This 1982 moment for Uhuru - Uhuru 2.0 need to be ruthless
« on: September 05, 2017, 08:50:00 AM »
His victory was annulled for the flimsiest of reasons ever advanced in any democracy. The judges like everyone else see him as softie after he cooled down post ICC - Ruto ndio mbaya is all your here. After he wins again on 17th October Uhuru need to read and understand that our constitution is powerful presidential systems - he has all the tools to avoid another maraga mess. He need to stop playing softie - and really play hard ball. If he find that hard to do - I am suggesting he appoint Ruto as acting pork for six months and all these messes will be sorted out. Jubilee have nearly 2/3 of MPs - they just need to buy 20-30 more MPS and they can ammend many parts of the constitution one afternoon. They control 30 plus counties - so they can even ammend all parts of the constitution that requires referendum..by getting signatures..holding a referendum..and fixing some of structural problems.

First priority ought to be to sort of judiciary - to have executive and parliamentary oversight over them - otherwise as of now - the judiciary have connived and grabbed power - and yet they are not elected by anyone.

What you are advocating here is back to the days of Jomo and Arap Moi. what I can tell you is that times have changed. If you think Uhuru can come up with a flimsy referedum and win, you must be dreaming.
Btw, where in this world is a judiciary elected? There are three arms of government, executive, legislative and judiciary. The judiciary is there to enterprate the consistuition and can declare any move by the other arms of government non-constituitional. That is the work of the judiciary.

Democracy works fine when each branch is check-mating another. Our judiciary is above everyone else. PORK and Parliament need to some levers to make sure we don't have rogue judiciary like Odungas and Maragas.

Uhuru has huge mandate in 2.0 if you go by senate and parliamentary figures - MCAS and Governors - so he just need to use it.

There is nothing sacrosanct about the judiciary so that they cannot be criticized or ridiculed. Their history of corruption is as bad as the other two. The case has already been adjudicated so there is no sub judice here. Criticism and chaos that may emerge are for them to ponder.

Noone has a carte blanche as imagined. Moi "put his foot down" and we have a 100% new system that he opposed.

Ouru should go a head and do whatever it is that he wants to do then Kenyans who disagree will react. There is really no need for threats because nobody is going to be cowed with threats, empty or pregnant.

It is just that Pundit has not been paying attention.

Uhuru has done everything he can do to become a dictator so that he can be feared and made President for Life as his later Dictator Father.

1. Amended laws to grant himself imperial powers
2. Become a legislator in chief by reversing the requirements for his signature and replacing his veto with a memorandum causing many illegal laws to enter the books
3. Like his father his goal is to emasculate, bankrupt and eventually kill devolution so he can reclaim that power. Like I predicted way back in 2015, Uhuru will reduce the Counties to entities answerable to a cabinet minister who will in turn issue edicts / decrees. The rigging of seats in areas such as Bungoma is to grant him the short chance to kill devolution. The SCOK has really given him a jolt

I guess they will rig the referendum too at 54%.

Moi too changed the constitution in one afternoon. He came to grief over the same clause a few years later
Quote
255. (1) A proposed amendment to this Constitution shall be enacted in accordance with Article 256 or 257, and approved in accordance with clause (2) by a referendumthe independence of the Judiciary and the commissions and independent offices to which Chapter Fifteen applies;
(h) the functions of Parliament;
(i) the objects, principles and structure of devolved government; or
(j) the provisions of this Chapter.

Jubilee have nearly 2/3 of MPs - they just need to buy 20-30 more MPS and they can amend many parts of the constitution one afternoon. Uhuru can even remove the term limit if he agrees with Ruto. The kind of support they have - mean any amendment will pass parliament or  referendum route. Our constitution is Uhuru biatch.

Now you are overreaching yourself. Lifting a term limit will be a hard sell in RV. Ruto's homeboys like Charles Keter and Murkomen can hardly wait to become the new Biwotts in town.
