Gichuru was the target of the new NARC Government in 2003. The Kibaki government went after him with gusto. He was being pursued for corruption. A warrant of arrest was issued. Even though Gichuru was attending harambees and being seen in posh hotels in meetings with influential ministers and power brokers like G.K. Kuria, we were told he could not be traced.
He then surfaced obtained bail and the case went dead.
Gichuru would not be heard of again until the Jersey judgment. Note that Kenya was asked to surrender Okemo and Gichuru before the trial of their "companies" but declined.
The idea behind the delay is a The Rich Man's Precedence known in those circles as The Githunguri Judgment. It was delivered by Justice Madan to stop a long winding case started by Njonjo against Githunguri for the theft of 300 million. Madan ruled that 8 years was too long to pursue someone as it became a persecution.
Pattni has benefitted from it as have a raft of Anglo Leasing suspects. To benefit you simply draw out the case until you hit 8 years. To do that you need money to disappear police files, court files, witnesses, get judges to call in sick and court clerks to mix dates and fail to inform parties.
I wish some guy like Omtatah could go to some court and obtain order that would block that money until Okemo and Gichuru asd delivered to Jersey.
What I find truly bizzare is the utter lack of any interest in the case by either Tobiko or EACC. Here they have a cut and dry case, with confession to boot. But they'd rather go after Eric Ouko for buying auditing software. I know Tobiko is working on extradition. Which means he has a lot of the evidence why these guys are wanted, including the confession. Is there something, legal beyond my paygrade, that bars him from prosecuting the crooks?
