It might or it might not be.  But it is up to the offended person to sue; serikali is wasting judicial resources on cases they have no business going after.  If Mutungaru Judges were worth their salt, they should automatically throw out such cases.

I have come to realize that most Kenyans don't really know the law.
This guy needs to say he's being denied his free speech rights.
Govertnments are the most oppressive entities any place can have. Top politicians always want more power and if unchecked it can bring misery to the masses. Thru is accumulating power instead of giving it to institutions that need it. And any institution perceived to be a threat is quickly dismantled or weakened to a point it no longer functions effectively.
