The fact that one party approached the Court should be very clear that a dispute exists that cannot be sorted out with talks. This is neither Ngilu's nor Swazuri's cesspool. It is a National Issue. So when the Highest Court in the land fails to clearly spell out that Ngilu is encroaching on the powers of the National Land Commission, I begin to wonder if we need this court. This court failed to act properly and send Kenyans to a runoff between Uhuru and Raila, thus handing the Presidency to Uhuru.
The Supreme Court has directed the National Land Commission and Lands Cabinet Secretary Charity Ngilu to hold talks within 90 days over differences in their mandate on land matters.
The court on Thursday said it will give an advisory opinion should the two parties fail agree in the talks.
