Self-proclaimed National Resistant Movement general Miguna Miguna might have spent the weekend at a police station in Lari, Kiambu County, after police refused to free him on Friday despite a court order.
Sources indicate that Mr Miguna, who was picked at his Runda home on Friday morning, was taken to Githunguri Police Station then transferred to Uplands Police Station.
CUSTODY
Police have, however, denied that the lawyer was being held at the station, even though they kept it tightly guarded from Saturday.
On Sunday, his lawyer Edwin Sifuna, Suna East MP Junet Mohamed and Busia Woman Representative Florence Mutua visited the station but the officer in charge insisted that Mr Miguna was not there.
However, Mr Sifuna insisted they had reliable information that the lawyer was detained at the Uplands station.

Uplands I think is among the coldest places in Kenia,up there next to Nandi Hills. He’s lucky it’s dry season ,so it only gets cold for a few hours of the night. I wonder whether Jubilee is deliberately trying to kill him, make his incarceration more painful, or just using Okoyu populace to scare away protestors.

MM's been incarcerated before. He's loud but he's also fearless and built to withstand martrydom. My guess is they're torturing him for info. and the good thing is he's got a mouth and will likely confuse them with a 1001 angles. Basically in a nutshell- an imprisoned MM is action to his words, garners respect and is good for his career.

It's getting a little frustrating because arrest and all these kind of games are knowns known. These are areas that NASA technical team have fully covered. There is plan A, B, C, D to counter jubilee idiots but the break down is at execution level. NASA need to make some adjustments.

It’s hard for anyone, including wannabe Paul Kagames to claim moral superiority and rule of law when they don’t give a fuck about it. I think that is crux of the current upheavals in Kenya.

First of all, there will be no treason charges. Kina Kajwang are being charged with small time crimes like sijui administering illegal oaths and what-have-you. This is what vooke was talking about when he was teasing NRM for using "People's President" rather than just PORK in the oath.
Secondly, Robina, you are advocating for exactly the opposite of law. There are constitutional and legal protections for law-breakers including suspects, accused, defendants, convicted, imprisoned. These are not there for those we subjectively think are deserving but precisely for those categories of people, which is potentially everyone.
Thirdly, absolutely no one is under obligation to keep Muigai's portrait anywhere on their own premises. Miguna did not say anyone was forced to take them down, he asked people to do that voluntarily. It's far less treasonous to get rid of the president's portrait than it is to burn the flag or disrespect the national anthem of a nation, so thank goodness no Americans think these acts should now mean that legal protections afforded to all should be arbitrarily withdrawn from those they find insolent.

The courts ruled that Uhuru and Jubilee won the presidency; swearing in Raila is brinkmanship that GoK can outplay NASA.

If Miguna is to be charged with capital offence - I think he can be kept in a dark room for 14 days. Rumours has it the police had warrant of search and possibly of arrests. Don't know if police can hold him for more than 24hrs without presenting him in court?

It appears Boinett has ignored further court orders to produce Miguna. I wonder if he is smart enought to realize that legally it's his ass on the line, not kamwana's. kamwana has no legal authority to order policemen around. But again, maybe just of those laws that can be ignored.

Their have been two court orders to release Miguna but this rogue government disobeyed them just like they did the court order to open the server. They believe they are above the law. You cannot scream rule of law then disobey the law yourself. Jubilee has painted itself into a corner. They cannot intimidate NASA or even put fear into us. They can even kill Miguna and Raila if they want but that will not change anything to their favor-this cat is out of the bag. When we boycotted the elections on 11/26 and swore in Baba, we crossed the rubicon and we are not going back. Hope springs eternal but for a moment can you come down to reality and realize you've given Uhuru the global approval for this crackdown and nobody really gives a f whatever is happening to NASA and it's folks. Certainly not the global powers like your adopted country US. What would they say when someone swore himself as PORK and another declared he was NRM GENERAL :D. Actually history is not on your side. Raila was in jail for a long time and when he came out he was more popular and more committed to the struggle than ever. Miguna is coming out a new minted leader with more following than ever. Soon he will be impossible to even arrest. Arresting Miguna has done more to elevate him politically than anything Miguna would have done for himself. Miguna right now can ran for office in any NASA stronghold and win without breaking a sweat then you will have to deal with him. If they kill him in Jail he will be bigger than JM in death followed by some of the biggest riots ever seen which ouruto may not survive nationally and internationally, and lastly his family will most likely win an award that will make Matiba's look like champ change.

