Nkaissery Decision to Close Dadaab Nullified

It will take some time for Jubilee to realize that their best approach to matters is through following the letter of the law. A High court judge rules that the decision to close Dadaab was illegal and that Nkaissery lacked the powers (under the law) to make such a call. The High court also nullified the decision to repatriate refugees terming both actions "unconstitutional".

Just for the record the Judge who scalded Nkaissery is NOT Odunga and is NOT Luo and has never been accused, suspected or connected to Raila Odinga or CORD.

The High Court in Nairobi has quashed the government's plan to close down the Dadaab refugee camp.

On Thursday, Justice John Mativo ruled that Interior Cabinet Secretary Joseph Nkaissery and Principal Secretary Karanja Kibicho acted beyond their powers in issuing the directive to close down the camp.

The court also declared the repatriation of refugees unconstitutional and described it as discriminative.

The judge directed the state to adopt mechanisms that would ensure the department of refugees is functioning properly.

Notices published in the Kenya Gazette announcing repatriation of refugees were declared null and void.

Jubilee has instructed the judge to nullify the order to avoid embarrassment. It has seen that it cannot manage to evict refugees to somalia.

But wapi zile pesa walikuwa wametenga?
