Obviously Kivutha "basic structure" case was nuisance value - like most other cases. Like that Tana River case - BBI needs 24 counties and has about 20 buffer. In the end it is very hard to block popular initiative because 4M+ Kenyans already signed up and that shows BBI popularity.

They didn't dismiss it; refused to hear it;  and it had nothing to do with basic structure.

4M collected through forgery and coercion is null and void.
4M signature that IEBC were forced to verify in shabby manner is null and void
40 counties bribed with MCA car grant is null and void - especially when they didn't even care to do public participation.

Now they are in parliament - and trying to short-circuit the 90 days requirement btw 1st and 2nd reading.

You cannot ammend katiba through illegalities.

Well your sterling legal track record is out there. Including telling us that parliament itself is unconstitutional. Those things might matter in public opinion but not legally. BBI remain a 2022 combo - manifesto - and they are right on time. Only the gullible believe there can be referendum in June.

Yes my legal record is 100 times better than yours because you don't even know law 101. You're just supporting anything Raila does. Parliament fate is not yet decided. I think the only thing you think you won was governors suspension - which has reduced governors into District Commissioners. It remain the biggest threat to devolution - handing over governors to whips of DCI/EACC - and reducing the office to zero security of tenure.

BBI fate will be decided by our courts - and it was almost designed to be declared null-and-void.

As for 2022 - you're dreaming of Uhuru backing Raila with BBI :) :) - wake up and smell the coffee - even the most ardent of ODM morons knows such delusion are just delusion.

Uhuru is busy dropping Raila and you cannot even see it - the re-surgence of sacred alliance is enough clue - that Uhuru is playing Raila.

Mumbi Ngugi suspending governor was perfectly legal - if DCI/Kibicho abuse power that is their choice not Mumbi or Robina fault. Corruption is also less in county now due to fear of consequences. If you want governor post to mint cash find something else to do.

BBI 35% is the best thing since sliced bread. It cures tribalism, deadly-scramble for PORK, rural-Nairobi migration, etc. Add hybrid and you can nick it. BBI corrects MPs Kilifi and Naivasha mischief that sullied Bomas and CoE drafts. It what Wanjiku wanted really through years of consultation. They can strengthen SRC to curb MP greed - otherwise Kenyans want gender parity and whatnot - give them their own poison. BBI is mere 1st amendment.

Of course multiple other cases exemplify your legal ignorance - Jomo portrait on bank notes, high court cannot torpedo Maraga advisory, etc. Now ati high court will kill BBI. Dream on.

2022 - we will see, won't we? At least you gave up all delusions of Uhuruto playing Raila - now you have new straw. There was BBI leaders zoom yesterday that asked Mutua to step down for Wiper - to embarass Ruto. That the binding glue - BBI power-sharing agreement.

Only a naive judge will hand over a grenade to kid and hope he doesn't detonate. Corruption has not reduced. What has happened is that governors are stealing as long as they shout BBI.

Governors need to enjoy security of tenure and should only be removed through impeachment by MCAs.

BBI hiyo we shall see - I doubt it will survive the 8 court cases - today was the hearing date.

Anything on the 8 anti-BBI cases? BBI you waiting to die... is a real trojan. If you see the battle-hardened, well-oiled, go-getter Ruto being watermelon - jua ni kubaya - it unstoppable steamroller.

You remind me Kalenjin famous war tactics that always ensare their enemy. It called pulling back - send small boys to attack the enemy - and then let the small boys run for dear life with enemy in hot pursuit - and by the time - they realize they are all dead :). This happen to Uhuru mungiki boys in Nakuru - where they fell hook, line and sinker..only to lose guns and lifes.

You should ask the Brits what poor Nandi did to them for 10yrs until they decided to murder in cold blood Koitatel arap Samoei - a great military tactician - while coming to sign a peace treaty to leave Nandi independent.

The Nandi sustain the war for 11yrs by knowing when to retreat...by having that discipline to know when to lose a battle...and win the war.

"When provided the opportunity, the warriors had decisively struck. When the Europeans had the advantage, the Nandi warriors possessed the discipline to avoid a costly attack. And all this was accomplished by raiding parties, not the combined might of the Nandi tribes."

Anything on the 8 anti-BBI cases? BBI you waiting to die... is a real trojan. If you see the battle-hardened, well-oiled, go-getter Ruto being watermelon - jua ni kubaya - it unstoppable steamroller.
