This is to condemn IEBC gazetted posting of Returning Officers throughout the country in preparation for the August Elections as biased, ethnic profiling and planned pre-rigging of elections.
Returning Officers are a key cog in the management, transparency and credibility of elections. This is more so given their new status in law as the final arbiter of final results to be pronounced at the constituency level. Their appointment and deployment must therefore be without ethnic or other blemish.
The Constitution demands the exercise of equal opportunity for all Kenyans. Any Kenyan should serve anywhere in Kenya, and not be discriminated against on the basis of creed and ethnic origin. Reverse discrimination is also abhorred.
We in NASA are therefore unable to discern the criteria and logic of IEBC posting members of only one community as Returning Officers to serve in certain electoral areas, especially the western region. Kenyans want to know what special qualifications these officers uniformly hold so as to be specifically selected to work in western. Alternatively what special features of elections has IEBC identified to be supervised in western that necessitate appointment of officers from a single ethnic group?
Is IEBC telling Kenyans that only members of a single community could be found within its staff to qualify for posting to western? Do they, for instance, have better geopolitical and linguistic knowledge of the region than any other IEBC officers within IEBC? What special instructions do those officers have as members of a select community? Does IEBC have a shortage of staff from other ethnic communities, and if so, why did that happen?
These postings cannot therefore be a coincident. We find this exercise devious because the officers were not being posted as new recruits. Instead, IEBC found it necessary to post these officers under cover of “rotation”, a deceitful way of electoral theft machinery being set up.
Suffice it to conclude that IEBC is paying lip service to the tenets of ethnic integration in the workplace and more so, has embarked on an unfettered pre-rigging of elections. We reject those postings not because we are against the officers but want to protect their integrity against negative perceptions their posting has generated to the effect that sinister they are an advance team to steal the August Elections. We therefore ask IEBC to revoke the postings.
It is instructive that IEBC has been uncomfortable with this power and has threatened to appeal against a ruling that protects results from being interfered with by Commissioners sitting in Nairobi.
Apparently satisfied that their appeal may lack merit, IEBC Commissioners are now circumventing the law by unethical ethnic profiling of Returning Officers appointment and deployment.

The IEBC has basically confirmed the over-representation of Kikuyus and Kalenjins in their ranks.
