Title: Prof Kivutha goes to Supreme court to block BBI
Post by: RV Pundit on November 30, 2020, 11:06:11 PM
I agree with submission but I think it ought to be done at High Court.

For instance, the Governor noted that there are currently 78 different issues proposed for amendments which affect at least 13 of the 18 chapters of the Kenyan law.

According to him, this presents an uphill challenge to those charged with civic education and public participation.

On the issue of whether public officers should use state machinery to drum up support for the referendum, Governor Kivutha argued that it would be an unfair fight for others who do not have the luxury of state resources.

Meanwhile Ndii "Basic Structure" headed for 5 bench - you can bet a sympathetic bench will be entertaining this case. BBI 4.0 has better recall their BBI handchieth and remove judiciary ombusdman :). Otherwise one arrow from Judiciary is more than assured to delay and kill it.

 and 3 others register first victory as Justice Mrima;

1. Grants application for an expanded bench (3/5 judges) CJ to constitute bench.

2. Dismisses Preliminary Objections from the AG and Parliament to strike out Petition.
