From I read, he is not being held to allow "investigations". He is simply being held until the magistrate can hold a bail hearing on Friday. That is not unusual in serious cases. Here, the prosecutor has argued that this is a serious case because Mr. Kuria, while on bail one matter (ethnic abuse), has then engaged in even more extreme transgressions (calling for widespread panga violence). It seems right and proper that breaches of bail conditions should not be taken lightly; in most places they justify a locking-up.

The justice system should have on call judges. To lock someone because there i no judge is injustice itself. If someone like this can be locked up guess what happens to a regular guy.

As far as I can tell, the issue is not that there is no judge. Both parties appear to have placed significant new material before the magistrate, and he has stated that he needs a few days to review it. (Keep in mind that a typical judge/magistrate will be dealing with several cases on any one day.) I see no reason to believe that a different judge/magistrate---assuming an idle one can be found--would necessarily be able to conduct a review of all the material (new and old) in less time.

Someone like what? Are you suggesting that he should have been treated differently because he is "someone like this"? If so, why? All over the world, people who breach bail conditions routinely get locked up, and it is not unusual for people to stay locked up until a hearing on bail conditions.
