In fact the only person I think who didn't get it right according to Wakora 4 is Chebukati.

No iebc officials committed any offence,the challenges were systemic....I think Raila had gone to court hoping that the iebc commissioners and secretariat officials were held responsible for the mess so that he would start calling for the disbandment of the commission to find an excuse to boycott election,however it wasn't the case,Nasa need to start campaigns,

Yeap. That was the plan and seem Chebukati had bought into it. Now IEBC staff should get back to work and deliver us another election. It's waste of time and money because nobody impugned the results of the last one. The wakora 4 should be made to pay for this somehow.

Kiai case mentions spirit of devolution...that was part of the goals, weakening central government (Chairperson) and strengthening counties (returning officer)

But it looks like while they was eager to take away his powers(verification), they wanted him to maintain the same level of  personal (not institutional) responsibility (accuracy). Sheer lunacy.

Parliament and judiciary need to make up their minds on finality of constituency tallying center results.

This means the IEBC Chair may in some cases be unable to declare the winner... which is what should happen when the elections are seriously flawed. His old powers to correct 34B created loopholes for tampering.

So imagine on Oct 17 or 2022... the IEBC can declare the elections as flawed... and announce a fresh match... without anyone running to SCOK.

I don't see this ruling as ridiculous. It simply means GET YOUR SHIT TOGETHER. Elections are not guesswork.

Thank you, Robina. Succintly put. :D Thats exactly how I read that judgment too. "CUT THE CRAP! DO WHAT YOURE SUPPOSED TO DO". Thats what the court is saying.

Uber-nonsense Robina. Which law ALLOWS Chebukati to do that?  The law only allows him to hold re-run if any of the candidate don't meet the criteria - 25% in half counties and 50% plus 1 in valid cast votes.

It can only mean if we do another election - and like this one - we have 80-150 forms with issues - Chebukati can reject them - after failing verification - and declare them invalid or fraudulent or whatever votes.

Then remainder 150 will determine PORK. If someone still get half of 25% in half the counties and half of those 150 - then we have new PORK.

SO basically assume of the 150 forms with issues - about 3 constitutuency in every country are valid - the rest are invalid - so 25% if possible - and the 50% is possible.

Now assume those 150 are from certain region only - you get minority elected president - while rest of the country votes are  rejected - because there is verification without CURE.

This means the IEBC Chair may in some cases be unable to declare the winner... which is what should happen when the elections are seriously flawed. His old powers to correct 34B created loopholes for tampering.