NAIROBI — The most widely watched television stations in Kenya are shuttered, and the government has defied a court order to return them to the air. Opposition politicians are under arrest, and journalists have also been threatened with jail. And the government has officially designated some of its opponents “an organized criminal group.”
“This is a new crisis for democracy,” said Willy Mutunga, a former chief justice of the Kenyan Supreme Court, who left the bench in 2016. “Defying a court order is subverting the rule of law.”
The events in Kenya over the past week are a stunning about-face in a country praised mere months ago as a shining example of democracy, when the Supreme Court overturned a presidential election, and the winner, President Uhuru Kenyatta, agreed to abide by the ruling. That case was hailed as a powerful display of judicial independence and a win for the rule of law.
But now many Kenyans fear their country is sliding away from democracy. The coming days, they say, may be critical in determining what direction the country will take.
“Kenya hasn’t seen anything like this before — this is unheard-of,” said Ahmednasir Abdullahi, who represented Mr. Kenyatta before the Supreme Court last year in several election cases. “When there is a court order you don’t obey, you look like a rogue state.”
In Kenya, some are now likening Mr. Kenyatta to Daniel Arap Moi, the authoritarian president who ruled the country for 24 years, before finally leaving office in 2002. Mr. Moi outlawed political parties, banned many foreign and local newspapers and magazines, and detained and tortured those designated as political opponents, including writers and intellectuals.
But shutting down broadcast stations “never happened, even under Moi,” said George Kegoro, executive director of the Kenya Human Rights Commission, a nongovernmental group that is a leading human-rights authority in the country.
The current tensions have their roots in last year’s presidential election, when Raila Odinga, Mr. Kenyatta’s longtime political rival, challenged his loss to the president. The Supreme Court ordered a new election, but Mr. Odinga withdrew before the second vote, saying the process remained unfair.
When Mr. Odinga’s supporters boycotted the polls, they handed Mr. Kenyatta an easy victory. Mr. Odinga refused to concede defeat and threatened to take a parallel “oath” as “the people’s president.”
The government said it would regard the action as treason, and Western diplomats pleaded with Mr. Odinga to cancel the ceremony. But he pushed forward with the “oath,” and the United States government, in a formal statement, stopped just short of denouncing the move as unconstitutional.
Mr. Kenyatta summoned media owners last week and warned them not to cover the Odinga event at Uhuru Park, in downtown Nairobi. But on Tuesday morning, Kenya’s biggest stations broadcast live from the park before Mr. Odinga’s arrival.
Government officials then disconnected them.
Mr. Odinga did take the oath that day.
On Wednesday, three journalists at NTV slept in the newsroom after being tipped off by police sources that officers were stationed around the building, waiting to arrest them. They spent Thursday night in a safe house, and on Friday, a court granted them anticipatory bail, effectively protecting them from arrest. So far, they have not been charged with any crime.
A court in Nairobi on Thursday ordered the government to restore the stations “with immediate effect.”
But by early Monday morning, it had still not complied.
The government’s aggressive stance toward the media and the political opposition may have ended up lending legitimacy to what many observers had dismissed as political theater by Mr. Odinga.
“The whole world was condemning Raila Odinga for what he had done,” said Mr. Abdullahi, the president’s onetime lawyer. “The government had the moral high ground. For me, this is the government shooting itself in the foot.”
Though Kenya’s Constitution guarantees freedom of expression and freedom of the press, the Kenyatta government, and the president personally, have long had a rocky relationship with the media. Mr. Kenyatta has said on several occasions that newspapers are useful only for “wrapping meat.”
Last year, Kenyatta aides issued a directive to suspend all government advertising in four major newspapers, and several journalists have been fired for refusing to toe the government line in their coverage.
But the television blackout is universally agreed to be the most dramatic showdown between the government and the press in the history of Kenya’s young democracy. The shuttered stations reach nearly 70 percent of Kenyan viewers, according to the latest figures from GeoPoll, a survey firm.
None but the wealthiest Kenyans can watch television online, where the stations continue to broadcast.
The government is discussing reopening the stations with the media outlets, conditioning a return to the air on their agreement to coverage restrictions, according to an official with knowledge of the confidential conversations. The media outlets deny any negotiations.
If government officials continue to disregard the order to turn the stations back on, the court could cite them for contempt, or even order them jailed, lawyers say. If those orders are also ignored, that would be a clear sign of a weakened judiciary — and a teetering democracy.
But a bigger concern now is whether the government takes action against Mr. Odinga. An arrest, many fear, might be greeted by widespread public resistance and set off violence — especially since the crackdown seems to have polarized ordinary Kenyans.
“We are hurting as a country,” said Job Ogutu, a mechanic who works in downtown Nairobi. “The gains we made are no more. The government is supposed to be the custodian of all laws, but it’s using these same laws to hurt and oppress its people.”
Many have abandoned hope for dialogue between the two political leaders and are instead digging in behind the man they support.
That’s the turn of events that Mr. Mutunga, the former chief justice, finds most worrying, because each political heavyweight could muster crowds of thousands to do his bidding.
“I keep on having nightmares about a possibility of an ethnic civil war,” he said.
Mr. Mutunga pointed to the widespread conflict that followed the 2007 election.
“That’s our history,” he said. “We have had these issues before. And now one side controls the machinery of violence — they have the army, they have the police. Who is going to restrain them?”
The United States government said in a statement last week that it was “deeply concerned” about the interference with the media, and the United Nations Office of the High Commissioner for Human Rights called on the government to “respect and implement” the court order to end the blackout.

