Classic moving target.  That is NASA case. They are inventing theories. Which look nice except it's not backed by data. When it challenged. They invent another one. Now they know from auditing going on that Real Original Form 34 As that forms are not fake. Now it's new theory - Bermuda Triangel.

This bombshell falls flat because NASA has failed to produce a single photo image of original Forms 34A to show how 6days of darkness were used for cooking. Despite having agents countrywide, not a single contradictory form can be produced. The conclusion is unlikely to favor them. It is more likely to be that - the reason NASA cannot produce their own agents' photo images - is because they are exactly like those in IEBC hands and in fact prove the elections are valid.

My personal maxim is never guess what you can confirm.

Pheroze has good reasons to doubt 11K forms; they were unavailable and were only availed over 1week after the declaration. Why can't they sample any number from these polling stations and demand a recount as well as verifying from the KIEMS kits how many voters went to the stations?

They should easily demonstrate that there is a consistent pattern of stuffing by;
1. Move votes than KIEMS identified voters
2. Less total votes than actually reported
3. Lesser votes for Uhuru than declared

But NASWA is arrogantly going for annulling of the entire results purely on suspicion. They need to confirm their worst fears

If Jubilee was not cowardly they would have subpoenad them just as NASA did for IEBC. Petitioner to provide evidence against himself 8) 8) No 5th Amendment in Kenya.

What I would like to see from this petition - apart from likely NASA case being dismissed with costs - is the court demanding to know where the 10K Forms 34A were for 6days. IEBC owes us that much, and if someone held them up for dubious intentions they should be sanctioned accordingly, including jail term. It's a breach of transparency.

Lets wait for IEBC to respond to this 11k forms were missing. The originals may have been available (brought in via POSTA or ROS delivering them physically) but the scanned ones that could be easily shared were not available- due to transmission challenges. The is difference btw we cannot share the forms now - and they are not available.

I think we are ignoring the fact that the petitioner submitted 25k documents, and choosing instead to focus on the lawyers and their horse hair.  The judges will rely on the evidence submitted more than the lawyering we have witnessed.

Now I understand NASWA's presser after they walked out of Bomas to the effect that Chebukati had told them the ROs took personal responsibility for the results.

NASWA demanded t see all forms 34A Before declaration while Chebukati said duly filled forms 34B sufficed

Possibly.  Nowrojee was of the opinion that this missing step and delay unacceptably exposed the system to possible tampering.  It would also mean some forms were eventually scanned and sent from funny locations.   

I don't know this system.  But with message queueing system you can send the scanned forms from anywhere(including challenged - even completely unconnected -  areas).  The scan won't arrive on time, but when the opportunity arises, it will eventually arrive and retain the correct timestamps and GPS coordinates.

Now we are seeing none of that but aspersions from Pheroze Nowrojee and his poor English.

IEBC have laid bare their systems after court order - so let's have that evidence. Pheroze is of course wrong on matter laws - Chebukati just need form 34B to make Form 34C. He didn't need to verify anything because other IEBC staff below him had verified and declared final results.

That is the suprising part. All they ever did is to compare the statistics with scanned form 34As - then make wild allegations. The most surprising thing is the NONE of NASA agent at polling station disputed the tallies or refused to sign...except at National Level where they walked out before announcement of the results.
And photos. Yeah.  With hardly any time for the parties to get information.  In fact I hear there are still issues at this very moment.  They obviously didn't take the court order seriously.  I hope they are cited for contempt.
