President Uhuru Kenyatta’s maternal uncle Peter Gathecha is at the heart of the Sh6.3 billion NYS looting, new investigations indicate, putting the First Family at the centre of the massive financial rip-off and also in a series of billion-shilling scams that have engulfed Uhuru regime.
The Kenyan Weekly has established that Ben Gethi, a key suspect in the NYS Scandal adversely named the President’s uncle as among architects of the scam.
Before his surprise confession which was done in camera on October 4, the flamboyant businessman pleaded for protection saying he had received death threats.
Gethi, 31, told the Parliamentary Accounts Committee that at his age, he had no financial muscles to sign large-scale deals –– the kind of contracts Gathecha had allegedly signed with NYS. PAC is headed by Rarieda MP Eng. Nicholas Gumbo (ODM).
The two are said to have supplied fuel through a company known as Horizon and had been paid a staggering Sh500 million when the NYS probe started.
Gethi revealed that they supplied fuel at Sh104 per litre against the market price of Sh78 between 2014 and 2015.
He also admitted that the Energy Regulatory Commission (ERC) did not licence him to supply fuel on wholesale price as required by law.
And in what could unravel the NYS puzzle, documents presented before PAC shows that Gathecha had several phone conversations with key NYS suspects.
For instance, Gatecha had more than 30 phone calls with Gethi days before the scandal broke out.
A communication chart from the Criminal Investigation Department also indicates that Gathecha had numerous phone conversations with ex-NYS Deputy Director General Adan Harakhe.
Harakhe, whose IFMIS password was used to approve many of the fictitious payments, has already been charged in court.
Waiguru has in all her public appearances defended Harakhe, and presented him as a victim of cartels in the Devolution Ministry.
The same chart shows Gethi had over 150 phone calls with Deputy President’s William Ruto’s aide Farouk Kibet.
Peter Gathecha is a blood brother to Uhuru’s mother, Mama Ngina Kenyatta.
He is said to have been awarded a huge tract of land by Jomo Kenyatta making him one of the largest land owners and wealthiest families in Kenya.
The land is said to straddle Kasarani Stadium, Lucky Summer Estate and Kayole Estates in Nairobi’s Ruaraka Constituency.
However, the new revelations now put the graft crisis facing the country deep inside President Uhuru Kenyatta’s family, debunking earlier speculations they are too rich to steal.
All sleaze that has dogged the four-year-old administration has always been heaped on Deputy President Ruto.
Just recently, it emerged Uhuru sister and cousin are among owners of companies are suspected to have irregularly pocketed millions of shillings in the Sh5.3 billion “HealthGate” scam.
Uhuru’s sister Nyokabi Kenyatta Muthama and cousin Kathleen Kihanya are directors of a company that pocketed Sh41 million in questionable pay-outs.
Last month, The Kenyan Weekly exclusively reported that nominated Senator Beth Mugo’s son Murugi Mugo was involved in Sh30 million forgery to steal from the National Quality Control Laboratories, one of the key parastatals in the Ministry of Health.
When he appeared before the Nicholas Gumbo-led PAC, Gethi requested to be grilled in camera and the details of his shocking testimony have remained confidential.
However, the PAC Hansard seen exclusively by The Kenyan Weekly indicates that Gethi claims he was introduced to key Jubilee leaders by the President’s uncle.
These include ex-Devolution Minister Anne Waiguru, Treasury Cabinet Secretary Henry Rotich and suspended PS Peter Mangiti.
In October, Gethi reported to the police that his life was in danger over evidence he was expected to hand over to PAC.
He claimed he received the death threat in a note that was given to his driver by an unknown motorcycle rider.
“Ben come Tuesday, we will be watching you closely. Whatever you have which you will give to those people at Parliament which does not concern you but concern others, let it not reach them. If the information reaches them, then something will have to be done even if you think they will protect you. We know where to get your loved ones,” reads the threat written in Kiswahili.
In public, Gethi told PAC that Waiguru and the head of Banking Fraud Investigations Unit Joseph Mugwanja interfered with investigations and gave biased statements to sway the probe.
“Waiguru worked with Mugwanja to fabricate documents in NYS and I have evidence to prove it…There is absolutely no link to corrupt intentions adduced against me whatsoever,” Gethi told the committee.
Opposition chief Raila Odinga, believed to be aware of every detail of the rip-off, recently termed the NYS Scandal as “President Uhuru Kenyatta’s scam”.
Raila said Waiguru who is at the centre of the scandal is the President’s protectorate.
“The protection Ms Waiguru is enjoying clearly demonstrates that the NYS scam is President Uhuru Kenyatta’s scam and its chief architect Anne Waiguru is his protectorate.”
Every time Waiguru is cornered over the scam, she has always threatened to ‘spill more beans’.
“Equally loud is the silence on aides and associates of the Deputy President who have been linked to the NYS scam by evidence, indicating they received money from the other suspects in the scam,” Raila said.
Investigators to the scandal have trained their sights on transactions worth Sh15 billion made through 28 financial institutions as they seek to unmask the faces behind 40 companies.
Documents provided to PAC, and subsequently availed to the CID and EACC has raised to Sh6, 323,743,655 funds which were transacted through the 28 commercial banks.
So far, key allies of Ruto including Farouk, Elgeyo Marakwet Senator Kipchumba Murkomen and his legal Advisor Korir Sing’oei have been mentioned in the scandal.
However, the revelations that Gachecha was involved in the scam now adds a new twist to the rip-off which has so far seen over 20 people charged with various offenses.
It also explains why ex-CS Anne Waiguru, seen as a key mastermind of the scam, is yet to face justice.
