Chief Justice Maranga should recuse himself from NASA case

Based on Uhuru campaign utterance. Maranga chief justice position was a token to kisii people. There is no way a dog can go against its owner especially one who has been feeding it T bone steak.

No amount of money would make me want to be in the position of these judges. Overturning a whole election is surely such a huge thing that I think even if NASA shocks us by presenting actual evidence, judges would not be inclined to do it. At the same time, if in the closed deliberations it emerged that enough want to do it, Im pretty sure they would be "encouraged" with candy or threats to drop their delusion of independence in matters of this magnitude.

It so weighty judges have 14 days to decide. In short unless you have smoking gun evidence - this is waste of time. Cherry picking errors here and there - is not enough to overturn an election and hold another one where the same human errors will show up. Transcription errors, transposition errors,mathematical, failing to stamp or sign, name it....as long as they are few & fair to all candidates...is no evidence enough to overturn presidential election. Maybe MCA election that is close.

No sane person imagines IEBC can hold PERFECT ELECTION. We want free and fair election. All mistakes & errors just need to be fair. NASA will cherry pick errors that advantaged Uhuru- Jubilee will respond with errors that advantaged Raila - and IEBC will pick the tabs (cost of law suit).


I mean if observers all says the election was free, fair, open and credible - that is CUE to CONCEDE.

NASA are wasting their time. Actually they are trying to skirt around the simple and decent thing to do. CONCEDE.

If NASA concede..our democracy will be more richer....rather than trying to discredit IEBC & make kenya look like a dictatorship where election are stolen.

Pundit, it is Uhuru that is making Kenya look like a dictatorship. Think about it: Is it really necessary to harass civil society? Is the level of brutality that has happened in Kisumu necessary? This heavy handed approach to things he could easily resolve in a neater way is what is tainting him and Kenya, not NASA claims. As you say, the way things stand now is that NASA has an uphill task, so I don't get why Uhuru thinks going after dissent in this manner is better unless he truly does intend a dictatorship and is just getting started.

Few countries in the world - US included - will allow foreign funded NGOs to interfere on certain matters. I think Civil Society need to be monitored and regulated. The Wariah is doing it in haphazard manner. As for demos - blames lies with both side - Police & Demonstrator need to listen to Uhuru advice - meet and plan how the demo will be conducted, when, how. Maybe it about time parliament enacted demonstration act of kenya - that will define how police and demonstrators can do their business - without messing up the rights of everyone else. I imagine they need to notify the police, maybe put media advert of the days, times & route of their procession - so everyone is aware - and people can raise objections.

As for Kisumu, people will disobey rules all the time and demonstrate spontaneously without notice, they will act unruly, like it used to happen with university students and happens in Eastlands when uwizi has become too much in an area or the police have killed someone the people perceive to be innocent. Police should not behave like monsters in that scenario. The demonstrators are not like Mungiki or even mobilized Kalenjin warriors or Tana Delta clan warriors: they are not carrying guns, machetes, arrows or other lethal weapons. Giant watersprays, rubber bullets and mass arrests are more than enough to contain them in a few days if not a few hours. Literally no one needs to die just because there was an illegal demonstration.

It has always been my belief that in Kenya it is the police who convert demonstrations into riots. They come in with violence and it then becomes a cat and mouse tit for tat game. Not always but a lot of times, demonstrations turn into riots the moment police turn up.

My reading of Kenyan history is that whenever the government heats up the political atmosphere, there is a nasty blow back.

Kenyatta did it from 1966 culminating in the First Kisumu Massacre 1969. He then rigged the elections that year after a string of political murders. By 1971 he had a coup plot on his hands.

In 1982 saw the culmination of another season of government inspired political heat.

After the 1988 elections where GoK just had a list of who wins where and who loses, the events leading to mass demonstrations and cries for multiparty democracy had got their foundation. By 1992 Moi had no option but to give in.

So Uhuru must lie low. The responsibility of claiming the country lies with him. If he allows Duale, Sonko and Kuria to lead the way, their journey will be very short. Moi paid a heavy price for removing the security tenure of Judges, Auditor General, Attorney General etc. Those are some of the few things most democracies have in common around the world and hold dear. Moi stole in broad daylight, the Auditor reported, he gave orders nobody make any comment even to opposition (when he eventually allowed it) and the matter soon got off the pages of the newspapers - which he treated as irritating flies and for that boasted that he had the most free press in the world.

The problem with Kenya for the last five and next five (I have no illusions the supreme court will kick out Uhuru)is both President and Deputy President are hot tempered and thin skinned and are given to arrogance and issuance of threats for simple slights. I doubt that I could have made either of them in charge of a department with people to manage.

The rush to declare the loser the winner was designed to make the ensuing court battle difficult.  That declaration should also be called into question.

Not only did Jubilee rug the elections, they pressurised the IEBC to declare them winners.
