Raila. So obviously the payback for Gema is 1M1V1S. The other carrots are to help old Baba win and cure Maraga advisory.

Raila actually allowed "editorial changes" - you can google it. Meant to appease PWDs, MCAs, etc - without conceding anything to Mobutu. The aim is obviously to corner Mobutu into No - because duhh - yes-no duel benefit Raila.

Gender is court-ordered - complete with an advisory from the mercurial Maraga. BBI does not create 1/3 rule it already in 2010 katiba. All those bills that failed in parliament proposed the same top-ups. Actually whether or not BBI passes 1/3 headache will still be there. Don't conflate things.

Second, BBI has strong props that are better empowerment than present and other proposed tokenisms
1. Parties are forced to ensure 1/3 in primaries
2. Nominated are for women who vie and lose prioritized by votes received. That ensure strong women get nominated and not flower-girls
3. Gender top-ups sunset clause is 15 years not perpetual
4. Parties are incentivised to field strong women by getting more funds - there is a gender metric in party fund

These measures are a big improvement on 1/3 issues created in 2010 and not by BBI

Wanjikus have right to report judicial misconduct to independent office. JSC is police service - ombudsman is a knockoff IPOA. See? It moronic to pretend judges should oversight themselves. Of course it can be abused but so  can any other office appointed by PORK. Judiciary is not a sacrosanct organ.

CS will be MPs and that reduce the duplicate headcount. Already we have more CAS than the 14 proposed in BBI. The present non-MP cabinet is excess fat that get trimmed by BBI. You have about 50 non-elected CS and CAS now - BBI cure this infection. Duale and Mbadi roles and deputies become D/PM and Leader of Opposition.

Bomas 2005 - CoE 2010 - all had hybrid "mongrel" - same as pre-2010. Selfish MPs doctored them in Kilifi and Naivasha. The same Wanjikus who wanted to elect PORK also wanted to domicile cabinet in parliament. The core of 2010 was reduce PORK powers and devolution. Both get enhanced by hybrid and 35%. 
In short - this is just mongrel we came from - and we are going back.



In short Pundit - katiba 2010 is not the Commandments. Even old testament was amended in new St James version :) BBI did not drop from the sky but was proposed by Kenyans for 2 years. Heck even Mobutu Bomas and twitter ideas have been included. Barasa and other poodles indicate Mobutu will oppose. Tough luck.

Why did we change constitution if old mongrel was good????????????

I like CK2010 because it based on strong principles of separation of power.

But this mongrel will eventually make PORK imperial and powerful...it blur the lines everywhere...which is very sad.

And if that PORK is somebody like WSR or Raila - you'll cry in the toilet - because theyw ill run everything. Uhuru wishes he was imperial - and feel really frustrated esp by Judiciary. That is good.

Implement CK2010 fully - and have independent institutions and branches of gov. This is what works. The mongrel doesn't.

We began with parliamentary system in 1963 - then it got changed to mongrel - we cried real tears.

We went president system like obtain in US and Nigeria - now we want to go back to the mongrel.