Exactly. To some minds, only one law matters, the one that says Muigai can act as President. The rest are details. It's not really LAW being defended here, it's might. Keep that clear and you will not be confused by the contradictions.

ODM believes the people are with them - the 'cowards' are just 3 people and NASA is otherwise intact - while to me the crack showed the trio are unwilling to put their neck on the line for Raila. The grievances are not shared evenly. The Kamba I doubt would shed a drop of blood for secession.
This debate is easy to settle - see if there will be a new presidential election before 2022 like ODM has demanded. Or a new people's republic in its absence.

The better question is "which law bars him from swearing a president". For one to commit a crime there has to be a law against that action and it is not up to the police to decide whether Miguna committed a crime or not. Miguna has the right and freedom to express himself and shame on you Robina for cheering, aiding and abating police brutality and dictatorial tendencies. Miguna was very careful in the way they worded and conducted the "swearing in". Only an imbecile would confuse it with the "real swearing in". There is no way any court of law that would confuse that would convict Miguna or Raila of Treason and that is the reason they do not want to produce him in court. What Miguna did clearly was an act of resistance, protest, self determination and freedom of expression whichever way you slice it. The longer Miguna stays in Jail the better for the movement because such acts of cowardice only solidifies the peoples resolve and confirms there worst fears of ouruto regime. If the intended motive is to scare NASARITES, then its achieving quiet the opposite. This are not the days of MOAS when your views were relevant. The losers are the tax payers who will pay dearly for the time he spent in Jail. If he dies at the hands of the evil murderers, the more tax payers will pay to his family. Miguna is a natural citizen of Kenya and has never renounced his Kenyan citizenship. He was never given the opportunity to appeal the draconian administrative action and therefore he was not deported but forcibly sent into exile. This is a very temporary situation because Miguna will return to Kenya triumphantly after Ouruto are gone.

MM renounced his Kenyan citizenship to become a Canadian citizen eons ago. I believe Canada has dual citizenship with a handful of countries but Kenya isn't one of them. He may've applied for dual citizenship in Kenya because of recent change concerning naturalization etc. with the new constitution.

The same high court judge kimaru ruled miguna never lost his birthright kenya citizenship....anyway no need to waste time with constitution crap, no one cares about constitution except NASA moderates.
