The truth is an apology coming or Itumbi paying up Lenaola.  I doubt Lenaola has called his bluff knowing he has something to hide.

SCOK turning out to be much tougher than ICC. Which way for Itumbi? I would suggest he continue hiding under Maggie Kenyatta skirt because when Lenaola is done with him Mwilu will jump on him and finish him off. Even with apology how is his position in office of president attenable?

Gosh, this judge wants to retire on Itumbi's dime.  Wololo. 

Next up NASA should man up and initiate private prosecutions of the thieving bastards.  It's an open secret that Chiloba and others rigged at their behest.

Itumbi is done...but the sad thing is the Kalenjin mafia that set him up and provided him with this fake  information will be no where to be found which most likely this are the same people who leaked msando car location to Moses Kuria. Kalenjin mafia since the days of moi have maintained a spy ring on all politicians and business man across the country. This spy ring should be disbanded

JSC and the law society have not come out strongly against political attacks being instigated on the whole of the judiciary. I don't remember Raila calling the judiciary names when Uhuru won five yes ago

I think Lenaola integrity has been beyond reproach so his decision was due to possibly fake planted forms

That is way to go. Mwilu obviously is guilty as hell so she is silent. Let us get the very bottom of this. This horrible decision by Wakora 4 will be revisited severally and may in the end undermine the judiciary independence. Judiciary ought to exercise their power with great caution. If they joke around like they've done - then they will be emasculated by the people.

He also think because he lives in state house and has security he cannot be served. That ended when Kibaki failed to serve Moi. Now the law allows litigants to serve each other through the media - including social media!

He does not understand that what is coming would completely ruin him. At his age to be found by a court to be a liar is first of all to guarantee that his public job is gone! He cannot serve on a board of governors of a school unless nobody knows or is not interested in kicking his ass. He can witness his own wife being raped by Pundit but cannot be put on the witness stand. If an advocate tries, he risks contempt proceedings and referral to the LSK.

That is why most people opt to settle out of court.

I know Lenaola. Settling would be out of question. Itumbi would have to take out ads on the front pages of the newspapers and publish an unqualified apology. He is one guy not interested in wealth and money.

Safaricon always leak like a sieve not that hard to obtain someone phone logs but to use something obtained without court orders in a manner that itumbi did is a recipe for disaster.  I know how Nsis guys bait people with mpesa....Kenya is a lawless jungle...it's good when these things are highlighted so Wanjiku can learn about privacy laws.

I like how Itumbi shouts about his freedom of expression whilst he and other Jubilee propagandists can't stomach NASA folk utilising the same rights.

In many ways this is an interesting case that will define a lot of things. It is close to Jaramogi Odinga vs Nation Newspapers & Oloitiptip where the respondents lost heavily in that precedent setting case.

We have a sitting Supreme Court Judge as the plaintiff and a spoilt State House trouble maker with the ear of the president on the other side. That pits the Judge against the president.

If this matter to the wire I expect it at the SCOK where Njoki and Ojwang would like the robots they are side with Itumbi against their own comrade. Maraga, Wanjala, Mwilu would side with Lenaola. That would leave Ibrahim to cast the winning vote. I believe if in the unlikely event Uhuru has stolen the election successfully, Ibrahim would side with Njoki or fall "sick" again.
