Title: How Uhuru Kenyatta Tried and failed to Influence Judges
Post by: Omollo on September 03, 2017, 12:51:58 AM
Like I wrote, The MUllah and Ngatia had written a judgment which they wanted Maraga to read.

The Ethnic Rag (http://www.nation.co.ke/news/politics/Behind-the-scenes-attempts-to-arm-twist-judges/1064-4080728-sc44kw/index.html) writes:
Quote
But it wasn’t easy. The Supreme Court judges were aware they were being watched and whatever decision they made would be celebrated by a section of the political divide and criticised by the other.

Sources say that from the outset, CJ Maraga and Lady Justice Mwilu had made up their minds that the process matters more than the outcome and if the process is wrong then the outcome is equally wrong.

On the other hand, Justice Wanjala is said to have been conscious of the criticism levelled against the decision issued by the bench he sat on in 2013 that ruled against the Coalition for Reforms and Democracy candidate Raila Odinga.

With Justice Mohammed Ibrahim indisposed, the focus by some influential Jubilee-affiliated officials was to get Justice Lenaola to change his mind and cast his lot with Justices Ojwang’ and Ndung’u.

“The person who tilted the decision was Justice Lenaola,” former Law Society of Kenya CEO Apollo Mboya told the Nation. “Had he allowed himself to be influenced, we would have ended up with a tie among the judges which would have meant that the results as declared by IEBC on August 11 stand.”

SECRET VENUE

After the hearings concluded on Tuesday, the judges then retreated to a hotel in Nairobi’s Upper Hill.

They later relocated to a secret venue within the city and agreed to switch off their phones.

However, that did not stop state agents from going after them.

Meanwhile, a Cabinet Secretary [Fred Matiangi] and two city lawyers [Ahmednasir Abdillahi and Fred Ngatia] on at least three occasions visited one of the judges’ house in Nairobi selling what they said was the government’s position.

From our sources, the judge would welcome them and tell them that they would decide according to the law and what is good for the country.

LEAKED INFORMATION

This, the three misunderstood the judge was going to play ball. In fact, one of the lawyers [Ahmednasir Abdillahi]  even assured his friends that things had been sorted out.

But by Thursday afternoon, one of the judges [Njoki Ndung'u] is said to have leaked out information that things would not go the way of the Independent Electoral and Boundaries Commission (the first respondent) and President Uhuru Kenyatta (the second respondent), prompting more attempts to make the judges change their minds — targeting at least one more judge [Smokin Wanjala] to change his mind.

Attempts to talk the four judges out of nullifying the election, the Sunday Nation has learnt, went well past midnight on Thursday when the people who were making efforts to influence the judges gave up.

This could have informed the decision by politicians allied to Jubilee including Aden Duale and Kipchumba Murkomen and some lawyers not to appear in court on Friday morning when the Supreme Court made its determination despite having been present throughout the proceedings from Sunday to Tuesday.

CHARACTER ASSASSINATION

The judges having made the determination, there seems to have been a full-blown character assassination campaign targeting them..

So far, malicious information is being spread targeting Chief Justice Maraga, Deputy Chief Justice Mwilu and Justice Lenaola.

For instance, some claims emerged on social media that the CJ had flown out of the country immediately after delivering the decision.

However, on Saturday the CJ was at the Nairobi Central SDA Church, Maxwell, where he is a member.

Other posts that appeared to have been from newspaper websites — but which have been shown to be fake — targeted the personal and professional life of the deputy chief justice.

Other fake pieces of information have maliciously linked Justice Lenaola to a controversial MP among other wrongdoings.

If matiangi did that then he should resign in shame. As for Ngatia and ahmednassir they should never practice law in kenya again.....no wonder the 2 amigos have never lost any court case

I now understand that a lot of challenges are coming on. Apparently IEBC officials were told which winners to announce regardless. This happened a lot in western and kisii areas. Even the so called winners were astounded at what happened. Most jubilee mps and Mca will fall. It's not over until the fat lady sings.

Umeskia wapi hii fununu? Link please?

Reading that DN piece above, I have to reiterate what I've said several times: no amount of money would convince me to take the place of these judges or IEBC. I will thank God at mass today that the judges proved strong and withstood these folk and for their wellbeing.

Uhuru will meet a violent death like Jezebel. That's the only thing that can bring closure to his wonderful country.

Every detail coming out makes me wonder whether the 54% was inflated. Maybe it just wasn't the ambiguous integrity but the 54% cooked

What's up with this Damascus moment?  Am glad you finally found your voice. I know I owe you an apology.

Ai Pasi, that's a bit aggressive.  I have personally seen jubilidiots walking around. I'm 100% sure many voted for him.  What this election has exposed is that they, (jubilidiots) are nowhere near 50% of the electorate.

Psychology tells us that the moderate ones might actually switch sides.  Folks like being associated with winners.

Are you perhaps saying that someone decided on 54% as a nice number and decided to ignore the real ballots?  That would explain the  we will be back with 70+1!" cries.  They've already settled on that one... Lol

Pastor is cracking heads huko. Com vibaya sana. He's left the jubilidiots bewildered because they realise unlike them pragmatic folk that fear and respect God separate themselves from the evils of crime, corruption and impunity when the proof is laid out

Nice you mention pragmatic folk Bryan....??. Aroused my attention.

This country has so much promise if only all that live in it had equal opportunity and strive and work hard for an honest reward and an honest living. Right now it is just a feeding trough to a few greedy ones. We thank God for the likes of Justice Maranga!

Those servers and the truth must be fully exposed. The orders were appropriately far reaching (with the limited time there was) that if IEBC had allowed the audit, we would have had a good view of what went down; probably also a good clue towards tracing wether Msando's credentials were used to access the servers. Of course a deeper investigation would show more, including the fact that the register wasn't touched, it still has dead voters. The so-called audit by KPMG was only a smokescreen cosmetic desk review.... Jubilee agreed to the so called audit only to the extent that it didn't actually touch the actual register to expunge the no -existent voters, a good cover up if you asked me.

Even as NASA pays attention to the repeat election, NASA must not let up on exposing what is in those servers and the KIEMS kit. We must exorcise the practise of doing evil and getting away with it. It has created an enormous culture of impunity that is mindbogling!
