A judge has warned Kenya Revenue Authority to stop killing local companies in the guise of collecting taxes.
Justice Weldon Korir ruled that the taxman has become a monster in itself by killing local businesses over alleged failure to pay taxes which in turn affect thousands of families whose bread winners are rendered jobless once the companies are shut down.
Hongera Judiciary
KRA shouldn't be overzealous or they will be no goose to pluck.

Some of KRA powers are unconstitutional. They have almost Kangaroo court system where they charge you for tax offences - and fine you upto 1m or so kshs. I have appeared before one. They also enjoy lots of discretionary power to close business.
That is elephant in the house. KRA should never become the judge and executioner of tax dispute.
They should apply for court orders to close premises....

KRA is super ultra corrupt. They have a department that sanitizes anyone, including big and small companies for a price. They can make anyone clean, or dirty as far as taxes are concerned. To make things worse, the sick department can be bribed by anyone to kill a business competitor in so many ways!

The judge is right. KRA is destroying a lot of businesses in Kenya. There is hardly anyone with a business in Kenya who has no issues with KRA. Flourishing businesses would mean more taxes to be collected. Killing businesses will in the long run be negative even for KRA.

They have too much power. So they can abuse power. The power should be taken from them and given to judiciary. They should not shut business or close bank accounts without getting a court order.
Sadly the court of appeal -overturned such good high court decisions.

KRA staff are under immense pressure to meet ever growing targets hence this aggression.
I'd say more power to them but whenever they lose cases they should compensate businesses all lost income

Absolutely.
Too much power without accountability.

But on the other hand,

Search and seize is different from closing. The fakas come with nyororo and crazy padlocks to close the factory gates/ key premises. They are totally rogue with state house and police backing.
