High Court Judge Justice George Odunga. He has ruled that criminal proceedings carried out without the consent of the Director of Public Prosecutions are “unconstitutional, illegal, unlawful, null and void”.
The Judge said that attempts by DCI to charge a person with a criminal offence without the consent of the DPP "amounts to abuse of his powers. It is therefore null and void."
By holding a constitutional office, the DPP is supposed to determine cases without the direction of any person, which puts him as a central figure in the administration of criminal justice.

One of the things we battled for years is the police deciding to charge or not charge a person. These decisions were made by a simple OCS who then ordered a "police prosecutor" to take the man for arraignment.
In a small village or town, the OCS knew the magistrate with whom they drunk & fucked malayas together.
Pundit should know. There was a place I knew Kapkatet - Tengecha. I think the courts were in Sotik but they'd take suspects to Kisii or Kericho. Quite a beautiful place but like Mogogosiek completely isolated because nobody cared. Now get in trouble there and your only option is to pay the bribe they're demanding. Today a millenial would say I'll just call my father!
Those days how? You had to book a phone call. Don't imagine the ocs didnt know you'd do that. Anyway apart from fucking the exchange girls they listened into all calls sup motu 😂 Nobody forced them. They then spread it around and no doubt the OCS would hear about it and be very cross.
So we got the 2010 constitution. We had to shout to force Tobiko to remove police prosecutors. We threatened to go to court. He removed them although they didn't go immediately.
So what Kinoti is doing is trying to reverse that. Why?
To the greenhorn he is tired of the obstruction by the DPP and wants action. Not true. Prosecution can be punitive. A person takes a plea is denied bail and remanded. Kinoti is simply trying to reintroduce torture to force suspects to sign confessions. He wants to force a return to status quo ante!
He must never succeed. Does the DPP fuck up. Oh yes. That's because a DPP came but the entire office remained unchanged. The corrupt remained intact. There's old corruption and new corruption. State counsels that had established fiefdoms in outlying areas weren't even moved.

Consigliere went to court. He wanted to play his usual games of getting a stay then sitting on it for eternity.
The judge told him nyet. Unless he is contesting the validity of the judgment and bases it on law, the sentence stays. I can see a situation in which Kinoti is summoned to the court. If he comes the judge will have one question: Have you complied with the order? He says No he's ordered taken down to start serving his sentence.
